I John Newlands Merchant Tailor in Glasgow
Being resolved to settle the succession to my means and estate
so as to prevent all disputes that might otherwise arise
thereanent among my children after my decease do hereby
give grant assign dispone convey and make over to and
in favour of Macvicar Newlands my daughter, residing in
family with me my whole household furniture and plenishing
including books with my silver watch and gold chain to be
used and disposed of by her at pleasure. Further I do hereby
assign dispone convey and make over to and in favour of
the said Macvicar Newlands James Newlands Isobel Newlands
Janet Newlands and Mary Newlands my children under
the reservations after mentioned All and sundry sums of
money debts and stock in trade, whether due to me by bonds
bills or otherwise, presently pertaining and belonging to me
or that shall be pertaining and belonging to me at the time of

my death, and which I appoint to be divided among them
in the following proportions namely two shares to the said
Macvicar Newlands over and above the aforesaid household
furniture &e conveyed to her, other two shares thereof to the
said James Newlands one share thereof to the said Isobel
Newlands one share thereof and a third part of a share
to the said Mary Newlands and one share thereof
to the said Janet Newlands excluding always the jus
mariti[2] and right of management of the husbands of the
said Mary Newlands and Janet Newlands over the
sums hereby conveyed to them and declaring that the same
shall not be attachable or arrestable for their acts, debts or
deeds and that they shall not be entitled to uplift and
discharge the same on their own receipt independant of
their said husbands Further I hereby leave and bequeath
to the Reverend William Newlands residing in London
my son my silver snuff box in testimony of my esteem and
regard for him and to the said James Newlands I hereby
leave and bequeath my whole wearing apparel including
shirts with my writing desk and wooden chest But these
presents are granted by me and to be accepted of by my
said children with and under the burden of the payment
of all my just and lawful debts sickbed and funeral charges
Lastly I hereby Nominate and appoint the said Macvicar
Newlands, James Newlands David Black Merchant in
Glasgow and Andrew Robertson Warehouseman there and
survivors and survivor of them to be sole Executors of this
my last will and Testament for the purposes aforesaid
and not otherwise, and with full power to them to give up
Inventories and confirm the same if need be, and in case of
any dispute or misunderstanding arising among my said
children regarding the sums left to them, arising out of these
presents, they shall be bound to refer the same to the amicable

decision and determination of the said. David Black
and Andrew Robertson whose award shall be final
and against which there shall be no appeal to a
Court of law, Reserving always to me my own lifetime
of the premises and full power and liberty at any time
hereafter and even on deathbed to alter and revoke these
presents in whole or in part, dispensing with the delivery
hereof and declaring these presents to be equally valid
and effectual although found lying in my own
repositories or in the hands of any neutral person
undelivered at the time of my death any law or practice
to the contrary notwithstanding And I Consent to the
registration hereof in the Books of Council and session or
others competent therein to remain for preservation and
for that purpose Constitute
Procurators In Witness whereof
these presents written upon stamped paper by John
Gibson writer in Glasgow for James Bogle Writer there
Are subscribed by me at Glasgow the 24th day of March
18,37 years before these witnesses James Baird Scot writer
in Glasgow and the said James Bogle Declaring that
the place of subscription with the data and witnesses names
and designations are filled up and inserted by the said

Codicil written 22d day of November 18,37

[Margin entry] Codicil I John Newlands within
Designed in terms of the reserved powers in the within settlement
make the following alterations thereon considering that
Macviccar Newlands my daughter has died and James
Newland my son has gone abroad since the said settlement
was executed their respective shares of the property left them is
hereby revoked and under the exceptions and declarations
after mentioned I do hereby give grant assign convey and
make over from me after my decease to and in favours of

Isobel Miller my grand-daughter the Reverend William
Newlands residing in London my son and Isobel, Janet
and Mary Newlands my daughters All and sundry sums
of money debts stock in trade Bonds Bills and accounts
presently pertaining and belonging to me or that shall be
pertaining and belonging to me at the time of my decease
to be divided among them in equal shares, and which
division is to take place within six months of my decease,
and I herby nominate the said William Newlands to be
one of my Executors in place of my son James gone abroad
and in addition to the silver snuff box left him by the
within settlement I bequeath to him my silver watch
and gold chain appended thereto. Declaring that the
said Isobel Millers share of my said property shall be payable
to her at such times and proportions as my Executors may
think fit and her necessities require it. Farther I hereby
leave and bequeath to the aforesaid Isobel Miller my
grand-daughter my whole household furniture But as she
is under age I hereby appoint the said William Newlands to
be her guardian along with the said Janet Newlands, it
being her late mothers request that she should consult and
be directed by the said William Newlands her uncle in
the management of her affairs until majority or marriage
as well as my own earnest wish. Farther I hereby appoint my
Executors on my decease to deliver to the said Isobel Miller her
mothers chest of Drawers wearing apparel and two gold rings
the other gold set ring to be given to her half sister Janet
Henderson and the within settlement so far as not hereby
revoked and altered shall remain good, and Consenting
to the registration hereof in terms of the clause of registration
contained in the within settlement I have subscribed these
presents written in the back of the within settlement by
John Gray Writer in Glasgow for James Bogle writer there

At Glasgow the 10th day of August 18,38 years
In Presence of Walter Moir Esquire Commissary Depute for
Lanarkshire Compeared the Reverend William Newlands minister
of the Gospel London who being solemnly sworn and examined
Depones that John Newlands Merchant Tailor in Glasgow the
Deponents father died on the 29the day of July last 18,38 years. That
the Deponent has entered upon the possession and management
of the personal Estate of the deceased as one the Executors nominated
under a Deed of Settlement executed by the deceased of date the
24th day of March 18,37, and Codicil annexed thereto of date the
22d day of Nov.r 18,37 and which is now exhibited docqueted and
subscribed by the Deponent and the said Commissary as
relative hereto: That the Deponent does not know of any Settle-
ment or Writing in relation to the deceaseds personal estate
or any part thereof other than that now exhibited: And
Farther that the foregoing Inventory each page of which is
signed by the Deponent and the said Commissary as re=
lative hereto, is a full true and complete Inventory of the
personal Estate of the said deceased John Newlands wherever
situated or known to belong to him beneficially at the
time of his death and that the said Estate the whole
of which is situated in Scotland is of the value of ₤100
and under the value of ₤200. All which is truth
as the Deponent shall answer to God (signed) William

and Sisters. I think it necessary to leave this Letter to
you that in the event of any death, after the business
carried on by Mr Thomas McNaught and myself is
wound up and my lawful debts paid the remainder
of any effects are to be equally divided amongst you
Might? my Brother George Newlands Jeweller Kilmarnock
and my Sister Janet Newlands residing at 73 West Nile
Street Glasgow and my Sister Margaret Newlands
Dressmaker 73 West Nile Street Glasgow. my Brother
George Newlands aforesaid to act as Trustee both for himself
and my sisters. I hope the above will be satis
:factory to you all. P.S. the Trusteeship to last during
the winding up of the Business I am my dear Brother and
Sisters your affectionate Brother (Signed) John Newlands.
Addressed on the back thus. To Mr George Newlands Jeweller Kilmarnock and
Misses Janet & Margaret Newlands 73 West Nile Street Glasgow to be opened in the presence of the above parties.
