State of Louisiana Parish of Claiborne

To the Hon Judge of the 11th[illegible] Judicial Dist Court of the State of Louisiana in and for the parish of Claiborne. The petition of Washington B Nicholson a resident of your State & parish with respect represent that he is owner of fife[sic] eights (5/8) of one undivided tract of land in common with the legal heirs of Tatum Wafer deceased to wit: Amanda E Wafer surviving widow, Puella E Wafer wife of Francis A Hilly, James C Wafer emancipated, also the following Minor children, John M. Richard T. George R. and Tatum M Wafer. That said land is situated in your parish & State. That said land is held in common with the above named heirs--said land described as follows to wit: The W 1/2 of section (22) twenty two & N 1/2 of SE 1/4 & S 1/2 of the NE 1/4 & NW 1/4 of NE 1/4 of same section and E 1/2 of NW 1/4 & SE 1/4 of section twenty seven all in Township twenty one Range Six West, containing in all Seven hundred & Sixty acres more or less. That petition is the owner of five eights of said land. That it cannot be divided in Kind. That Pet. is anxious for a partition of said lands, so that he may enjoy his portion of said lands. Pet. avers that it is necessary for special Tutors to be appointed to represent the Minor children as mentioned above & that a family meeting is necessary to determine of the sale of said land to effect a partition. Premises considered pet pray for an order of partition and order of sale to effect said partition and that said sale be made upon twelve months time or upon such terms as the family Meeting May determine. Further pray that Special Tutors be appointed to represent the Minors in said partition to with: For John M Wafer T S Meek, Richard T J D Pennington, George R. W C Boring & for Tatum M Wafer James C Baker. Also that an order for a family Meeting be granted & that a commission issue to some Notary Public to convoke said family composed of the following relatives & friends of said Minors. Thomas B Wafer W C Boring M T Nicholson James S Meek, J D Pennington, to advise as [illegible] the interest of said Minors as to the terms of the sale of said land. Further pray that Amanda E Wafer Puella E Wafer & husband Francis A Hilly & James E Wafer for themselves & J S Meek, J D Pennington, W C Boring & James C Baker as special tutors be cited to appear & answer hereto & after a final hearing Pet have Judgment of partition & a decree for sale of land & for all orders necessary & for general relief (signed) Young & Hill Attys for Pet. I accept service & [illegible] in the prayer of the foregoing petition, waive time & [illegible] of law. Also waive copy of Petition & citation (signed A E Wafer F A Hilly, P E Hilly J C Baker J S Meek W C Boring J D Pennington, J C Wafer.

State of Louisiana Parish of Claiborne

By reason of the law & by further reason of the petition, it is ordered that a family meeting be held on set forth in the prayer of the petition & that the land described in the foregoing petition be partitioned between the Plaintiff & Defendants. after a sale of said land which is hereby ordered upon such terms as the family Meeting May Recommend, and that the following parties be appointed as special Tutors to wit: for John M Wafer J S Meek, for Richard T Wafer T D Pennington, for George R Wafer William C Boring & for Tatum M Wafer Jas C Baker & that they have notice of the filing of this petition & that John R Ramsey Recorder & Ex off Notary Public be commissioned to convoke & hold the family meeting. This done & signed at office this 9th day of December A. D. 1867. (Signed) Hyden A Kennedy Clk Dist Court.

State of Louisiana Parish of Claiborne Succession of Tatum M Wafer Dec'd. To J R Ramsey Recorder & Ex off Notary Public in & for the Parish & state aforesaid Greeting: You are hereby commissioned empowered & required to make a division & partition of certain lands in Kind belonging to the Succession of Tatum M Wafer Dec'd, owned in common by W B Nicholson & the heirs of said succession & that the following persons to wit: Joshua Willis, James C Baker & James M Scaif[illegible] are all appointed as experts to aid in making said division & partition and due return make hereof according to law, Given under my hand & seal of District Court having as yet no Parish seal, this 17th day of October 1868 (signed) M Callahan Dy Clk D. C. & Ex off Dy Clk of Probates.

State of Louisiana Parish of Claiborne WeJ C Baker & Joushua Willis do solemnly swear that we will faithfully & impartially partition & divide in Kind the land hereinafter described between the legal heirs & representatives of Tatum M Wafer Dec'd & W B Nicholson of said Parish to the best of our belief & understanding so help us God: Sworn to & subscribed before me Dec 28th, 1868 (Signed) J R Ramsey Recorder & Ex off Notary Public. Be it known that I J R Ramsey Recorded & Ex off Notary Public in the said parish and state duly commissioned & sworn by virtue of the annexed commission to me decided by M Callahan Dy Clk of the District & parish Court in & for the parish of Claiborne, proceeded on this day after having qualified J C Baker & Joshua Willis as Experts according to law to make a partition in Kind of the following described land situated in the parish to wit; The W 1/2 of Section twenty two (22) & the N 1/2 of the SE 1/4 & S 1/2 of the NE 1/4 & NW 1/4 of the NE 1/4 of same Section & E 1/2 of the NW 1/4 & SE 1/4 of Section twenty seven 27 in Township 21 twenty one of Range Six 6 West, Seven hundred & Sixty acres more or less between the legal heirs & representatives of Tatum M Wafer Dec'd & W B Nicholson of said parish as follows to wit: beginning forty one feet South of the half mile on the Eastern line of Section twenty two & run due West to within two hundred & fifty yards of the half mile line dividing Section twenty North & South & then run North one hundred yards, thence West four hundred yards thence due South one hundred yards, thence due west forty one feet, South of the half mile line to the west line of Section twenty two which includes the North half of said Section twenty two. Except the NE 1/4 of the NE 1/4, making two hundred & Seventy Six & 3/4/100[sic] acres more or less with all the improvements thereon which was set aside and allotted to the legal heirs & representatives of T M Wafer Dec'd, & all the balance of the land to wit: The N 1/2 of the SE 1/4 & South west quarter of section twenty two except that portion lying south of the half mile line dividing Section 22 North & South above alluded to, and described as the E 1/2 of the NW 1/4 & the SE 1/4 of Section twenty seven with all the improvements thereon in Township twenty one of Range Six west allotted to W B Nicholson, the said Nicholson pay the heirs of T M Wafer eight dollars per acre for the excess of land by him received in this partition, which accounts to 8 or nine acres more or less to be determined by Measurement. In proof of which I have caused said Experts with W B Nicholson & Mrs. A E Wafer Testrix to Sign these presents in presence of the attesting witnesses & me said Notary on this 28th day of Decr, 1868.
