Transcription

In the name of God Amen
I John L. Mattingly of the County of Union and State of Kentucky being weak in body but of sound & disposing mind and memory do make and publish this as my last will and testament hereby revoking all other wills heretofore made by me
1st I will that all my just debts be paid by Executor hereafter named ---
2nd I will and bequeath to my wife Sarah Mattingly the farm on which I now reside together with all money due me & all of my other property of every description whatever so long as the said Sarah Mattingly shall remain my widow for the use and benefit & support of herself and my children that are now living at home with us so long as they remain with her towit Rowan Robert Churchill, Thomas Charles Gipson, Sarah Elizabeth & George Logan
3rd I hereby constitute and appoint my wife Sarah Mattingly Executrix of this my last will and testament and desire that she be qualified as such without being required to give any security whatever.
4th It is my will that my wife shall dispose of any of my property except the land that I now have or that she may hereafter make for the support & education of any or all of the above named children as she may think proper and that she shall not be required to render an account of the same to court nor shall she be required to make any publick sale of my property after my death except to pay my debts and she may sell such property & in such manner as she may think proper for that purpose.
5th It is my will that when my said wife shall die or marry that the Land on which I now live containing 200 acres purchased of A.L. Churchill shall descend to my four youngest children (towit) William Thomas Charles Gipson, Sarah Elizabeth & George Logan and that the personal property then on hand shall descend to my three children John Rowan Robert Lewis & Lud Churchill
6th It is my will that my son James Mattingly have my interest in my fathers farm on which said James Mattingly now lives.
7th I will to my son Stephen Mattingly one Dollar
8th I will to my daughter Julian a cow white now my stock
9th I will to my daughter Mary Jane one dollar
10th I will to my son James one dollar

At a County Court holden for Union County at the Courthouse in Morganfield on the Nineteenth day of August In the year of our Lord one thousand eight hundred and fifty This Last will and Testament of John L. Mattingly deceased was produced in Court and was in open court proven to be the Last Will and Testament of John L. Mattingly deceased by the oaths of Thomas S. Chapman and Enos L. Galloway the subscribing witnesses thereto and was by the Court ordered to be recorded
