- John Lee Esq. lived in Virginia in 1695, when tobacco was grown in fields in the state and plantation owners reaped the results. Note: Doc indicates birth in 1695. The doc that he lived in Virginia in 1695 is confusing and would imply an earlier date of birth. They had six children in 17 years. He was in North Carolina when farmers joined forces in a fight that would foreshadow the American Revolution. [1] He died on December 4, 1766, in Johnston County, North Carolina, at the age of 72. Note: Will filed Dec 4, 1766, proved 1768. Date given would indicate John Lee died on the day his will was filed however this is probably not the case.

- Also: There is a problem found recently with the male descent line from Col Richard Lee down to Gen R E Lee - the all male descent- that line which is being quoted as the Y-DNA Haplogroup M-253 that has been 'authenticated' ( because it is the Ditchley line which Gen Lee descend from two living male descendants tested and with documented pedigrees approved by the historical society) ... unfortunately there appears to be a NPE in THAT line, from preliminary research that IS on-going.
- Because of this NPE - or disconnect in THAT line - all the other lines from COl. Richard Lee, such as John Lee, Esquire's line - are being quoted as not being related to or descending from him, Col. Richard Lee because of the unverified Y-DNA tests and results from the two living descendants from Gen Lee whose Y-DNA tests cannot be publicly verified and their DNA is not available on GEDMatch to compare.
- But there have been other descendants from Gen Lee that have recently tested and uploaded their DNA onto public websites such as GEDMatch to make comparisons available. :)
- Interesting enough, the male descendants of the Ditchley/Blenheim line from Col. Richard still match DNA with others descending from Col. Richard Lee when triangulation is done but through shared DNA from the female ancestors, such as Carter, Constable, Allen, Hancock, etc.,.
- All of this independent research is in the process of being confirmed verified at this time and where the probable dis-connect may have occurred in the Ditchley/Blenheim line and still in the preliminary stages.
- But on the other hand - fortunately many of Lee descendants from ALL of the lines descending from Col Richard Lee (and his ancestral Shropshire line descendants included) have uploaded their DNA test results - AU and Y-DNA - on to GEDMatch where comparisons, triangulations, and various reports (generation reports that can pin point common ancestor generation) can be run so that anyone with access can publicly verify.

- His will also names his wife as Mary The date for settlement of Mary's estate has not been documented. However, in 1792, Thomas Lee was in the county to sell the home place.[citation needed] The home place had been willed by John to his son, Thomas, upon the date of his wife Mary's death. At this time, Thomas Lee resided in Hawkins, Co., Tenn. and had lived there for appr. 20 years since about 1773. [citation needed]Thomas Lee and brother John had moved to Hawkins County, Tennessee around the same time. Both of these Lee brothers had large families before they died in Hawkins County, Tennessee. - "IN THE NAME OF GOD, I, John Lee, Johnston County & Province of North Carolina, being so at this time tollbery (tolerable) well in health and of sound mind and memory but calling to mind the mortality of the body and that it is appointed for all men once to die and ordain this my last will and testiment in manner and form following: That is to say first and princpally first all I commend my soul unto the hands of God that gave it. As for my body, I commend it to the earth to be burried in an decent manner at the discression of my executors. But regarding my worldly estate with which it has pleased God to bless me with, I dispose of in the following manner, viz: In the first place I desire that all my just debts and funeral charges be fully satisfied and paid. Imprimis I lend to my well beloved wife, Mary Lee, the plantation whereon I now live and all my personal estate for her to be possessed with and enjoy during her life or widowhood.

(some have surmised that this is daughter Elizabeth, since she is not otherwise mentioned in any item; however Elizabeth died in 1753. Perhaps this item was left to one of her children other than Shadrack Ingram?

Richard Lee, being that it was a Will - most likely family).

- Johnston County, North Carolina records indicate that John Lee served on juries and helped "lay off' roads but the best records on him are the land transactions.
- It is evident, there is not a complete record of his land holdings, or that he willed too much land. Land records indicate John Lee owned 1470 acres; while he willed an estimated 1779.[citation needed]
- John Lee Esq. was living in Nansemond County, Virginia during 1728, when Colonel Richard Byrd ran the line between Virginia and North Carolina. This line split John's plantation so that part of it was in North Carolina and part in Virginia. [citation needed] The same was true of lands owned by Godfrey Lee and Dr. Richard Lee; both whom resided near John Lee Esq. Note: this documentation would indicate the John Lee of this profile is the John Lee of Nansemond, Virginia whose descendants YDNA tested I1a, which directly contradicts documentation elsewhere that indicates John Lee Esq. descendants YDNA tested R1a. This is questionable and confuses the identity of John Lee Esq.

- John had owned several hundred acres in Nansemond County, Virginia but after 1728, the majority of his land became part of North Carolina. [citation needed] John Lee Esq. kept this land until around 1740, when he sold it and moved to Craven County, North Carolina which later (in 1746) became Johnston County. [citation needed]
- John Lee had received land grants in Craven County, North Carolina on 26 Jul 1743 and never sold them; but deeded them to his children by deed or will. When this land was passed on to John's children, this land was on Mill Creek in Johnston County. [citation needed]
- John had remained on this land until his death in 1766-1768. the old graveyard where John was probably buried had only fieldstone markers, and has long since been plowed under.

It is no exaggeration to say that the LEES have been "the most representative family of the South." The life that developed in Virginia, the political rule, and social dominance of a few rich plantation families-was unknown elsewhere in the colonies, EXCEPT IN ARISTOCRATIC OLD SOUTH CAROLINA. - Our branch of the Lee family only lived in VA for a short period of time, arriving from England then moving to NC about 150 years later. We are not normally considered part of the 'famous VA Lee's' which primarily includes General Robert E. Lee. However we are cousin's and share the same heritage and prominence in colonial America. Our line split from his with John Lee, 1530 in England. Our branch was part of the early famous VA Lee's in early colonial America. In the future I will include details and history notes. - In 900-One thousand and one hundred and three years ago - this Northman went into northern France along the English channel, and took the north-west section-extending from Belgium along the channel to Brittany, and including the Cherbourg Peninsula, extending inland about 100 miles.

- Brief history of John LEE, Esquire John Lee, Esquire (abbreviated JLX) was probably born in VA or NC around 1695 and is thought to have been among the Roanoke River Settlers in 1720. JLX's wife was Mary, who may have been the daughter of William and Alice (McLand) Bryan. JLX and Mary started their family on lands between the Roanoke and Tar rivers along Coneto and Conoho Creeks. Today, these lands would be along the borders of the NC counties of Halifax, Martin, Edgecome, and Pit. Several or all of John and Mary's children were born in the Roanoke region and records through 1744 most frequently list JLX as being of Edgecomb Co., NC.[citation needed] By the 1740s, settlers were moving into lands in Johnston County- then known as Craven County. These immigrants included JLX who on 26 July 1743 received grants for 400 and 100 acres of land along the south bank of the Neuse River. [citation needed] Many of JLX's Conoho Creek neighbors such as Needham, John, and William Bryan also moved south to Johnston County prior to 1750. - Brief history of John LEE, Esquire John Lee, Esquire (abbreviated JLX) was probably born in VA or NC around 1695 and is thought to have been among the Roanoke River Settlers in 1720. JLX's wife was Mary, who may have been the daughter of William and Alice (McLand) Bryan. JLX and Mary started their family on lands between the Roanoke and Tar rivers along Coneto and Conoho Creeks. Today, these lands would be along the borders of the NC counties of Halifax, Martin, Edgecome, and Pit. Several or all of John and Mary's children were born in the Roanoke region and records through 1744 most frequently list JLX as being of Edgecomb Co., NC. By the 1740s, settlers were moving into lands in Johnston County- then known as Craven County. These immigrants included JLX who on 26 July 1743 received grants for 400 and 100 acres of land along the south bank of the Neuse River. Many of JLX's Conoho Creek neighbors such as Needham, John, and William Bryan also moved south to Johnston County prior to 1750. Court records detail JLX's various land holdings (over 1700 acres) in Johnston County and refer to his serving on juries, laying off roads, etc. John and Mary lived the remainder of their lives in Johnston County and raised at least nine children. John died between December 4, 1766 when his will was written in Johnston Co., NC, and February of 1768 when the will was probated. John's will names wife Mary, sons Robert, Edward, John, Thomas, Frederick; daughters Mary Ballanger and Sabray Green, grandson Shadrack Ingram. John's wife Mary probably died before 1780. Source: W. Move to DNA Discussion page :: Note: Although this documentation indicates John Lee Esq. was born at Nansemond, Virginia, John Lee of Nansemond is projected YDNA Haplogroup I1a. [11] This is contradictory to birth and YDNA information documented elsewhere in this biography for John Lee, Esq who is projected to be R-M269. This contradiction may be the result of mistaken identity, an erroneous family tree, misinterpretation of data, or an as yet undiscovered NPE occuring in one of the descendant lines. The presence of contradictory birth dates and places of birth may also indicate that the current information is the product of guesswork or unsupported circumstantial evidence and that the exact birth dates and locations are not known.
- John Lee Esq parents have been said to be Richard Lee b: Abt. 1677 in Surry Co., Virginia (grandson of Col Richard Lee "The Immigrant") and Mary Young b: Aft. 1679 in Virginia. [citation needed] Richard Henry Lee and Mary Young Lee were disconnected as John Lee Esq parents primarily because YDNA evidence raised questions as to their genetic relationship. This was based on YDNA (charts) results found in Lee YDNA groups. This evidence appears convincing, however the seeming discrepancy may be the result of an error in the downstream family tree of the testers, an NPE, or misinterpretation of YDNA results due to errors in projected Haplogroups. Obviously neither John Lee or his proposed father, Richard Lee have been YDNA tested and their results can only be projected based on the kinship claims of testers whose family trees may or may not be accurate. There are some questions about the identity of John Lee Esq which may be the result of a NPE or error in the family tree of one or more individuals currently proposed as descendants. The possibility exists supported in part on identical birth and residence locations that indicates a possibility that John Lee Esq and John Lee, Nansemond may be one and the same person. For these reasons the YDNA evidence alone is not considered conclusive and additional research is warranted and ongoing. Family trees and kinship of the testers must be verified before DNA results can be reliably used to confirm claimed relationships.
Traditional Ancestral Line
- This is an examination of the traditional (speculative) line of descent from Col Richard (Henry) Lee "The Immigrant" to John Lee, Esq. It should be noted that the accuracy of this line is disputed and current YDNA evidence makes this relationship questionable but has also raised questions regarding accuracy or the possibility of a NPE.

- It is interesting to note that William Constable Lee is predicted to be R-M269 as is John Lee Esq. Although Richard Lee, said to be the father of John Lee, Esq YDNA is not known, the predicted Haplogroup would also be R-M269, if the relationships are correct. [12] It is also interesting to note that FTDNA kit#149909 R-M269 is for ancestor Richard Henry Lee, b 1618 and died, 1664. This tester also appears to trace his line to Richard Lee, "The Immigrant".
- This brings us to a set of interesting possibilities :
- William Constable Lee is not the son of Richard Lee, "The Immigrant", or
- There was an NPE that occurred at this point in the line, or
- One or more pedigrees contains an error of fact.
- There also appears to be a genetic connection to a Hugh Lee [13] (Subgroup 18a, Hugh Lee bc 1650 dc 1721 Prince George Co, VA) whose descendants also tested R-M269[14] The relationship between these individuals is under investigation. According to unsourced documentation there was a John Lee b1695 in the Hugh Lee line and other family members that resided in Johnston County, NC.
Ancestral Lineage-Preliminary Conclusions
- Published (Unverified) DNA test results indicates that John Lee Esq 1695-1767 is projected R1b Haplogroup. It is also projected that his proposed grandfather, William Lee 1651-1696 is also R1b Haplogroup. Given this, it would be a logical assumption barring an NPE event or documentation error that Richard Lee 1677-1726, proposed as the father of John Lee Esq would also be R1b. However, Richard Lee, "The Immigrant" is projected as Haplogroup I-M253. The implication of this is (if the data is correct) that this William Lee 1651-1696, can not be the son of Richard Lee, "The Immigrant". Additional research may reveal that William Lee 1651-1696 is or, is not the correct William, son of Col Richard Lee, that an NPE occurred, or that the lineage of the YDNA test subjects is in error. Although this evidence does weaken the claim that William Lee is the son of Col Richard Lee it does however, strengthen the claim that John Lee Esq is the son of Richard Lee 1677-1626, and grandson of William Lee 1651-1696.

- From my understanding through speaking to a number DNA ‘experts’ and research, to have 6th cousins from separate male lines descending from same shared male ancestor can have different Y-DNA Haplogroups, depending on the rate of mutation and tests taken by the descendants. In fact I have learned that it would be irresponsible (and possibly illegal) to state affirmation that these two male descendant do not share the same ancestral 6th (or 7th, etc.) great-grandfather.
- Now, in contrast, if two males of same male line descend from same shared male ancestor, it is most unlikely they will have different Haplogroups. They should always match, unless there is what is called an NPE (non-parental episode) basically a pregnancy that is not of the same male (father).
- Now -back to the scenario of the two male cousins from separate male descending lines from the same male ancestor (6th great-grandfather as mentioned in first scenario) are being tested against the shared males DNA sample (the 6th gr-grandfathers actual DNA) it is not impossible to have different Haplogroups, without an NPE to cause the difference, it can happen as there are mutations between each generations and genetic distance between the lines.
- Now - in the Lee DNA project(s) case(s) where male cousins from separate descending lines from a shared 6th (7th, 8th,etc.) great-grandfather, having different Y-DNA Haplogroups, the testers are being tested against DNA supposedly from the shared male ancestor (Col. Richard Lee) from only one of the male descending lines, several generations down from shared ancestor (gr-great grandson of Col. Richard Lee - DNA from Gen. Robert E Lee) (Note: the shared common ancestor of the two separate lines is Col. Richard Lee, not Gen. Robert e Lee). Gen. Robert E Lee happens to share direct DNA with only one tested descending line Haplogroup, not both, even though both lines descend from Col. Richard Lee - so the one tested line descending from Gen. Robert E Lee would share his DNA to his tested living descendants as their 4th, 5th, 6th, etc. gr-grandfather - his DNA representing the direct line from Col. Richard Lee, while the other tested living descendant line DNA compared against this same DNA from Gen. Robert E Lee has a relationship to him as a 4th, 5th, 6th, etc., cousin once removed, twice removed, etc., of Gen. Robert E. Lee, so the DNA tested is not a true representation of their Y-DNA from their shared ancestor, Col. Richard Lee. It is probable, and cannot be ruled out, that the tested living descendants from separate lines descending from same shared ancestor, Col. Richard Lee, can have different Y-DNA Haplogroups. Highly probable considering the variables, and it would be a stretch to say that the results show no direct relationship to the shared ancestor by comparing indirect DNA.
- To add to this: there again are even more variables that may affect the differences in the 5th, 6th, 7th, etc., male cousins from separate lines, from a shared male ancestor, such as: what type of Y-DNA tests were done on the individuals, how many markers tested, generational changes, what labs the DNA tests originated, the convergence of separate Lee lines into the line through marriage to female Lee DNA carrier, as in example of the main five ancestral Lee lines (Pimhill, Langley, Stanton, Roden, Lea) marrying into the Lee line that became the Coton of Shropshire line, etc., these variables and generational mutations can, and often do, affect the Y-DNA Haplogroup match results.
- So, basically to say that a descendant from one Lees of Virginia line is credible or not because of the Y-DNA Haplogroup results from separate lines matching or not matching, or stating that one is or is not a true descendant of Col. Richard Lee (The Immigrant) is irresponsible, speculative, and possibly illegal to discredit a lineage because of these Y-DNA results, because having matching Y-DNA Haplogroups with as many variables as these separate male descending lines may or may not happen, even IF the living male descendants were tested from Col. Richard Lee’s own DNA, which in all current testing they are not, which makes the non-matches even more likely to happen. Mutations and changes in the Y-DNA can even happen from father to son.
- The bottom line that was said to me from more than one DNA ‘expert’ was that when it comes to genealogy and DNA testing, DNA testing is to compliment genealogy and documentation, it is not to overrule, or define what is or what is not a viable descending line because there are possible variables, as mentioned above, that can and do effect the results.
- So there are no absolutes here, other than that some of us with multiple Lee lines match DNA with descendants from separate Lees of Virginia lines that carry both the Y-DNA Haplogroups in question. And it is unfair to the living descendants of these lines to speculate in such a manner, to say that absolutely these lines with different Haplogroups from the Robert E Lee DNA carriers are not direct descendants from Col. Richard Lee.
- The most important key to what I am trying to convey, because I am not a “DNA” expert, and citing second hand knowledge which I am limited, is that the Y-DNA Lee descendants are being compared to is not a Y-DNA sample from Col. Richard Lee’s DNA. This is the biggest UNKNOWN factor. So there is not an absolute that Col. Richard Lee, The Immigrant, progenitor of the Lees of Virginia lines Y-DNA Haplogroup is M-253, or M-269. All we know is that one descendant of Col. Richard Lee, that DNA sample is being stated to have the Y-DNA Haplogroup M-253, and the descendants from that group seem to have a match of M-253, while the other 80% of documented descendants are not. And all the facts are not known. What is a fact is that stating from these UNKNOWN factors that a descendant with a well-documented connection cannot be confirmed or denied a relationship to the ancestor, Col. Richard Lee, when in reality, the Y-DNA testing and comparisons present and past are not done against Col. Richard Lee’s DNA - which can be obtained. ALL else is assumption and opinion. This is not for a ‘wikitreer’ to decide, not for any genealogy, historical, DNA project, or Society entity to decide, because it would be a violation of individual rights, involves hundreds, if not thousands of individuals, as laws need to be adapted to today’s DNA and genealogy applications, especially here in the United States where personal rights are even more protected by our Constitution, and one’s individual genealogy, ancestry, and DNA, is a protected right and it is probably best for an entity higher than individuals on websites to decide, the courts being a possibility, how to proceed in the case of descendants of an historic figure as Col. Richard Lee with the denial or acceptance of documented lines since there seems to be a discrepancy – which may or may not be in the current descendant DNA sample which lines are being compared, and again that is all assumptive.

The data and biography indicates that this profilke is John Lee Esq. Before merging it should be determined which John Lee this profile is intended to be.

- In reading the change history it appears that the John Lee Esq of this profile started out as John Lee (JLX) b 1695/96 at Richmond county, Virginia and soon after information for John Lee (JLN) b 1690 at Nansemond, Virginia was added to the profile. This appears to have created the questions regarding Richard Lee and whether he could be the parent of John Lee Esq. This is the result of conflicting YDNA data which is contained in the bio and presented as evidence. It is conflicting because data for two different men with different halplogroups are presented in the same biography.
- The question is: Which John Lee is this profile supposed to represent (JLX) or (JLN) ? If the profile managers can agree on an answer to this much of the confusion can then be resolved.
