In the name of God amen! I Polly Smith of Union County Kentucky being in a loe [sic] State of Health but of a sound mind and disposing memory doe make ordain and constitute this my last will and testament:
1st that should there be any debts against me that they be paid
2ndly having heretofore disposed of my negroes my wish is my great Neice [sic] & nephews (towit) Elizabeth Greathouse to whom I gave my yellow boy Henry (possibly Henry mentioned in father Joseph Smith's Smith-195864 will). should not sell said boy Henry but that the one that first arrives at age or marrys [sic] shall take him and have the boy valued and pay to each of the others their proportion of the value of said boy. 3rd that my house and lot in the town of Simpsonville in the county of Shelby and State of Kentucky be sold and the proceeds of which sale or the amount gotton [sic] for the house and lot together with all bonds for money and debts of every kind together with any money which I may have at my death I wish equally divided between my neice and nephews and great neice and nephews (towit) Betsy T. Johnston Thomas Johnston and James R. Johnston and Elizabeth Greathouse George Greathouse and William H. Greathouse 4th I wish my nepew [sic] Thomas Johnston to have all my house hold furniture most of which is boxed up and left in the care of Smith and Messle of Shelbyville Kentucky. Lastly I appoint Philip Johnston of Union County Kentucky Executor to this my last will. In Testamony whereof I have hereunto set my hand this 6th day of August 1847.

At a county court began and held for the county of Union at the courthouse in Morganfield on Monday the 18th day of October 1847 this last will and Testament of Polly Smith deceased was produced into court and proven as such by the oaths of Wm Thornberry & J. D. Henshaw the subscribing witnesses thereto and was by the Court ordered to be recorded and on the motion of Phillip Johnston the within named Executor who made oath and with George W. Whitecotton and Alexander M. Kenny his securities in the penalty of $2000 conditioned as the law directs a certificate is therefore granted him to obtain a certificate of probate thereof in due form of law.
