This is the last Will and Testament of me MARY QUENNELL of the City of Chichester, Spinster, that is to say, I constitute and appoint GEORGE BALCHIN of Arundel in the County of Sussex, Gentleman and WILLIAM JACOB HOLLEST of Farnham in the County of Surrey, Gentleman, Executors of this my Will. I give and bequeath all my monies and securities for monies, goods, chattels and Personal Estate whatsoever and wheresoever unto the said GEORGE BALCHIN and WILLIAM JACOB HOLLEST their Executors and administrators upon trust to collect and get in my said Personal Estate and to convert it into money so much and such part and parts thereof as shall consist of money or securities for money. And I declare that my said trustees and the survivors of them, his executors and administrators shall stand and be possessed of and interested in the monies to arise and be produced by and from such sale and conversion. Upon trust, in the first place to pay thereof my just debts and funeral and testamentary expenses and subject thereto upon trust as to one equal moiety or half part thereof, lay out and invest the same in Government Security or upon mortgage of freehold or long leasehold property in England at Interest and I direct that the interest, dividends and annual produce thereof shall be paid to my sister ELIZABETH the wife of WALTER CALHOUN for her sole and separate use and benefit and without being subject to the control, debts or engagements of her present or any future husband for her life and after her decease upon trust to pay and apply and dispose of the principal monies, the dividends, interest and annual produce whereof are to be paid to my said sister for her life to each person or persons upon such trusts and to for and upon each and intents and purposes as my said sister shall notwithstanding reverture? by her last Will and Testament or any review? thereto give, devise, direct, innuit or appoint and for default of such gift, devise, direction, innuitation or appointment and so far as the same if incomplete shall not _____ upon trust for my sister SARAH QUENNELL, her executors and administrators and as to the other moiety or half part of the said trust monies and premises, I direct that the same shall be paid and transferred to my said sister SARAH QUENNELL in case she shall be alive and unmarried for her sole use and benefit but in case she shall be married then I direct that the said trust monies and premises and also the monies if any which may arrive from default of appointment by my said sister ELIZABETH CALHOUN shall be laid out and invested and held for my said sister SARAH upon the same trusts and to and for the same ends intents and purposes and with sole life power of testamentary appointment as are hereinafter declared concerning the trust monies and premises given and bequeathed for the benefit of my sister the said ELIZABETH the wife of the said WALTER CALHOUN and in default of such testamentary appointment by my said sister SARAH QUENNELL and so far as the same if incomplete shall not extend I direct that the said last mentioned trust monies and premises shall be held by my said trustees or the survivor of them, his executors and administrators upon the same trusts for the benefit of my said sister ELIZABETH the wife of the said WALTER CALHOUN as are hereinbefore expressed limited? and declared of and concerning the original share and as to any monies and premises in respect of which the trusts, gifts and bequests hereinbefore limited and declared shall by means of the deaths of parties or otherwise be incapable of taking effect, I declare that my said trustees and the survivor of them his executors and administrators shall stand possessed of the same upon trust for the benefit of my ___ of this in the same manner as if I had died intestate. I give devise and bequeath to the said GEORGE BALCHIN and WILLIAM JACOB HOLLEST their heirs executors and administrators all estates? vested in me by way of trust to hold by them upon the trusts after____? The same provisions and I do hereby declare that it shall and may be lawful to and for any trustee for the time being or executor of this my will who may be an attorney or solicitor notwithstanding his acceptance of the office of trustee or executor under this my will to make the same professional charges for all business done and all attendant time and trouble given and bestowed by them in or about the execution for the trusts and powers herein contained as my said trustees and executors or the survivor of them his executors or administrators would have been entitled to make if they or he not being a trustee of this my will had been employed by the trustee or executor for the time being of this my will ____ at rule of equity to the contrary thereof in any wise notwithstanding and I declare that in case my trustees or either of them shall decline? or become incapable to act or devise to be discharged from acting as a trustee of this my will it shall be lawful for him or his executors or administrators to appoint a new trustee who may act in the same manner as of originally named in this my will. I declare that the receipts of my said trustees and executors for the time being shall effectively discharge any person paying money under this my will or the trusts thereof that such trustee and executor may submit matters to arbitration vary securities for others of a life nature, take securities or give time for payment of any debts, accept a ___ position on or omit to sue for debts reasonably deemed doubtful, bad or desperate and pay claims on such proof or evidence as they may consider beneficial for my estate and I further declare that my trustees and executors for the time being shall only be answerable or accountable for his own acts and defaults and not for any banker, broker or any other person with whom they may have deposited any trust monies and that they may reimburse themselves all costs and expenses incurred in or in relation to this my will or the trusts thereof. And I revoke all former wills and codicils by me at any time made and declare this only to be my last Will and Testament. In witness whereof I the said MARY QUENNELL the testatrix have to this my last Will and Testament comprised in this and the two preceding sheets of paper subscribed my name the twelfth day of January in the year of our Lord one thousand eight hundred and forty seven ---- MARY QUENNELL ---- Signed, published and declared by the above named MARY QUENNELL the testatrix as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other both of us present at the same time have hereunto subscribed our names as witnesses.--- JOHN P. Whereas I am at present lodging and boarding with LUCY BARNES of the said City, Hopseller? At the rate of fifty pounds per annum and whereas I have lately paid in advance to the said LUCY BARNES the sum of one hundred and forty pounds for which sum the said LUCY BARNES has agreed to board and lodge me for three years from the twenty fifth day of December last now then I declare that in case I shall die at any time during and previous to the expiration of the said term of three years I hereby remit unto the said LUCY BARNES all _____ demand in respect of the said sum of one hundred and forty pounds for so ___ by the said term as shall be unexpired at the time of my death on account of my said board and lodging and I give and bequeath the same accordingly to the said LUCY BARNES in consideration of her attention to me and kindness to me during the time that I have resided with her.
