Transcript of the Will of Cecil Whittaker SHERWIN

(1860 - 1928)

THIS IS THE LAST WILL AND TESTAMENT of me CECIL WHITTAKER SHERWIN of Number 8 Beechcroft Avenue Stafford in the County of Stafford

I appoint my dear wife Mabel Eliza my daughter Alice Catherine and my friend Richard John Young of Westthorpe Rowley Park Stafford aforesaid (hereinafter called my Trustees) to be EXECUTORS and TRUSTEES of this my will and I declare that the expression my Trustees shall include them and the survivors or survivor of them or other the Trustees or Trustee for the time being of this my will where the context so requires or admits.

I give and bequeath unto my Trustees my freehold messuage and hereditaments situate and Numbered 8 in Beechcroft Avenue Stafford aforesaid and the whole of my household furniture and articles of domestic or household use or ornament upon trust that my Trustees shall sell call in and convert into money the same and shall invest the nett proceeds thereof with power to vary such investments from time to time and shall stand possessed of such investments in trust to pay the income thereof to my said wife during her widowhood and after her death or remarriage upon trust for all my children who have attained or shall attain the age of twenty one years in equal shares and if there shall be only one such child the whole to be in trust for that one child. Provided always that if any child of mine shall die in my lifetime leaving a child or children who shall survive me and attain the age of twenty one years then and in every such case the last mentioned child or children shall take (and if more than one equally between them) the share which his her or their parent would have taken if such parent had survived me and attained the age of twenty one years and as to the residue of real and personal property whatsoever and wheresoever of or to which I shall be seised possessed or entitled at my death or over which I shall have a general power of appointment or disposition by will I give and bequeath the same unto my Trustees subject to the payment thereout of my funeral and testamentary expenses and debts and the payment of all estate and all other death duties payable on my death in respect of the whole of real and personal estate upon trust for my said wife absolutely

And I declare that it shall not be necessary for my Trustees to take an inventory of my said household furniture or articles of domestic or household use or ornament and they (other than my said wife) shall not be concerned to see to the insurance thereof or be liable for any loss or damage that may happen thereto from any cause whatsoever and I also declare that my Trustees may postpone the sale and conversion of the said messuage and hereditaments Number 8 Beechcroft Avenue Stafford aforesaid and the said household, furniture and articles of domestic or household use or ornament for so long as they shall think fit and that the rent profits and income to accrue and the use thereof from and after my decease from and of such part thereof as shall for the time remain unsold and unconverted shall after payment of all incidental expenses and outgoings be paid and applied and appropriated by the person or persons and in the manner to whom and in which the income of the proceeds of such sale and conversion would for the time being be payable or applicable under this my will if such sale and conversion had been actually made

BE IT KNOWN THAT Cecil Wittaker Sherwin of 8 Beechcroft Avenue Stafford in the County of Stafford died there on the 31st day of May 1928 AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament of the said deceased was proved and registered in the Principal Probate Registry of His Majesty's High Court of Justice, and that administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to

Mabel Eliza Sherwin of the same address Widow the Relict Alice Catherine Sherwin of 26 Sandy Lane Rugeley in the same County Spinster Daughter of deceased and Richard John Young of Hesthorpe Rowley Park also in the same County Gentleman the Executors named in the said Will

1. This Will does not show the occupation of Cecil, but in the 1881 census he is listed as a commercial clerk and on his marriage certificate in 1884 he is shown as a commercial traveller, he appears to have done quite well for himself to be able to have an estate of over £2,000 on his death in 1928.

2. His Will indicates that he had more than just the one child, but only Alice Catherine is named and then only because she is named as Executrix.

3. We need to find the Will of Mabel Eliza, which might shed more light on the children of the marriage.
