December Inferior Court of Pleas and Quarter Session 1775 The Last Will and Testaments of Daniel LEE, James POYNER, and Joseph WILLIAMS deceased was in open Court exhibited proved and the respective executors qualifyd by taking the oath by law perscribed all in due form of law and was ordered to be recorded as followeth ----

In the name of God Amen, I Daniel LEE of the County of Currituck being in sound mind and memory Thanks be to Almighty God for the same do therefore make and ordain this to be my Last Will and Testament in manner and form following--- Viz --First I recomend my soul unto the hands of Almighty God who gave it to me and my body I give to the earth from whence it was taken to be buried in a christain like manner by at the discresition of my executors hereafter named and as for my temporal estate I despose of as followeth.

Imprimis: I give and bequeath unto my Son Nathan LEE the middle peace of the land I now live on according to the bounds as the land is laid of to him an his heirs forever and if my said Son Nathan LEE should dye without heir lawfully begotten of his body I give the said land to my Son Elias LEE and his heirs forever.

Item: I give and bequeath unto my Son Rasha LEE seventy five acres of land called the Oak Ridge and the head of the entry to him and his heirs forever and if he should dye without issue lawfully begotten of his body I give the said land to my Son John LEE and his heirs forever.

Item: I give and bequeath unto my Son Linton LEE the uper part of my plantation containing seventy five acres more or less to him and his heirs forever and if he should dye without heir lawfully begotten of his body I give ye said land to my Son Elias LEE and his heirs forever.

Item: I give and bequeath unto my Son Daniel LEE the lower part of my land joining the widow HEETHs land containing seventy five acres more or less to him and his heirs forever and if he should dye without heir or issue of his body lawfully begotten I give ye said land to my Son John and his heirs forever.

Item: I give and bequeath to my Sons John LEE and Elias LEE one hundred acres of land to be equeally divided lying in Buck Skin swamp to them and their heirs forever and if either of my Sons John or Elias should dy without heir or issue lawfully begotten of their body the land I give to ye survivor Brother and his heirs forever.

Item: I give and bequeath to all my Sons now living a paracel of new pattened land lying betwixt the Survey(?) and my plantation to be equeally devided between them and their heirs forever.

Item: I give one grindstone and one croscut saw to all my Sons now living to be used by either of them when ever they want as long as they last.

Item: I give and bequeath to my Daughter Jean LEE one feather bed and furniture whereon she lodges to her and her heirs forever---- Furthermore I desire my Daughter Jean LEE may have the use of the house my Son Nathan LEE now lives on as much land as he can lend after my deceas as long as she lives single or will live on ye said land.

Item: I give to my Son Linton LEE one long gun to him and his heirs forever.

Item: I give to my Son Elias LEE one musket gun to him and his heirs forever.

Item: I give and bequeath to my Son Nathan LEE one feather bed and furniture to him and his heirs forever.

Item: I give to my Son Rasha LEE one feather bed and furniture to him and his heirs forever.

Item: I give to my Son Linton LEE one feather bed and furniture being the bed I usally lye on to him and his heirs for ever.

Item: I give to my Son Elias LEE one feather bed and furniture that he usally lyes on to him and his heirs forever.

Item: I give to my Son John LEE the feather bed and furniture he usally lyes on and my hunting gun to him and his heirs forever --- one cow and calf and the colt my mare is now with fold with if it she lives to rais it, to him and his heirs forever.

Item: I give to my Son Daniel LEE the feather bed and furniture he usally lyes on to him and his heirs forever.

Item: I give to my Daughter in Law the Wife of my Son Luke LEE deceasd one cow and calf and the and her increas to be for Mary LEE Daughter of Luke LEE I likewise give to Son Nathan LEE forty shillings to be layed out in schooling of Mary LEE Daughter of Luke LEE deceased and one ewe and lamb to ye aforesaid Mary LEE to her and her heirs forever

Item: When all my just debts and funeral charges is paid the remainder part of my estate not given away I give to be equeally devided between my children then living. I also appoint my Sons Nathan LEE and Linton LEE to be my executors of this my Last Will and Testament in testimony whereof I have hereunto set my hand and seal this 4th day of December one thousand seven hundred and seventy one and in the Twelth year of our Reign. /s/ Daniel [his D mark] LEE and a seal
