I Russel Givens of Vanderburgh County in the State of Indiana do make and publish this my last will and testament.
I give to my children Lilly Carter, Susan Carter, Mary Ann Vinson, Martha Givens, Green Givens, Henry Givens, George Givens, Samuel Givens, and Russel Givens one dollar each tho having heretofore had their portion of my portions of my property and I give unto Samuel Givens and Thomas Givens my two youngest children the tract of land I bought of Horace Plumer containing five acres also all my personal property that I may have at the time of my death. The above in subject however to the payment of my debts which direct my executor to pay out of the first money that may come to his hands for which purpose I hereby nominate and appointing James T. Walker my Executor to this my last will and testament as aforesaid hereby authorizing and empowering him to compromise adjust release and discharge all my debts and receive all due me for the said purposes.
In testimony hereof I have hereunto set my hand and seal this 1st day of January 1858. Russel (his X mark) Givens

Be it remembered that on the 23rd day of January 1858 James Amos one of the subscribing witnesses to the within and foregoing last will and testament of Russel Givens late of said County deceased, personally appeared before Louis Richter Clerk of the Court of Common Pleas of Vanderburgh County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and certified as follows that is to say that on the first day of January 1858 he heard the said Russel Givens request James T. Walker Esq to sign his name to said instrument in ??ting as and for his last will and testament and that this & disposing as the same one law & the said Russel Givens adopt said signature by making his mark thereto and that he ??? the said Russell Givens declared the said instrument in writing to be his last will and testament and that the said instrument in writing was a the same time at the request of the said Russel Givens and with his consent attested and subscribed by the said James Amos, Josiah Jenkins and Jas T Walker in the presence of the said Testator and in the presence of each other as subscribing witnesses thereto and that this said Russel Givens was a the time of the signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

Sworn and subscribed by the said James Amos before me Louis Richter Clerk of said Court at Evansville this 23d day of January 1858. In attestation whereof I have hereunto subscribed my name and affixed the seal of the said Court. Louis Richter clk.

I Louis Richter Clerk of the Court of Common Pleas of Vanderburgh County in the State of Indiana do hereby certify that the above & foregoing is a full true & complete Record of the last will and testament of Russel Givens late of Vanderburgh County deceased and of testimony of James Amos upon which said will was by me duly admitted to probate and upon my attestation of said testimony. In testimony whereof I hereto sign my name this 23d day of January 1858. Louis Richter Clk.
