Will of William Shipton (1747-1812)

I William Shipton of Yoxall Woodhouses in the Parish of Yoxall in the County of Stafford Gentleman do make and ordain this my last Will and Testament and first I direct all my just debts Legacies and Funeral expences to be fully paid and satisfied

I Give and devise unto my Two Nephews William Shipton and Robert Shipton All that my Messuage Farm and Tenement with all and singular the Lands and Appurtenances belonging to me situate at Scropton in the County of Derby To hold to them the said William Shipton and Robert Shipton their Heirs and Assigns for ever equally share and share alike as Tenants in common and not as jointenants but subject to and charged and chargeable with the Payment of the following Annuities Legacies and Sums of Money that is to say, subject to and charged and chargeable with one Annuity yearly rent or sum of Twenty Pounds a Year unto my sister Ann Pott for and during the Term of her natural life by four Quarterly Payments in the Year at the four most usual Quarterly days of Payment in the Year, that is to say, Lay Day Midsummer day Michaelmas day and Christmas day the first payment thereof to begin and be made at such of the said days as shall happen next after my decease and also charged and chargeable with one Annuity yearly rent or sum of Twenty pounds a year unto my sister Dorothy Wetton for and during the term of her natural life by four like Quarterly payments in the Year at the said above Quarterly days and the first payment to be made at such of the said days as shall first happen after my decease And also charged and chargeable with one other Annuity Yearly rent or sum of Twenty Pounds a Year unto my sister Mary Willcock for and during the Term of her natural life by four like Quarterly Payments in the Year at the said above Quarterly days and the first payment to be made at such of the said days as shall first happen after my decease and I will and direct that the said several Annuities shall be paid and payable to my said three sisters to and for their own sole and separate use independent of their present Husbands or any Husband they may hereafter respectively marry and that the same shall not be subject or liable to the debts or engagements of their respective Husbands and that the receipt and receipts alone of my said sisters shall from time to time be a sufficient discharge to my said nephews for their said several Annuities and in case of default of payment of the said Annuities or any of them at any time hereafter it is my will and direction that my said sisters or any of them shall have full power to enter into the said Premisses or any part thereof and to distrain for the same for the recovery thereof in the same way as in cases of distress for rent and from and after the decease of the survivor of my said sisters I discharge and make liable the said Messuage Farm and Premisses with the payment of the sum of One hundred Pounds unto my Nephews and Nieces Ann Shipton Mary Shipton Sarah Shipton ------ John Shipton George Shipton Richard Shipton and Joseph Shipton to be paid to them within Twelve Months next after the decease of the survivor of them my said sisters if they shall have attained their respective ages of twenty one years and such of them as shall not have attained their age of twenty one years to be paid to them when they shall have respectively attained that age / I Give and Devise to my sister Dorothy Wetton all that Messuage or Tenement wherein she now lives with Two Pieces of Land called the High Ash and a new Inclosed Piece of Common Land all which Premisses are situate in the Parish of Abbots Bromley To hold the same to my said sister Dorothy Wetton for and during the term of her natural life and from and after her decease I Give and devise the same unto her son Thomas Wetton his Heirs and Assigns for ever

I Give and devise to my Nephew Matthew Corr Dawes and to his Heirs and Assigns for ever All those Pieces of Land called Averill Hayes and Woolleys Meadow situate in the Parish of Yoxall aforesaid and now in possession of Samuel Adderley I Give and Devise unto Thomas Dawes the Younger of Yoxall aforesaid and Charles Barnes Robinson of Hill Ridware in the County of Stafford Gentleman and their Heirs All that Messuage or Tenement with the Lands and Hereditaments thereto belonging as well Freehold as Copyhold situate and being within the Manor and Parish of Yoxall aforesaid and which I lately purchased from Thomas Astle Esquire deceased In Trust nevertheless for the purposes after mentioned and to support and preserve the contingent uses and Estates hereinafter limitted from being defeated and destroyed but nevertheless to permit and suffer my Nephew John Shipton and his Assigns during his life to receive and take the rents and profits thereof and of every part thereof to and for his and their own use and benefit for and during the term of his natural life and from and after his decease In Trust and to and for the use and behoof of the first son of the Body of my said Nephew John Shipton and the Heirs Male of his Body lawfully Issuing and in default of such issue In Trust for the second third fourth and all and every other the son and sons of the Body of my said Nephew John Shipton in Tail Male the Eldest Son and the heirs of his Body being always preferred before the Younger and the Heirs of his body in seniority of age and Priority of Birth and in default of such Issue to all and every the Daughter and Daughters of my said Nephew John Shipton to take equally as Tenants in Common and not as jointenants and their heirs and if there shall be but one such Daughter then to such only Daughter her Heirs and Assigns for ever and in default of such Issue In Trust for and to the use and behoof of my Nephew Thomas Shipton and his Assigns in like manner and in default of Issue of my Nephew Thomas Shipton In Trust for and to the use and behoof of my Nephew William Shipton and his assigns in like manner and in default of Issue In Trust for and to the use and behoof of my Nephew Robert Shipton and his assigns in like manner and in default of issue In Trust for my own right Heirs for ever I Give and devise to my Niece Elizabeth Yeld all that one Acre of Land more or less lying inclosed within Mr Woodroffe's Mickle Meadow in the Parish of Yoxall To hold to her my said Niece Elizabeth Yeld her Heirs and Assigns for ever I Give and devise to my said Niece Elizabeth Yeld All that Messuage Farm and Lands both Freehold and Copyhold situate at Yoxall Woodside and now in possession of Thomas Lakin together will all right and claim upon the Forest or Chase of Needwood belonging to the same To hold the same to my said Niece Elizabeth Yeld for and during the term of her natural life and from and after her decease to her son William Walter Yeld his heirs and assigns for ever

I Give and devise to my Nephew Thomas Shipton All that Messuage Farm and Lands situate in the Parish of Yoxall aforesaid which I purchased from Isaac Hawkins Brown Esquire and also all those Pieces of Land called the Pail Piece and also a Messuage and Land being Copyhold which I purchased of William Alldrit And also all that Freehold Land which I purchased from William Shorthouse and the moiety of the Lands and Premisses given and devised to my by my late father and all my Freehold and Copyhold Lands whatsoever and wheresoever To hold to my said Nephew Thomas Shipton his heirs and assigns for ever And I Give and bequeath unto my said Nephews Thomas Shipton and John Shipton all my Household Goods Plate Linnen and China to be equally divided between them and the Tenant right and possession of the Messuage Farm and Lands at Yoxall Woodhouses together with the stock their both quick and dead and the crops growing thereon at the time of my decease

and all the rest and residue of my Personal Estate Moneys and Securities for Moneys and also the Tenant right and possession of the farm called the Twitchell Farm with the stock there both quick and dead and crops growing at the time of my decease I give to my Nephew Thomas Shipton his Executors and Administrators but charged and chargeable with and I make liable the said Messuages Land and Personal Estate so by me Given Devised and bequeathed to him my said Nephew Thomas Shipton with the payment of my Debts Funeral expences and charges of proving my will and also with the following Legacies and Sums of Money (that is to say) to my Nephew Thomas Pott the sum of Two hundred Pounds to my Nephew Thomas Wilcock Two hundred Pounds to my Nephew John Wilcock One hundred Pounds To my Nephew Stephen Wilcock One hundred Pounds to my Nephews Thomas Wetton John Wetton and Benjamin Wetton and to my Nieces Ann wife of John Reed Dorothy Wetton Mary Wetton and Louisa Wetton One hundred Pounds each I Give to my Niece Elizabeth Harvey One hundred Pounds and to William Birch of Barton under Needwood surgeon and apothecary the Sum of One hundred Pounds all which Legacies I will shall be paid in the twelve months after my decease and I Give unto my old servant William Slater the sum of Twelve Pounds per annum for and during the term of his natural life to be paid to him by my said Nephew Thomas Shipton half yearly at Lady Day and Michaelmas in every year the first payment to begin and be made at such of the said days as shall next happen after my decease with the like remedy for recovering the same as I have hereinbefore given to my sisters for the recovery of their Annuities and I direct my Nephew John Shipton to pay to my said Niece Elizabeth Yeld the sum of Fifty Pounds within Twelve Months after my decease to be by her expended in a monument to be erected to the memory of my late wife and myself in the Parish Church of Yoxall And Lastly I do hereby make nominate constitute and appoint my Brother John Shipton and my said Nephews Thomas Shipton and John Shipton Executors of this my last will and Testament hereby revoking all former wills by me at any time heretofore made and declare this only to be my last will and Testament In Witness whereof I have to this my last will and Testament contained on Four Sheets of Paper to the three first set my hand only and to the last my hand and seal this eleventh day of June in the Year of our Lord One thousand eight hundred and four

Memorandum made by me at the time of the execution of my Will by me William Shipton and it is my Will and direction that if the monument by me in my will directed to be erected shall exceed the sum of Fifty Pounds that what the same shall exceed shall be paid to my niece Elizabeth Yield by my Nephew Thomas Shipton and I further give to Hannah Yield Daughter of my Niece Elizabeth Yield the sum of one hundred pounds to be paid to her at her age of Twenty one years or day of marriage which shall first happen and to Elizabeth Shipton wife of John Shipton I give the sum of ten pounds to buy her mourning which said two legacys I will shall be paid by my Nephew Thomas Shipton In Witness whereof I have hereunto set and put my hand and seal as a codicil to my last will and executed at the time of the execution of my Will

I William Shipton of Yoxall Woodhouses in the Parish of Yoxall in the County of Stafford Gentleman do make and ordain this as a Codicill to be annexed to and taken as part of my Will which I have heretofore made and bearing date the eleventh day of June one Thousand eight hundred and four and it is my Will and I hereby direct that instead of the Legacy by me given in my said will of one hundred pounds to my niece Ann Shipton and charged upon my farm and lands at Scropton I give and bequeath to her my said niece Ann Shipton the sum of four hundred pounds to be paid to her by my nephew Thomas Shipton within twelve months next after my decease out of the personal estate and effects by me given to him in and by my said will and this my codicill. / And the devise by me made to my sister Dorothy Wetton now the wife of Samuel Adderley of the Premisses at Abbots Bromley for her life with remainder to her son Thomas Wetton in Tice and who is since dead I hereby revoke such devise in favour of my said sister and her son and I hereby give and devise the said Premisses at Abbots Bromley unto my Nieces Dorothy Wetton and Mary Wetton and to their heirs and assigns forever to take equally share and share alike as tenants in common and not as jointenants and I hereby also revoke the bequest made in my said will of my household goods plate linnen and china to my nephews Thomas Shipton and John Shipton and the Tenant right and possession of the Messuage Farm and Lands at Yoxall Woodhouses and the stock quick and dead and crops there growing to my nephew John Shipton and instead thereof I Give and bequeath all my said household goods plate linnen and china and the Tenant right and Possession of the said Farm at Yoxall Woodhouses together with the stock there both quick and dead and the crops growing thereon at the time of my decease unto my nephew Thomas Shipton his Executors and Administrators but charged and chargeable together with the other personal estate given him by my said will with the payment of the said sum of four hundred pounds hereinbefore given to my niece Ann Shipton. And the Legacys by me given in my said will to my Nephews Thomas Wilcock and Thomas Wetton who are both since dead I direct shall sink into the residue of my personal estate and I hereby nominate constitute and appoint my Nephew Robert Shipton as Executor to my said will with his Brothers Thomas Shipton and John Shipton in the place and stead of my Brother John Shipton who is dead since the making of my said will and I hereby in all other respects ratify and confirm my said will In Witness whereof I have to this Codicill which I direct to be annexed and taken as part of my said will and contained in two sheets of paper to the first set my hand and to the last my hand and seal the nineteenth day of April in the year of our Lord one thousand eight hundred and six.

Let a Probate of this Will and the two Codicils annexed be granted to Robert Shipton Thomas Shipton and John Shipton all of Yoxall Woodhouses in the County of Stafford Gentlemen the joint Executors therein named

They being duly sworn and also that the deceased's Personal Estate would not amount in value to the sum of 3,500£
