Land from the estate of Benjamin Luckett sold to EJ Durbin. Lists names of six of Benjamin Luckett’s children: Aloysius Luckett, Benjamin Luckett Jr, Matilda Lenarts, Teresa Luckett, Susanah Bowles, and Catherine Mills.

Cissell & other Comms. of B. Luckett to E. J. Durbin
This indenture made and entered into this 16th day of December 1839 between Raphael T. Cissel, Willis G. Hughes & Thomas S. Chapman Commissioners appointed by the County Court of Union County for the purpose of conveying the several parcels or portions of land laid off described and bounded in the report of Commissioners appointed by the County Court of said County to survey and portion out the several interests of land amongst the heirs of Benjamin Luckett Dec’d to the respective owners named in said report, of the one part & Elisha J. Durbin of the County aforesaid State of Kentucky of the other part. Witnesseth that whereas the above named Elisha J. Durban having purchased of Aloysius Luckett, Benjamin Luckett Jr., Matilda Lenarts (formerly Luckett), Teresa E. Luckett, James W. Bowles & Susanah his wife, Ignatius Wills & Catherine his wife their several interests in the land of Benjamin Luckett dec’d as his children & heirs the Commissioners as above described assigned and allotted to said Durbin his interest to & in said land acquired as above stated contained in two parcels marked on sd report No. 3 & 4. This Indenture therefore witnesseth that for & in consideration of the promises and the further consideration of one dollar to them in hand paid the receipt whereof is hereby acknowledged the parties of the first part as Commissioners appointed as aforesaid have granted bargained & sold and by these do grant, bargain, sell & convey unto the party of the second part his heirs & c forever the price or parcel of land described in said report marked No. 3 & bounded as follows to wit Beginning at a gum & elm in Barker’s Line & running with said line N58°W 100 poles to a Sycamore & elm on the bank of Casey’s Creek thence with the meanders of said Creek down the same 40 poles to an elm on the bank thence S58E 100 poles to a stake corner to Thos Luckett thence S32W 41 poles to the Beginning containing twenty five acres. Also the piece or parcel marked No 4 and bounded as follows to wit Beginning at a Mulberry oak & two dogwoods & running S58E 400 poles to a large Hickory & red oak thence S32W 85 poles to a burr oak sweet gum & small sassafras in the bend of a branch, thence N58W 120 poles to a sweet gum & two swamp oaks thence S32W 80 pole to a locust cottonwood & oak thence N58W 220 poles to three black gums corner to the James thence N32E 110 poles to two elms & burr oak another corner to the Dower thence N58W 60 poles to a stake corner to Thomas Luckett thence N32E to the beginning containing three hundred ten & ¾ acres. To have & to hold the above described parcels of land together with all & singular the appurtenances thereunto belonging or in any wise appertaining to himself his heirs & c forever to his & their only proper use benefit & beho afforesaid testimony hereof the parties of the first part have hereunto set their hands & affixed their seals the date whereof is the day & year first above written.

At a County Court holden for Union County at the Court house in Morganfield on the 16th day of December in the year of our Lord one thousand eight hundred & thirty nine this deed from Raphael T. Cissell Willis G Hughes & Thomas S Chapman Commissioners on behalf of Benjamin Luckett’s Heirs to Elisha J. Durbin was acknowledged in open court by the said Raphael T. Cissell Willis G Hughes & Thomas S Chapman Commissioners as aforesaid to be their act & deed which deed was by the Court ordered to be recorded.
