Administrators of Thomas Smitherman decd to John George Poindexter
This indenture made this fifteenth day of August in the year of our Lord one thousand eight hundred and seventeen between Margaret Smitherman and Samuel Smitherman Admrs of Thomas Smitherman decd John, William, Thomas, Samuel and Andrew Smitherman, and Sarah intermarried with George Boling, Nancy intermarried with Andrew Garner, Elizabeth and Jesse Smitherman heirs of the said Thomas Smitherman decd, of the County of Randolph in the State of North Carolina of the one part and John G Poindexter of the County of Surry and the State of North Carolina of the other part. witnesseth that the said Margaret and Samuel Smitherman admrs of said deceased and John, William, Thomas, Samuel, and Andrew Smitherman, Sarah Bolen, intermarried with George Bolen, Ann intermarried with Andrew Garner, Elizabeth and Jesse Smitherman for and in consideration of the sum of three hundred and fifty dollars to them in hand paid by the said John G. Poindexter, the recipt whereof the said Margaret, Samuel, Admrs, John, William, Thomas, Andrew and Sarah intermarried with G. Bolen, Ann intermarried with Andrew Garner, Elizabeth and Jesse Smitherman doth hereby acknowledge, hath given, granted, bargain and sell, alien and confirm unto the said John George Poindexter his heirs and assigns forever. All that tract and parcel of land, situated lying and being the the County of Surry and State aforesaid beinning at a Spanish Oak on the North Bank of the Yadkin River, runs North thirty-two chains to a black oak, thence West fifty-five chains to a Hickory Sapling, thence North ten chains to a black oad, thence West nineteen chains to a post, then thirty-two chains to a stake, ont he Bank of said River, thence down the same as it meanders tot he beginning containing two hundred acres entered by Allen Gentry and transferred to Randolph Brown being date the Eleventh day of October 1800 No. 199. The other part beginning at a post oak the North West corner of this two hundred acre entry made by Allen Gentry runs West forty five chains to a black oak on the bank of the Yadkin River, thence down the same as it meanders to a stake thence North thirty-two chains to the beginning containing firty acres of land entered the 14th day of August 1783, No. 2129 the same more or less, to have and to hold the aforesaid lands and premises together with all woods, ways, waters, and water courses and all and every the appurtences thereunto belonging or in ant wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits of the aforesaid lands and premises and every part thereof and all teh Estate, right, title, interest, claims, property and demands whatsoever of the said Margaret and Samuel Admrs. John, William, Thomas, Samuel, Andrew, Sarah intermarried with George Bolen, Nancy intermarried with Andrew Garner, Elizabeth and Jesse Smitherman, of, in and to the said lands and premises hereby granted to have and to hold the aforesaid lands and premises and every part thereof against them and their heirs and assigns forever to the said John George Poindexter, his heirs and assigns forever. In witness wereof we the said Margaret Smitherman, Samuel Smitherman administrators, John Smitherman, William Smitherman, Thomas Smitherman, Samuel Smitherman, and Andrew Smitherman, Sarah who intermarried with George Bolen, Nancy who intermarried with Andrew Garner, Elizabeth and Jesse Smitherman heirs to Thomas Smitherman deceased have hereunto set our hands and seals the day and year first above written.
