Floyd Will D

Know all men by these presents that I have bargained to Will D. Floyd, One acres of Land where(illegible) I now live Close to Polk Higgins Harris, Cape, and Lewis Eggart Lots, Said lot to be run(illegible) so as to have 40 feet Passway between B. F. Ashburn and J. A. Walker and(illegible) the lot sold(illegible)
The consideration being $50.00 Fifty Dollars, Fifteen of which is paid down, the other $35.00 Thirty Five to be paid in installment of $5.00 Five Dollars per month from the date written below and in case said amount is not paid in (12 months) Twelve months from date of this instrument This Transaction and Sale to be void and said Will D Floyd his heirs and assigns to surrender possession to the said David Melton and the amount paid to be kept by Said Melton as such for said Lot and house, and if the full amt of $50.00 be paid by said Floyd then said Melton is having(illegible) to make said Floyd a deed in fee simple

Before me, Thomas M. Eakin, a Notary Public duly appointed, commissioned and qualified in and for the county and state aforesaid personally appeared David Melton the within named bargainer with whom I am personally acquainted, and acknowledged that he presented the within instrument for the purpose therein contained.
And Martha Melton wife of the said David Melton having appeared before me privately and apart from her husband, the said Martha Melton acknowledged the execution of the said deed to ahve been done by her freely, voluntarily and understandingly without compulsion or constraint from her said husband, and for the purposes therein expressed. In testimony whereof I have hereunto set my hand and notarial seal at office in the town of Whitwell Tennessee, on this 1st day of Mar. 1900.
