This indenture made this 24th day of May one thousand eight hundred and twenty nine between Andrew P. Jester and Eliza his wife of the one part and Ann Jester of the other part all of Brooke County and State of Virginia WITNESSETH that the said Andrew and wife for and in of the sum of eight hundred dollars to them in hand paid the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grand bargain sell convey and confirm unto the said Ann Jester and her heirs or assigns all the following described lots or parcels of land with te appurtencances situate lyin and being in Wellsburg Brooke County and state of Virginia numbers on the plat of said Town of Wellsburg formerly Charles Town 103, 104, and 143 and bounded as followed to wit North by Liberty Street and lot No 144 east by Yankey Street South by an alley, west by Charles Street it is three lots of the property conveyed by Prather the proprieter to White from the heirs of White to Reeves and Connell by Reeves and Connell to Tallman by Tallman to Perry by Perry to Alexander Caldwell who conveyed the same to David E. Jester now deceased of who the above Andrew P Jester is heir at law all of which does upon the records of the county of Brooke appear in full. To have and to hold the above described premises with the appurtenances to the said Ann Jester and her heirs and assigns to the only proper use and [Cahoop?] of her the said Ann and her heris and assigns forever and the said Andrew and Eliza but themselves and their heirs executors and administrators to hereby covenant and agree to and with the said Ann her heirs and assigns that they said Andrew and Eliza the about described lots and premises to the said Ann Jester and her heirs and assigns and will warrant and forever defend against all persons and claims whatsoever. Brooke County VA to wit We John Gardner and Moses Congleton justices fo the peace in the county aforesaid do hereby certify that Andrew P. Jester and Eliza his wife grantors to the within deed of conveyance personally appeared before us in our county aforesaid and acknowledgment to the clerk of the County Court of Brooke in order that the same may be recorded. The said Eliza being at the same time examined by us seperate and apart from her said husband declared that she [agreed/consented] the same without any coersion of her said husband and that she wished not to retract it.
