Regarding the following email, I had asked the question who was James Vanlue in this census, born after Moses died and before Elizabeth married Erasmus Jone, cousin Larry Names supplied the answer. A real soap opera.
Hi, Jeanette,
You have raised a very interesting question. Perhaps I can answer it for you. I can't recall the exact year, but I believe it was 1825, maybe 1826. Somewhere around there a few years before Moses died. Elizabeth was tried for adultery. I read the court transcripts when I looked them up more than 10 years ago. I recall one person testified having seen her with some man whose name eludes me now. The witness said they were down by the creek and she had her skirt up and he had his trousers down. I don't recall the outcome of the trial.
So this fact might lead one to think Elizabeth had James after Moses died and he was illegitimate. Unlike today, in those times, adultery was considered a crime against the state instead of against a marital partner. My grandfather spent 30 days in jail and paid a fine of $250 when he was convicted of adultery in 1897 in Valparaiso, Indiana. On appeal to the governor, the verdict was overturned and his fine refunded to him but not until he had served his time in prison. Also, the husband of the woman he allegedly had this affair with sued him for alienating his wif's affections, but when the governor overturned my grandfather's conviction, the alleged cuckolded husband dropped his suit. It seems he didn't want his dirty laundray aired in public. I read the transcript of that trial as well. No witness testified to actually seeing my grandfather and the lady in question in the act of intercourse. Instead, the witnesses testified that they had seen them in a carriage at the end of a country lane. Nothing more than that and my grandfather was convicted. From other items in his history, I believe he was somewhat unpopular among the men of Valparaiso because he may have been popular among the ladies. In those days, all juries consisted of men only because only men had the right to vote. Earlier that same year my grandfather spent a week in jail and paid a fine of $10 for contempt of court. He was selected for jury duty and he made the mistake of speaking out of turn on the morning of a trial in the local barbershop. His remarks were reported to the judge, and in the judge's own words, my grandfather was made an example for other jurors. My grandfather's mother-in-law was Matilda Elizabeth Van Lue Newell Holloway. She was named for her two grandmothers: Elizabeth Boes Van Lue Jones and Matilda Wilson whose maiden name escapes me for the moment but I know it begins with a G.
Just for the record, my grandfather and his wife had two sons die before either one could reach the age of four. The second one had died about the same time he went to jail for contempt of court. His wife, desolated by the loss, had become distant and cold to him, and that usually drives a man to seek comfort in other places. The same was true of the lady he began seeing. It seems her husband was cheating on her as well. By the way, she was never tried for adultery, which is another reason my grandfather's conviction was overturned.
I supposed I overshared with you. Sorry.
Elizabeth does not appear in the Miami Co. Ind census with Erasmus Jones and his children, assuming she died prior to 1860.
Her son William Louis VanLue states in the 1880 census that his mother was from Germany.
