Will Transcription

I Mary Berry of Union County Ky do on this 12th day of September 1844 make this my last will and testament.
1st I will that every and all Of my property shall belong to my brother Joseph Berry (should he survive me) during his natural life.
2nd After the death of my brother Joseph Berry I wish my brother Peter Berry to have Edgar, Melissa, Emiline & her child.
3rd I also will that my niece Anney Berry shall have Anarina and Belfield
4th Also that my nephew Franklin Berry shall have Caroline, Benney and Juline
5th Also that my niece Lucy Berry shall have Ann Alevia
6th Also that my nephew John T. Berry shall have James
7th that my nephew Beverly Berry shall have Benjamin
8th Also that my nephew Philander Berry shall have Levi
9th I do further will and desire that all of my personal and all other property not heretofore devised shall be equally divided between my brother Peter Berry, my nephew Franklin Berry and my nieces Anney Berry and Lucy Berry
10th And I do hereby Constitute and appoint my nephew Franklin Berry and John T. Berry my executors to execute this my last will and testament – Given under my hand this day and date above.

At a County Court holden for Union County at the Courthouse in Morganfield On the 21st day of April 1845 This last will and testament of Mary Berry deceased was produced in Court and proven as such by the Oaths of Gibson B. Taylor and Charles K Nailer the subscribing witnesses thereto and was by the Court Ordered to be recorded which was done accordingly
