Will
I, Emeline Deputy, widow, of Appoquininimink Hundred, New Castle, and State of Delaware, do make and publish this my last Will & Testament, in manner and form following, that is to say:
- First: I give and bequeath unto my daughters, Mary Wright and Elizabeth Tharp, all of my cooking utensils and crockery ware, and all of my bed clothing, not heretofore set aside by me for my son David B Deputy, to be divided as equally as may be between the said Mary and Elizabeth, share and share alike: I also give and bequeath to the said Mary and Elizabeth, each one chest.
- Second: I give and bequeath unto my son Daniel W Deputy, my family Bible, one silver dollar, one pair of silver mounted spectackes, and one feather bed, weighing not less than forty pounds: and I give and bequeath my son John P Deputy, my gold ring, one pair of silver mounted spectacles, and one feath bed weighing not less than forty pounds.
- Third: After the payment of my just debts and funeral expenses, I give and bequeath all the rest, residue, and remainder of my property, consisting principally of monies and notes in the hands of Cornelius J Scott, and in the hands of Nathaniel Williams, unto my two sons, Daniel W Deputy, and John P Deputy, to be divided equally between them, share and share alike. And in the event of either of my said two sons, dying without lawful issue before arriving respectively, at the age of twenty-one years, then it is my will and desire, that the survivor shall be the sole heir of the brother so dying, to all the property bequeathed to either by this Will. And further, in the event of both my said sons dying without lawful issue, before arriving at the age of twenty-one years, then it is my will and desire that all the property bequeathed by me to my said sons, shall be divided equally between my son David B Deputy, and my daughters, Mary Wright and Elizabeth Tharp, or their legal issue.
- Fourth: As my son David B Deputy has some property in his own right, devised from his Father, it is not my intention to make him any bequests, except the contingent one above mentioned: neither is it my intention to bequeath anything to my daughter Rachel Jones.
- Fifth: I hereby nominate, constitute, and appoint Cornelius J Scott Esq. of Kent County, Maryland, Exexcutor of this my Will: and it is my desire that he may be appointed by the proper authority, Guardian of my two sons Daniel W and John P Deputy.
- In Witness whereof I have hereunto set my hand and seal, this second day of July in the year of our Lord, one thousand, eight hundred sixty nine.

- Personally appeared before me Benjamin Gibbs, Register of Wills, in and for New Castle County aforesaid, James Reynolds and Nathaniel Williams, the two subscribing witnesses to the foregoing instrument of writing, who being severally qualified according to the law, did say, that they saw Emeline Deputy the testator sign and seal said instrument of writing and heard her publish and declare the same to be her last Will & Testament, that it was in her presence, at her request, and in the presence of each other, they signed their names thereto as witnesses, and that at the time of their so doing, the testator was to the best of their belief of sound and disposing mind and memory. In witness whereof I hereunto set my hand at New Castle this 21st day of September A.D. 1871.
