This is the last will and testament of me John Shoolbred of the City of Bath Doctor of Physic I direct that all my just debts funeral and testamentary expenses be paid as soon after my decease as Conveniently may be out of my personal estate

I give and devise all my Messuages tenements lands and hereditaments situate at Auchtermuchty in the County of Fife in North Britain unto my Mother Helen Shoolbred for and during the term of her natural life and from and after her decease I give and devise the same unto my Brother Thomas Shoolbred and my Sister Margaret Shoolbred for and during their joint lives share and share alike as tenants in common and from and after the decease of either of them the said Thomas Shoolbred and Margaret Shoolbred I give and devise the said Messuages tenements lands and hereditaments to the Survivor of them during his or her life and from and after the decease of such Survivor I give and devise the same unto my dear Daughter Helen Mary Shoolbred who was born at Calcutta in the East Indies on the twelfth day of May one thousand eight hundred and eleven and baptized there her heirs and assigns for ever

I give and bequeath unto my dear Wife Lucy Shoolbred all my household furniture plates Jewels linen China and Wines in and about my dwelling House and premises situated and being N°10 Marlboro Buildings Bath and also my Carriages harness horses and other domestic animals to and for her own absolute use and benefit and also the sum of one thousand pounds to be paid to her immediately after my death.

I give and bequeath all my Books and such part or so many of my engravings (whether bound up in books or otherwise) drawings paintings philosophical Astronomical and Chemical apparatus and instruments Musical instruments Minerals and other Objects of Natural history and Curiosities as is or are not considered as part of my household furniture and as my Executors may think useful to Retain unto my said Wife for and during her life and from and after her decease in Case my said Daughter Helen Mary shall be then living I give and bequeath the same unto my said daughter Helen Mary for her own use and benefit and

I bequeath unto my said Mother the sum of one hundred pounds Sterling to be paid to her immediately after my decease but in Case she shall be then dead I bequeath the sum of fifty pounds to each of them my said Brother and Sister to be paid in like manner and in case either of them my said Brother and Sister as well as my Mother shall be then dead I give to the Survivor of them my said Brother and Sister the sum of one hundred pounds instead of his or her said Legacy of Fifty pounds to be paid in like manner and

as to all the Rest and Residue of my personal Estate Whatsoever and wheresoever I give and bequeath the same subject as hereinafter Mentioned unto James Alexander of Devonshire Street in the County of Middlesex Esquire Josias Dev Pre Alexander of Grosvenor Square in the said County of Middlesex Esquire and Samuel Batchellor of Corston Villa near Bath Esquire their Executors Administrators and Assigns upon trust that they my said trustees or the survivors or survivor of them or the executors Administrators or Assigns of such Survivor do and shall with all Convenient speed after my decease (but subject as hereinafter mentioned) sell dispose of Collect and get in the same including such and so many of my said Books Engravings Drawings Paintings Philosophical Astronomical and Chemical Apparatus and instruments Minerals and other objects of natural history and Curiosities as my Executors may not think useful to be Retained (subject nevertheless to the proviso hereinafter contained as to my funds and Securities in the East Indies) and do and shall lay out and invest the same in their or his names or name in the parliamentary Stocks or public funds of Great Britain or in the Stocks or funds of the East India Company or at interest upon any Government or real securities in England or Wales but will full power and authority to my said Trustees or trustee for the time being to hold Retain and not dispose of any foreign Stocks funds or Securities standing or being in my name or to which I may be entitled at my decease for such time or period as they in their Judgement and discretion may think proper and adviseable and do and shall stand possessed of and interested in the said trust monies stocks funds and Securities upon a trust that they my said trustees or trustee for the time being do and shall set apart and appropriate so much of the said trust stocks funds and securities as will be sufficient to produce the ??? annual sum of two hundred pounds and do and shall pay and apply the said [Annual sum of two hundred pounds by half yearly payments as and when the same shall be reviewed unto and for my mother Helen Shoolbred and her assigns for and during the term of her natural life and from and after her decease do and shall pay one ??? or equal half part of the said annual sum og two hundred pounds by half yearly payments as and when the same shall be reviewed (OR received?) to each of them my said Brother Thomas Shoolbred and Sister Margaret Shoolbred and their respective assigns for and during their joint lives and from and after the decease of either one of them my said Brother and Sister do and shall pay the annual sum of one hundred and fifty pounds part of the said Sum of the hundred pounds by half yearly payments and when the same shall be ??? unto the Survivor of them my said Brother and Sister and his or her Assigns during his or her life and as to the residue of the said trust monies stocks funds and securities which shall remain after the appropriation so directed to be set apart as aforesaid subject to the trusts thereof hereinbefore ???? in favour of my said Mother Brother and Sister respectively and also as to all or any funds or sums of money which may remain invested in India under the provision hereinafter contained my will is and I do declare that my said Trustees and trustee for the time being do and shall stand possessed therefore upon Trust to pay the dividends interest and annual ??? thereof as and when the same shall be received? to my dear Wife during her life and from and after the decease of my said wife in case my dear Daughter Helen Mary Shoolbred should be then living in trust to raise and pay the sun of three thousand pounds of lawful money of Great Britain but if my said daughter should be then dead then the sum of five thousand pounds of like lawful money and to pay apply and dispose of the same sum of three thosuand pounds or five thousand pounds as the case may be in such manner as my said wife shall by her last Will and Testament of any Codicil in writing thereto to be executed ??? in the presence of two or morecredible witnesses direct and appoint give or bequeath the same and in default of such direction or appointment and subject to any such which may not amount to a complete disposition of the said last mentioned trust monies upon trust as to one thousand pounds part thereof to pay the same to Mrs Sarah Bourke the wife of Captain Edmond Bourke of Lewes in the County of Sussex and one of my said wife’s Sisters in case she shall be living at the death of my said wife or to such person or persons and in such manner as the said Sarah Bourke shallwhether solo? or ?? direct or appoint and in case the said Sarah Bourke shall be then dead then upon trust to pay and divide the same Sun of one thousand pounds unto and between Agnes and Sarah Bourke daughters of the said Mrs Sarah Bourke in equal shares but in case of the death of either of them the said Agnes and Sarah Bourke the daughters under the age of twenty one years I direct that the share of her so” giving shall belong and be paid to the survivor of them but in case both of them shall die under the age of twenty one years I direct that the said last mentioned sums of one thousand pounds shall sink? into my said residuary Estate and as to one thousand pounds further part of the said sum of three thousand pounds or five thousand pounds (as the case may be) ?? Trust if necessary to invest the same at interest upon the like funds or Securities as I have hereinbefore directed in regard to my general residuary estate and to pay transfer and divide the same unto and between James? and Mary Piercy daughters of my wife’s Sister the late Mrs Francis? Piercy in equal shares subject nevertheless to the same benefit of Survivorship between them and to the same resultin trust in case both of them should die under the age of twenty one years as I have hereinbefore directed relative to the said Sum of one thousand pounds so as aforesaid bequeathed in favor of the said daughters of Mrs Sarah Bourke and as to one thousand pounds further part of the said Sum of three thousand pounds or five thousand pounds (as the case may be) upon trust to pay the same unto Mrs Mary Turner of Brighton the widow of the late Major Nicholas Turner and another Sister of my said Wife in case the said Mary Turner shall be living at the death of my said wife but not otherwise and in case my said wife shall make a partial appointment or disposition of the said Sum of three thousand pounds or five thousand pounds (as the case may be) pursuant to the power? hereinbefore given to her in that behalf so that sufficient shall not remain of the said last mentioned trust monies to pay the said three legacies of one thousand poundseach ??? I direct that the said three several legacies shall ??? proportionally and as to so much if any of the said Sum of three thosuand pounds or five thousand pounds (as the case may be) as shall not be so appointed or disposed of by my said wife as aforesaid nor necessary for satisfying the other trusts hereinbefore ??? respecting the same I direct that the same shall be and remain a subject to the trusts and dispositions herein declared relative tot he rest of my residuary Estate and as to the said trust monies Stocks funds and securities subject as aforesaid from and after the decease of my said wife in case my said Daughter Helen Mary Shoolbred shall be then unmarried In trust to pay and apply competent part of the interest dividends and annual produce of the said trust monies stocks funds and securities for the maintenance and duration of my said daughter until she shall attain her age of twenty one years and to accumulate the residue of such interest dividends and annual produce [uuuuuuuuuuuuuuuu] and stand possessed of such accumulation upon the left shall arise and after my daughter shall have attained her said age of twenty one years In trust to pay the interest dividends and annual produce of the said trust monies stocks funds and securities as and when the same shall be received to to her my said daughter during so long a time as she shall remain sole and unmarried but in case she shall have been married at the time of the death of my said wife with the consent of my said wife [uuuuuuuuuuuuuuu] in writing if under the age of twenty one years *** or under that age with the consent in writing of her guardians for the time being as a majority of them then my will is and I do hereby direct that my said Trustees or Trustee for the time being immediately upon the decease of my said wife if my said daughter shall be then married but if my said daughter shall then be unmarried and shall marry afterwards Then upon or at any time after my said daughters marriage do and shall make or cause to be made such settlement or disposition of the said last mentioned trust monies Stocks funds and securities upon or in favour of my said daughter and her issue and with or without any limitations in favour of her husband or (on failure of issue of such marriage) of my family as my said Trustees or Trustee for the time being shall think ??? or expedient provided always that if my said daughter Helen Mary shall
