Transcription

Whereas by the last will and testament of my late husband William Noel deceased of record in the clerks office of the Hopkins County Court he (the said Decedent) bequeathed to me during my natural life & widowhood his Tavern house and its appurtenances in the town of Madisonville in which he at the date of said last will and testament resided together with all his other town lotts and lands situate in the County of Hopkins and afterwards to be sold by the Executor of said Decedent and the proceeds disposed of as by the said will as directed. And whereas much of said estate bequeathed to me as aforesaid is yielding me no profit and it is believed might at this time be sold to the advantage of those who will be entitled to its proceeds. Now for in consideration of the premises and of the sum of five dollars to me in hand paid by those of whom the proceeds of said estate is devised after the determination of my estate therein as above set out & specified and for the further consideration of a bond executed to me of equal date with this Instrument and conditioned to pay me the sum of twenty dollars annually during natural life in case I shall demand the same. I have and do by these presents freely relinquish all the right title and claim devised under the said last will & testament in and to the whole of the estate above specified except the Tavern house and lot and the house & lot on main street adjoining the tavern lot including the orchard and give my full assent that the same may be sold by the Executor of said decedent and the proceeds disposed of as directed by s’d last will & Testament in the event of my death or intermarriage. In Testimony whereof I have hereunto set my hand this 7th day January 1846.

This Instrument of writing was this day produced to me by Nancy Noel a party thereto and acknowledged by her to be her act and deed. In Testimony whereof and that the said Instrument of writing and this certificate are truly recorded in my office I have thereunto subscribed my name the 23rd day of January 1846.
