Declaration for Widow’s Pension To be executed before a Clerk of a Court of Record or a Notary Public or Justice of the Peace having a Seal. State of Indiana, County of Spencer, ss.
On this 19th day of November, A. D. one thousand eight hundred and ninety, personally appeared before me a, Notary Public in and for the aforesaid County, duly authorized to administer oaths, Francis Stone, aged 42 years, a resident of the Town of Rockport, county of Spencer State of Indiana, who being duly sworn according to law, declares that she is the widow of John Stone, who enlisted under the name of John Stone at Owensboro Ky, on the ___ day of ___, 186_, in Co 109th Regt U.S.C. Inft Volunteers in the war of the Rebellion, and served at least ninety days, and was honorably discharged at _____, and died at Owensboro Davis County, Ky. That she was married under the name of Francis Lashbrooks, to said John Stone on the ___ day of ___, 18___, by Rev Henry Lashbrooks, at Davis Co., Kentucky there being no legal barrier to said marriage neither my Husband nor myself had been previously married. That she has not remarried since the death of the said Husband John Stone. That she is without other means of support than her daily labor. That names and dates of birth of all the children of the soldier now living under sixteen years of age are as follows:
She has heretofore applied for pension, the number of her former application is not granted no Lock(?). That she makes this declaration for the purpose of being placed on the pension roll of the U.S. under the provisions of the Act of June 27, 1890. She hereby appoints Lewis G. Smith of Rockport Indiana her lawful attorney to prosecute her claim and agrees to allow a fee of ten dollars. Her postoffice address is Rockport Spencer County Indiana.

Also personally appeared Layfayette McFarland Publiic residing at Rockport Spencer County, Indiana and David McFarland, residing at Rockport, Ind’a, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say the were present and saw Frances Stone the claimant, make her mark to the foregoing declaration; that they have every reason to believe from the appearance of said claimant an their acquaintance with her for 28 years and 28 years, respectively, that she is the identical person she represents herself to be; and that they have no interest in the prosecution of this claim.

I have a claim No 495649 Pending as widow of John Stone Co F 108 USCT filed by C. S. Finch and now have a call for evidence. Mr. Finch declines to get the evidence because I have informed him that Louis G. Smith filed the same claim several years since but has paid no attention to it since and declines to Relinquish his Right to prosecute the claim. Mr. Finch informs me that in a case when an attorney neglects to give a claim any attention for over one year or over he is notified that he cannot be Reported as the Attorney any longer and the Claimant can chose an other Attorney.

The Statement above made by Mrs France Stone is true. If I had known that Smith had on filed a claim for Mrs Stone I would not have filed her Claim. I have Recently worked a claim though for Nancy C. Brady of Rockport Indiana Claim No 487,752 widow of Benjamin F. Brady co A 1st Ind Cav. I filed her claim Dec 1894 had a call for all eviden Requesed to complete the claim sent it all up and have a receipt for the same the claim was allowed and and the claimant got her money but I got no fee because Smith had filed her claim some time before and I don’t think he ever filed any evidence but he got the fee same Ready to work Mrs Stones claim Through as soon as I am informed that Smith is Ruled out and that I will be Recognized at the attorney

27-Mar-1897: Power of Attorney. No. 495,649 Claim of Frances Stone Pension, Filed by C. S. Finch, Grand View, Indiana.
Know all Men by these presents: That Frances Stone widow of John Stone Co. F 108 Regt USCT Vol I of Rockport in the County of Spencer and State of Indiana have made, constituted, and appointed and by these presents do make, constitute, and appoint C. S. Finch of Grand View, Indiana my true and lawful attorney, for me, and in my name, place and stead, hereby annulling and revoking all former Powers of Attorney whatever in the premises, to prosecute before any Department, or the Courts or Committees of Congress of the United States until final completion, for me, my Claim for Pension now on file in the Bureau of the United States being Claim No 495,649. This claim was filed by C. S. Finch June 1894 and when he was informed that Lewis S. Smith had filed the Claim prior to that time he Finch declined to work the Claim as said L. G. Smith has entirely neglected the claim for ever three year. She don’t want him to have any thing to do with it and most Respectfully Requests that C. S. Finch be Recognized as the Attorney and to, from time to time, furnish any further evidence necessary or that may be demanded, giving and granting to my said attorney full power and authority to receive any draft or warrant that may be issued in settlement of said claim, and to do and perform all and every act and thing whatsoever requisite and necessary to be done in and about the premises, as fully to all intents and purposes as I might or could do if personally present at the doing thereof, with full power of substitution and revocation, hereby rectifying and confirming all that my said attorney or……substitute, may or shall lawfully do or cause to be done by virtue hereof.
