Philip A. Manro To the Surogate of the County of Cayuga The Petition of Jonathan S Monro of the town of Thoop County of Cayuga and State of New York respectfully sleweth That Philip A Manro lat of the town of Thoop in the county in the county of Cayuga aforesaid departed this life on or about the 7th day of June in the year of our Lord one thousand eight hundred and seventy. That the said deceas- ed was . At the time of his death an inhabitant of the said county of Cayuga. That he has left a last will and testament which is dated the 27th day of may in the year of our Lord one thousand eight hundred and seventy . That in and by the said will the deceased appointed your petitioner one of the Executors thereof. That the said deceased left the following heirs at law and next of kin to wit: Thomas J Manro Cynthia Rocham and Betsy Atwater of Thoop Bay Cay Co, and Mary Staslow of Auburn NY childred of said deceased. Sybil Manro of Throop aforesaid widow of said decd. That said will relates to bot real and personal Estate the whole value of which will not exceed the sum of $120,00- according to the best information of the petitioner, That your petitioner is desirous of proving said last will and testament, as a will of real and Personal estate, that the same may be recorded as such in pursuance of the Statute in such case made and provided Your petitioner therefore prays the Surrogate aforesaid: that the necessary steps may be taken before hime for that purpose. To Thomas J Manro Cynthia Benham and Betsy Atwater of Throop Cay. Co. Mary Starlow of Auburn NY. And Sybel Manro of Throop NY heirs at law next of Kin and wido of Philip A Manro. Late of Throop Cayuga County N.Y. deceased Send Greeting Whereas Jonathan S Manro of Aurelius Cay. Co. has lately applied to our Surrogates of the County of Cayuga for the proof of the will of Philip A Manro. Late of Throop in said County, Deceased which said will relates to both real and personal Estate. Therefore you and each of you are cited and required to appear at the office of the said Surrogate, in the City of Auburn on the 24th day of June instant at ten oclock in the person of that day , and attired the probate of the said will . In Testimony Wherof, We have caused the seal of office of our said Surrogate to be hereunto affixed. Witness Wm B Woodin Surrogate. Of the County of Cayuga. Cayuga Count ss. Jonathan S Manro of Aurelius in said county being duly sworn deposes and says he served a copy of the annexed original citation on Thomas J Manroe. Cynthia Burham and Betsy Stwater and Sybel Manro at Throop Cay Co. June 13th 1870. and on Mary Hearlow at Auburn N. Y. on the 14th of June 1870 That such service was made by handing to and leaving with each of said persons a copy of and at the same time shewing to each the said original Deposment further says he knows the several persons

ET Woodin Clerk to Surrogats Court At a surrogates Court held at the Surrogates office in the city of Auburn in and for the County of Cayuga. On the 24th day of June A.D. 1870 Present Wm B Woodin Surrogate An Instrument in Writing purporting to be the last will and testament of Philip A Manro. Late of the town of Throop in said county, deceased. Was appeased for proof and probate as a will of real and personal estate. Pursuant to the Statute in such case made and provided. On filing due proof of the service of the citation heretofore issued in this matter upon the him at law and next of kin of said dec d as required by law, It is Ordered that this matter be now brought on to be heard and both of the subscribing witnesses to said will were produced in open Court and testified as follows: In the matter of the proof and Probate of the last will and testa -ment of Philop A Manro, Deceased…. Cayuga County Ss John M Deuison of The town of Throop in said county being duly sworn says: I was well ac- quainted with Philip A Manro late of the town of Throop in the county of Cayuga. Aforesaid, deceased I was present when a certain instrument in writin now here shown to me bearing date the 27th day of May A. D. 1870. and purporting to be the last will and testament of said deceased, was executed. I saw the deceased execute the same by signing his name at the end thereof. I heard him publish and declare the same to be his last will and testament. The deceased requested me to becom a subscribing wit- ness to the execution threof. I did so. And signed my name thereto as such witness in his presence. The said deceased was in my opinion at the time of the execution of said instrument of a sound and disposing mind

In the manner of the proof and probate of the last will and testa- ment of Philip A Manro, deceased… Cayuga County ss Lelilis P Dean of the town of Throop in said county being duly sworn says: I was well acquainted with Philip A Manro. Late of the town of Throop in the county of cayuga aforesaid deceased; I was present when a certain instrument in writing now here shown to me, bearing date the 27th day of May A. D. 1870. and purporting to be the last will and testament of said deceased was executed. I saw the deceased execut the same by signing his name at the end thereof. I heard him publish and declare the same to be his last will and testament the deceased requested me to becom a subscribing witness to the execution thereof. I did so . And signed my name thereto as such witness in his presnece, the said deceased was in my opinion at the time of the execution of said intrument of a sound and disposing mind and memory and in all respects competent to make and publish a last will and testament and to devics real estate, that he was of full age and under no restraint that I know of. N.York of the age of seventy four years and being of sound mind and memory blessed be God for the same do make publish and declare this my last will and testament in manner following that is to say First I give and Bequeath to my wife Sibel an annuity of Four Hundred and ninety Dolars payable quarterly from the time of my decease during the term of her natural life to be accepted and received by her in lie of Dower Second. I give and bequeath to Luch leaduer a blind Girl an annuity of Seventy Dollars payable semi annually from the time of my decease during the term of her natural life. Third. I give an dbequeath to the Baptist Church of Throopsville in said County and annuity of Seventy Dollars payable annually from the time of my decease for the support of the minister and ministers of said church so long as said Church shall exist in its present State and condition, and it is my will and I direct that the legacies and annuities aforesaid shall be a charg upon all my Estate both real and personal Forth I give divise and bequeath all the rest residue and

remainder of all my real and personal Estate which I now own or of which I may die possessed to my five children, Jonathan S. Mauro Mary Kaslow Thomas J Manro, Betsey L. Stevater and Cynthia K Burham to be divided equally between them share and share alike To have and to hold the same to my said childrend their heirs and assigns forever, and it is my will and I direct that my Executors herinafter married shall have full and complete control and possession of my real Estate wherever situate from the time of my decease with full power and authority to sell or rent the same for so long a time after my decease as my said Executors shall deem best for the interest of my said children the avails of such sales and the rents of said real estate to be divided between my said children Equally as

aforesaid in a reasnoable time after the reciept of the same by my said executors, Fifth I give and bequeath to Squire Plioduer, the sum of Five hundred dollars payable in one year after my decease which Legacy I make a charge on all my real and personal Estate and Shall take preference of the bequist to my said five children herein before set forth. And Lastly I hereby appoint my tow sons Jonathan S. Manro and Thomas J. Manro Executors of this my last will and testament hereby revoking all former wills by me made In Witness Whereof I have hereunto set my hand and seal this 27th Day of May A. D. 1870 P A Manro The foregoing instrument consisting of one she was at the date thereof declared to us by Philip A Manro the testator therein mentioned to be his last will and testament and he at the same time acknowledged to us each of us that he had signed and sealed the same and we thereupon at his request and in his presence and in the presence of each other signed our names thereto as attesting wittnesses.
