Transcription

I Asher Stone of the County of Henderson and State of Kentucky, do make and ordain this my last Will & Testament.
Item 1st. My will and desire is that all my just debts be paid out of any money that may be in my possession or that may be coming to me—In case it should not be sufficient, then so much of my property to be sold to meet the demands against my Estate as may be necessary
Item 2. I lend to my wife Sarah G. Stone one third of my Estate during her natural life and at her death to be equally divided between my children herein after mentioned.
Item 3. I give to William L. Stone one negro man named Washington which negro he has in his possession, and is to account for in the division of my Estate, to him and his heirs forever.
Item 4. I give to Milly Ann F. Gregory one negro woman Betsy which negro woman she now has in her possession, which negro woman she is to account for in the Division of my Estate to her & her heirs forever. It is also my will that all that portion of my Estate, which may be coming to her after my death shall vest in William L. Stone & James M. Stone as Transfer for the use and benefit of her, and the heirs of her body, and after her death, the remainder to be divided between the Heirs of her body, and after her death, the remainder to be divided between the Heirs of her body forever.
Item 5th I give to James M. Stone one negro man, Randal which negro he has in his possession and is to account for in a Division of my Estate, to him and his heirs forever.
Item 6th. I give to Mary E. Easter one Negro woman Sarah, which negro woman she has in her possession, which she is to account for in a Division of my Estate. It is also my will that all that portion of my Estate which may be coming to her after my death shall vest in William L. Stone and James M Stone, as Trustees for the use and benefit of her, and the heirs of her body, and after her death, the remainder to be equally divided between the heirs of her body.
Item 7th. I have given to Asher J. Stone five hundred Dollars in money, which he is to account for on a Division of my Estate, after my death to him and his heirs forever.
Item 8th. I have given to David G. Stone three hundred Dollars in money, and I also give him a negro boy Washington about twelve years old, which he has in possession, which he is to account for on a Division of my Estate, after my death, to him and his heirs forever.
Item 9th. I have given to John E. Stone three hundred and twenty five Dollars and hereby give and devise to him the sum of Ten Dollars as his portion in and to any part of my Estate.
Item 10th. It is will and desire, that all my Children be made Equal in the division of my Estate after my death, except John E. Stone, who is to have nothing more from my Estate than he has already received, except the Ten Dollars contained in the above devise.
Item 11th. My will and desire is that my land be sold to the highest bidder on a credit of one, two and three years, and the money to be equally divided amongst my children, with the exception of John E. Stone, who is to have nothing more than Ten Dollars as above devised.
Item 12th I hereby appoint William L. Stone and James M. Stone Executors of this my last will and Testament. Given under my hand this 7th of May 1850. Asher Stone.

This last Will and Testament of Asher Stone dec’d was proved in open Court, according to law, by the oaths of A. J. Morrison & Wm B. Vansant subscribing witnesses thereto, and ordered to be recorded and the same is truly recorded. (E. 593). Attest Will D Allison clk.
