Transcript of the Will of Henry JUPP

(1799 - 1868)

This is the last Will and Testament of me Henry Jupp of Strood Farm in the Parish of Petworth in the County of Sussex Farmer.

I devise all my Real Estate (except real property if any vested in me as Trustee or Mortgagee) unto my dear Wife Jane absolutely.

I appoint my said Wife Executrix and my friend John James Boxall of Park Farm in the Parish of Pulborough in the said County Farmer Executor of my Will and after and subject to the payment of my debts and funeral and Testamentary expenses I bequeath my personal Estate and effects unto my said Wife Jane for her absolute benefit.

I devise all Real Estate if any vested in me as Trustee or Mortgagee to my said Wife and the said John James Boxall their heirs and assigns Subject to the Trusts and equities of the same respectively .

I declare that my Executors and Assigns shall be answerable for their own respective acts receipts and defaults only and shall be at liberty to retain and to allow to each other out of the moneys coming to their hands by virtue of this my Will all expenses incident to the execution thereof and a reasonable compensation for time and trouble . I revoke all former Wills .

In Witness whereof I the said Henry Jupp the Testator have to this my said last Will and Testament set my hand the Seventeenth day of September one thousand eight hundred and fifty nine.

Signed by the said Henry Jupp the Testator as and for his last Will and Testament in the presence of us present at the same time who at his request and in his presence and in the presence of each other have subscribed our names as Witnesses.

Proved at Chichester the 15th day of April 1869 by the Oath of Jane Jupp the Widow Relict of the deceased one of the executors named in the Will to whom Administration was granted power being reserved of making the like to John James Boxall the other Executor named therein.

The Testator Henry Jupp was late of Strood Farm in the Parish of Petworth in the County of Sussex Farmer and died on the 31st day of December 1868 at Strood Farm aforesaid.

Effects Under £500 Blagden & Upton, Solicitors, Petworth.

Record of Probate

On the 15th day of April 1869, the Will of Henry Jupp late of Strood Farm in the parish of Petworth in the County of Sussex Farmer deceased, who died on the 31st day of December 1868 at Strood Farm aforesaid was proved in the District Registry attached to Her Majesty’s Court of Probate at CHICHESTER, by the Oath of Jane Jupp of Strood Farm aforesaid Widow the Relict of the deceased one of the the Executors therein named she having been first duly sworn to administer.

Power being reserved of making the like Grant to John James Boxall the other Executor named therein. Extracted by Blagden & Upton, Solicitors, Petworth.

Effects under £800 No Leaseholds

NOTES:

1. Henry has at least two children alive at the time of his death by his first wife Mary Starmer yet he does not mention either of them. Instead he leaves his entire estate to his widow Jane absolutely, he must have been confident that she would look after them in her Will in due time, which of course is what she did. We can infer from this that Jane was indeed fairly close to her step children and this is not too surprising since she probably looked after them from their very early childhood.
