Aldewyk in the parish of Pageham. Certain tenements held of the archbishopric of Canterbury, now void by the death of John de Offord, late elect and confirmed, by service of rendering to the archbishop at his manor of Pageham 13s 4d yearly
He held no other lands &c in the county.
He died on 12 May, 23 Edward III.(1349)
Margaret daughter of William de Hardeshulle, a minor in the king’s wardship, four years of age at Michaelmas last;
Beatrice daughter of Nicholas, the deceased, of full age, married to Otto de Grauntsoun, knight;
Elizabeth daughter of Thomas de Seyntomer and Pernell his wife, aged eight years at the feast of St Margaret last, and Alice sister of the said Elizabeth, aged seven years at the Purification next are his heirs.

He died on 4 May, 23 Edward III. Heir not known.

KENT. Inq. taken at Derteford, Saturday before St Luke, 23 Edward III.
Menstre in the Isle of Sheppey (Scapeya). 103s 4d rent held, with a carucate of land in Kyngeston by Portesmuth, co. Southampton, of the king in chief by service of a sore sparrow-hawk yearly at Michaelmas.
Faukham, Frenyngham, Darent, Southflete, Stone, Holirode, Shanecountewelle, Herteley, Horton, Leghe, Penshurst and Asshe. A messuage, three carucates of land, 6a meadow, 60a wood, ten marks rent and rents of 100 hens and 50 eggs, and the advowsons of the church and chapel of Faukham, held, to him and the heirs male of his body, with reversion to Otto de Grandissone and Beatrice his wife and the heirs of the said Otto, of the bishop of Rochester by service of a moiety of a knight’s fee.
He died on 10 May last without heir male of his body. Heirs as above. (Beatrice is said to be aged 30 years and more).

LINCOLN. Inq. taken at Barton, 8 January, 23 Edward III.
Rotheuel. A messuage, 3 carucates of land, 15a meadow and a water mill. Rotheuel, Cocouold and Thorisway. 100s rent.
All held of the lord de Bello Monte, who is in the king’s wardship, by service of a knight’s fee.
He died on Thursday before the Nativity of St John the Baptist last. Heirs as above, but how the jurors know not at present. (Hardeshulle is here spelt Ardesel.)

Rothewell and Swalowe. A messuage in Rothewell and 3 carucates of land in Rothewell and Swalowe with a water-mill and 100s rent, held of the barony of Bayeux (Baiocis) by homage and fealty.
He died on Thursday after St John the Baptist last. Beatrice, wife of Otto de Grandi Sno, aged 40 years and more, is his heir.

LINCOLN. Partition of the manor of Rothwell, late of Nicholas de Malemayns, knight.
Rothwelle. The manor is divided into three parts, viz. the east, the west and the north.
Pourparty assignd to Elizabeth and Alice, daughters of Pernell de Sancto Omero, kinswoman of Nicholas Malemayns, knight, deceased, to be held when they shall attain full age.
The east. A grange and ‘carthouse,’ with chamber annexed, a square dovecot &c. (full details given, with tenants’ names), including 56a. land on the west side of the town, marked with a cross (signatas cum cruce), 46a on the east side, with the same mark (signo), and in linges eastward and in Southdale, 25a of linges and 44 cultivated acres of linges with the same mark, 10a meadow in the meadows of Smithfeld and Kingesenges, marked with the same mark, 1lb cummin from the heir of John atte Grene ; and the three parceners shall have a free tenant in common, viz. the heir of William Denys, who renders to each of them 12d yearly, and all the parceners shall have free ingress and egress at the gates of the said manor.
Pourparty assigned to Margaret, daughter of William de Hardeshull, to be held when she shall attain full age.
The west. A hall and chamber, with kitchen and round dovecot &c. (full details given, with tenants’ names), including the west part of the garden with water, up to a certain pit (pittum), which is placed for a mark between the said garden and the garden which falls to the north part, certain tofts, 18 bovates of land, 46a land on the east side of the town, marked with a pit, 56a on the west side of the town, marked with the same mark, and in linges towards the west and in le Southdale 25a linges and 44 cultivated acres of linges, marked with the same mark, 10a meadow lying in Smithfeld and Kyngesinges, marked with the same mark, and 1lb cummin yearly of the heir of William de Croxby for tenements in Thoresway. Free tenant and ingress and egress as above.

The north. A house called the ‘dayhous’ and the ‘shepcote’ and ‘swyncote’ and stable with water mill and garden thereto adjacent &c. (full details given, with tenants’ names), including certain tofts, 18 bovates of land, 46a on the east side of the town, marked with a shield, 56a on the west side of the town, marked with the same mark, and in linges and Southdale 25a in the middle of the linges and 44 cultivated acres, marked with the same mark, and 1lb pepper from the heirs of Gilbert de Kelstern of Alwaldeby with parcels of Alwaldby; and 10a meadow lying in Smithfeld and Kyngesinges, marked with the aforesaid mark. “John, the elder son and heir, was, as we have seen, twelve years old at the time of his father’s death in 1303 (the ‘father’ is William Hardreshull). The following year Nicholas Malemeyns King’s yeoman received a grant for his daughter of the marriage of John, son and heir of William de Hardreshull, tenant in chief, and in the case of the death of John, of the marriage of the next heir [3].
John de Hardreshull being of age in 1313 did his homage and had delivery of his lands. As soon as he was of age, or perhaps earlier, he married Maud Mussenden [1]. Nicholas Malemeyns’ elder daughters were either too young for marriage or had found better matches, Katherine the youngest afterwards married William, John’s son and heir.

“By his first wife Maud, Sir John de Hardreshull had a son William, and three daughters, Margaret, Elizabeth and Joan.
William married Katherine, one of the daughters of Nicholas Malmayns, and the following memorandum no doubt refers to his marriage settlement:
‘Be it remembered that a certain donation of the manor of North Kellesay and a fine levied thereof was made at York between Sir John de Hardrishull and William his son and the wife of the said William in three weeks after the feast of St Michael the Archangel 7 Edw. III (1333) at which time Philip de Hardreshull gave the manor of Kellesay to the said Sir John and he immediately gave it to William his son and his wife, by a fine levied in the King’s court as above. And Sir John de Hardreshull gave to Philip his uncle all his lands and tenements in ….. year 18 of King Edward of Carnarvon’ [1325] [4]”

“William died, as we have seen in his father’s life-time, leaving an only daughter Margaret. Both he and his wife were dead in 1349, for in that year the King presented to the church of Rothwell by reason of the minority of Margaret daughter of William de Hardeshill, kinswoman and one of the heirs of Nicholas Malmayns Knt.
In 1350, when the inquest was held after the death of Nicholas Malmayns, his heirs were found to be – Margaret daughter of William de Hardeshull aged four years, Beatrice daughter of Nicholas and wife of Otto de Grandessone of full age, and Elizabeth aged eight and Alice seven years, daughters of Thomas St. Omer and Petronilla his wife, another daughter of Nicholas.
Margaret evidently died an infant for her name does not occur in any of the later settlements, and we find nothing further relating to her.”

The Bill of Complaint, addressed to the Lord Chancellor, forms the starting point in the pleadings. It contains the wrong the complainant has suffered by the party complained of, the damage thereby sustained, and petition of process against the defendant for redress. The following short example will, however, more clearly explain the nature of a Bill in Chancery, and at the same time shew the value of these documents to the genealogist :-

In humble wise complaynen and shewen to your goode grace your feithfull Oratours Thomas Boleyn and Nicholas Carewe, knightes,

that where Kyng Edward the first by his letteres patentes, dated the xx th daye of Januarie in the xxiiii yere of his reigne [AD 1295-6] gave the Manor of Okley with the appurtenaunces, in the Countie of Surr., amonge other manors, londes and tenements to Nicholas Malemayn, knight, and to Alice his wif and to th’eires of their bodies lawfully begoton, and for lacke of suche issue to the right heires of the sayd Nicholas ; by force whereof the sayd Nicholas and Alis were of the premisses seased in their demene as of ffee tail and hadde issue one Petronell and Kateryn, and died, after whose dethe the premisses descended unto the foresayd Petronell and Kateryn as doughters and heires of the bodies of the sayd Nicholas and Alis lawfully begotten ; by force whereof thei entered into the sayd Manor and therof was seased in their demene as of ffee taill, by force of the gift aforesayd.

The Evidences, Charters, Court Rolles, Bokes of Accomptes and Mynymentes of whiche Manor with th’appurtenunces bene comon to th’ondes and possession of one Richard Colpepper, esquire, the nombre or certente wherof bene to your sayd besechours onknowen, ne they knowe not whether they bene conteigned in bagge, boxe or cheste, lockyd or onlocked, by reason of havying of whiche Evidences the sayd Richard Colpeper hath conveyed unto hym diverse estates of the premisses, of whiche Evidences, Charters and Mynymentes your sayd besechours have not onely required delyveraunce but also have desired the sayd Colpeper to make unto them estate accordyng unto their true title.
All whiche premisses to doe the sayde Colpeper utterly refusith, ageyn’ all right and goode conscience, wherof your sayd besechours have noe remedye by course of the Comen Lawe.
That it maye therfor plese your goode Grace to graunte to your sayd besechours a Writte sub pena to be directed to the sayd Richard Colpeper, commaundyng hym by the same to appere before the Kyng in his Court of Chauncery at a daye by your grace to be lymeted, to answere to the premisses and theryn ferther to be ordered as shall accorde with right and goode conscience.

In a brief answer, Culpepper says that the above Bill is “incerteyn and insufficient and the matter therin conteyned aparauntly determynable att the Comon Lawe” and therefore prays that it may be dismissed, with his reasonable costs, for his wrongful vexation sustained in this behalf.

Thomas Wolsey, appointed Cardinal Legate 17 May, 1518. This Bill is, therefore, after 17 May 1518 and before 17 Oct 1529.

Errors in the Bill of Complaint

At least 168 years elapsed between the above IPM's and the Bill of Complaint but there are significant errors in the latter.

  1. Only two daughters of Nicholas and Alice Malemayn are named
    1. Petronell
    2. Kateryn
    3. There is no mention of Beatrice/Beatrix Grandison nee Malmains the wife of Sir Otto Grandison
  2. Petronell has been 'married' to the incorrect husband - she married Sir Thomas St Omar not Philip Hoo, knight
  3. Kateryn has been 'married' to the incorrect husband - she married William de Hardreshull not Henry Newdegate knight

Newdegate/Malmayns connection

The family connections suggested in the above Bill of Complaint are incorrect, but there is an earlier Newdegate/Malmayns connection contained in the Newdegate family papers which are held at the Warwickshire Records Office.

A copy of a charter (Ref CR0136/B848) by Nicholas Newdegate, dated 24th January 1295/6, confirms his marriage with Alice, who was the daughter of Nicholas Malmayns.[13]

No further information found yet regarding the above Nicholas Newdegate/Alice Malmayns, but the date of marriage (1295/6) would suggest that Alice could be the sister of Malmayns-10 and the aunt of the three daughters of Malmayns-10 listed in the IPM's.
