Last Will & Testament
The Last Will & Testament of me, Nathaniel Beauchamp of Saint Georges Hundred, County of New Castle and State of Delaware, as follows, to wit;
- 1st. I will, order and direct, that my Executor hereinafter named shall sell at public sale, the whole of my Estate, whether it be real, personal, or mixed, except the unexpired terms of my manumitted colored servants, which shall be disposed of at private sale, and also excepting that part of my Estate hereinafter be ___. And after the payment of my funeral expenses, and all the debts, which I shall justly owe at the time of my decease. It is my Will that the net proceeds thereof together with all monies arising from the collection of debts or otherwise shall be disposed of as follows, to wit
- 2nd I give and bequeath to my dear wife, Sarah Ann Beauchamp, the one moriety or half part of my Estate aforesaid - my said wife at her option taking my colored girl Rachel, at the sale of ten dollars per year for the unexpired term which she may then have to serve otherwise, the said Rachel shall be disposed of, as in hereinbefore provided for, the sale of my other colored servants.
- 3rd I will, order, and direct that the remaining moriety, and residue of my estate (except my watch) which I give to my sister's grandson, Nathaniel Denny, shall be divieded into thirteen equal parts, and I do give and bequeath to my sister Elizabeth Clark, one of the said parts, and to my half brother, Joshua Deputy, one of the said parts, and also Sarah Ann Smith, Mary Jane Smith, Elizabeth A Smith, Joseph Marritt, Ann Eliza Marritt, James Marritt, Thomas B Marritt, James Denny, Francy Denny, Nathaniel Denny, and Sarah Elizabeth Johnson, (all grandchildren of my sister Elizabeth Clark's) each one of the said parts. Lastly, I do hereby nominate and appoint my aforesaid wife, Sarah Ann Beauchamp, and my friend Charles Tatman to be the executors of this, my Last Will & Testament, and I hereby declare that, my said executors shall not be responsible for the acts, deeds, receipts, defaults, or the disbursements of each other, but cash only for her or his own acts, deeds, receipts, defaults or disbursements
- And i do hereby revoke all former wills by me heretofore made declaring this only, to be my Last Will & Testament
- In witness whereof I the said, Nathaniel Beauchamp, the Testator to this, my Last Will & Testament, my hand and seal have subscribed and set this twelfth day of February in the year of our Lord, one thousand eight hundred and forty two.

- Signed, sealed, published and declared by the said Nathaniel Beauchamp, the Testator and for his Last Will & Testament in presence of us, who at his request and in his presence, and in the presence of each other, have subscribed our names as willingly thereto.

- Personally appeared Henry P Baker and Richard Hayes, the two subscribing witnesses to the foregoing Will, who being solemny sworn on the Holy Evangels of Almighty God, did say that they saw Nathaniel Beauchamp, the Testator sign and seal the aforesaid Instrument of writing and heard him publish, pronounce and declare the same to be his Last Will & Testament, that at the time of his so doing, he was to the best of their belief, of sound and disposing mind and memory, that it was at the request of the Testator in his presence and in the presence of each other, that they subscribed their names thereto
