Transcript of the Will of Jane JUPP
(1801-1874)
This is the last Will and Testament of me Jane Jupp of Petworth in the County of Sussex Widow.
I appoint Thomas Jupp of Pitherington in the parish of Pulborough in the said County Farmer and Manning Milton of Petworth aforesaid Brewer Executors and Trustees of my Will and I devise any real estate vested in me as Trustee or Mortgagee unto the saidThomas Jupp and Manning Milton their heirs and assigns subject to the equities affecting the same respectively. I bequeath to my daughter Sarah Jane Ward absolutely the worsted work made by herself and my deceased daughter Mary Jupp.
I also bequeath to the said Sarah Jane Ward if she shall wish to possess the same but not otherwise my Silver Spoons of a shell pattern with the sugar tongs to match. And in case my said daughter Sarah Jane Ward shall elect to take the before mentioned silver articles. I direct that the same shall be valued by my Executors and the value thereof reckoned as part of her share of my residuary estate.
And as to the residue and remainder of my personal estate I bequeath the same unto the said Thomas Jupp and Manning Milton their executors and administrators Upon Trust to call in and convert into money my residuary estate and thereout to pay my debts and funeral and Testamentary expenses.
I devise my freehold messuage in two tenements with the appurtenances situate at Pitherington aforesaid now occupied by the said Thomas Jupp and his under tenants and all other my real estate if any unto and to the use of the said Thomas Jupp and Manning Milton their heirs and assigns Upon Trust to sell my said Messuage hereditaments and real estate in such manor as to my said Trustees may seem best And also my residuary personal estate and the proceeds of sale of my freehold hereditaments and real estate all hereinafter referred to as my residuary estate.
I direct my said Trustees and executors to stand possessed of the same Upon Trust for and I bequeath the same unto such of the following persons namely William Jupp a Son of my late husband Henry Jupp by his first Wife and my said daughter Sarah Jane Ward as shall be living at my decease and the Child or Children then living and who shall attain the age of twenty one years of such of them the said William Jupp and Sarah Jane Ward as shall die before me and of James Jupp a deceased Son of my said husband by his first Wife and of my deceased daughter Catherine Elizabeth White in equal shares but so that the Child or the Children Collectively of one parent shall take one share only .
And I direct and declare that the Child or Children of my said daugheter Catherine Elizabeth White shall not be entitled to receive any part of my residuary estate until he she or they shall have first allowed or paid all debts due and owing to me on Promissory note or other security from George White the husband of my deceased daughter Catherine Elizabeth White. I declare and direct that the receipts of my said Trustees to purchasers and others for money paid to my said Trustees shll be sufficient discharges for the same .
I declare that my said Trustees shall be answerable for their own respective acts receipts and defaults only and shall be at liberty to retain and allow to each other out of the Moneys coming to their hands by virtue of this my Will all expenses incident to the execution thereof and a reasonable compensation for time and trouble.
In Witness whereof I the said Jane Jupp the Testatrix have to this my said last Will and Testament set my hand the fifth day of November One thousand eight hundred and seventy two.
Signed by the said Jane Jupp the Testatrix as and for her last Will and Testament in the presence of us present at the same Jane Jupp time who at her request and in her presence and in the presence of each other have subscribed our names as Witnesses.

Proved at Chichester the 15th day of September 1874 by the Oaths of Thomas Jupp and Manning Milton the executors named in the Will To whom Administration was Granted.
The Testatrix Jane Jupp was late of Petworth in the County of Sussex Widow and died on the 7th day of August 1874 at Petworth aforesaid.

Record of Probate
On the 15th day of September 1874, the Will of Jane Jupp late of Petworth in the County of Sussex Widow deceased, who died on the 7th day of August 1874 was proved in the District Registry attached to Her Majesty’s Court of Probate at CHICHESTER, by the Oaths of Thomas Jupp of Pitherington in the Parish of Pulborough in the said County Farmer and Manning Milton of Petworth aforesaid Brewer The Executors therein named they having been first duly sworn to administer.

NOTES:
1. Jane JUPP née KNIGHT was the second daughter of George and Mary KNIGHT and married Henry JUPP in 1826 in Guildford.
2. She was therefore the sister of Katherine MILTON née KNIGHT whose youngest son Manning MILTON is appointed as one of the Executors of her Will.
3. The identity of Thomas Jupp is unknown.
4. Jane’s daughter Katherine Elizabeth WHITE married George WHITE the son of John WHITE who was the brother of Jane JUPP’s brother-in-law Thomas WHITE. Katherine died in 1868 and in February 1872 George remarried one Emma Julia Annie WRIGHT. He was variously described as a commercial clerk, commercial traveller or commercial agent and seems to have been a bit of a wheeler dealer and had obviously borrowed money from his mother-in-law.
5. George’s children were Mary Jupp WHITE, Archibald WHITE and Katherine Jane (Kate) WHITE. Mary & Kate WHITE never married and ran a boarding house in Surbiton, at which I used to stay when my mother came to England when I was a lad. I remember them both well.
6. Henry JUPP’s first wife was Mary STARMER who he married in Pulborough in 1820 and by whom he had three children, James (1821 - 1872) William (1823 - after 1881) and Sarah b. 1824, but probably died as an infant.
7. Mary STARMER must have died about 1825 and Henry almost immediately remarried Jane KNIGHT, probably to look after his three infant children. Thus it is likely that Jane would have been fairly close to her step children and so they are remembered in her Will.
8. William JUPP, son of Henry is shown on the 1881 census as being a corn dealer and living in Brighton with his wife Sarah and one son James.
