History of Naturalisation laws in South Australia

Naturalisation in South Australia before 1848 was granted under specific Acts which named the individual applicant.

After that date legislation was passed which allowed naturalisation without a specific Act. Each state retained its own naturalisation legislation until 1903 when the Commonwealth Government standardised naturalisation laws.[1]

Just 100 Years Last Sunday Since First Lutherans Here Were Naturalised by Act
THE war lends added significance to a district anniversary which occurred last week, for, on February 11—just 100 years ago—the first district pioneer families were naturalised, and from these initial Australians have sprung worthy successors, now in the sixth mature generation. Surnames obviously have survived, but they are of little importance beside the record of achievement they represent over almost the full period of South Australian colonisation.
Joachim Kaspary once was chided in public in England for his foreign name. "Gentlemen," he replied, "This is the country of my choice. I honour it for its greatness, and I honour my father. You are English through the accident of birth. Has my choice not been correct?" So impressed were the authorities by the calibre of S.A.'s original Lutheran settlers that, on February 11, 1840, an Act of Parliament accorded them naturalisation.[2]

Notes

Most of the people identified in this list were Prussian 'Old Lutherans' (German: Altlutheraner) who refused to join the Prussian Union of Churches ordered by King Friedrich Wilhelm III.

It is useful to identify the ships they migrated on. Most of the families travelled together. They left the same small pockets of land, then mostly settled together in South Australia.

Notable ships:

  • Solway Arrived 16th October 1837 at Kangaroo Island. More than 25 'Old Lutherans' left the Province of Pomerania near the town of Cammin (now Kamień Pomorski in Poland)
  • Prince George Arrived 18th November 1838 at Holdfast Bay. Carried the main group of 'Old Lutherans' from around the town of Klemzig, Province of Brandenburg (now Klępsk in Poland). Land was leased for them by arrangement with the chairman of the South Australian Company. It was named 'Klemzig' after their home village.
  • Bengalee Arrived 16th November 1838 at Holdfast Bay. Primarily a supply ship, this ship also carried some passengers from Klemzig and other regions.
  • Zebra Arrived 2nd January 1839 at Port Adelaide. The migrant families left from around Kay, Province Brandenburg (now Kije, Poland). The captain (Dirk Hahn) of this Danish ship was very impressed by his passengers and arranged the lease of land in the Adelaide Hills. The settlers named the settlement 'Hahndorf' in his honour.
  • Catharina Arrived 22nd January 1839 at Port Adelaide. The majority of passengers left the Province of Posen around the city of Meseritz (now Międzyrzec Podlaski in Poland). The next major group emigrated from the Province of Silesia around the city of Grünberg (now Zielona Góra in Poland)
  • Skjold Arrived 27th October 1841. Many passengers had family connections with the wave that migrated between 1838 and 1839. Some Lutherans received permission to leave Prussia in 1838 but delayed their departure until 1841.
  • Heerjeebhoy Rustomjee Patel Arrived 21st April 1845. The passengers came from different distinct regions. Some had family connections with the 'Old Lutherans'. There were a number of Wendish (German: Wendisch) from the historic region of Lusatia. This ship also carried the first group of miners from the Kingdom of Hanover.

So many rabbit holes to explore. I have just seen that Helena Lange is one of the descendants of the two groups that emigrated to New Zealand in 1843 on the 'St, Pauli' and 'Skjold'. The settlement was also based on the Wakefield scheme but floundered. A good fraction of the settlers abandoned New Zealand and made their way to South Australia.

I have looked more carefully for the descendants of the folk naturalised in 1839. Migrants like https://www.wikitree.com/wiki/Auricht-2 are very useful to establish the roots of a number of family trees. I did not find any new Wikitree profiles where their ancestors have not already been identified.

The 1845 list compiles a group of Lutheran missionaries. I am impressed by the records kept of first nation languages and customs.

I have it now: 'Vocabulary of the Woolner District Dialect, Adelaide River, Northern Territory' by John William Ogilvie Bennett, 1869, annotated by Paul Foelsche. Both Bennett and Foelsche were on the 1869 Goyder Expedition. Bennett was speared and died, the book published posthumously.

The number of migrants in the 1840 list from the province of Posen and sailed on the Catharina is very high. The majority of German speaking immigrants at the time came from the province of Brandenburg and sailed on the Bengalee, Prince George and Zebra.

Perhaps there is someone on the Catharina that was very good at organising the mass naturalisation of their fellow passengers?

I hope to finish the 1847 list today - and convert it to a table.

I don't know. This will be an observation to share with the Pioneers Association of South Australia to see if anyone has more insight.

I was particularly interested because a significant number of my ancestors also migrated on the Catharina, however from the province of Schlesien (Silesia). The immigrants from Silesia don't figure much in the 1840 list.

I won't add much to the 1847 list. My head is hurting already. As soon as a Schulz appears I give up.
