Probate Court Special Term September 19th 1874
Sinah Jones Dec'd Estate of
This day came D.B. Jones & filed his petition in writing therewith producing & filing in this court an instrument of writing purporting to be the last will and testament of Sinah Jones dec'd and praying for such orders & decrees & proceedings as may be proper & requisite for the due probate & record of said will in this Court which said will appears to be attested by Grandison Smitherman and Jesse T. Tucker of Baker County, Ala & who are alleged to have signed the same as subscribing witnesses thereto and that the heirs of the said Sinah Jones dec'd are as follows to wit: D B Jones your petitioner, a son of said dec'd & of full age & a resident of Bibb County, Ala. Margaret Latham & Harriett E Belvin both daughters of said dec'd both of full age and residents of Baker County, Alabama & the children of Susan A E Johnston who was a daughter of said deceased to with: Mary S Johnston, Sarah J Johnston both of full age and residents of Twiggs County, Georgia. John G Johnston, Cicero Y Johnston, Francis M Johnston & Susan A Johnston all minors & under 21 years of age & residents of Twiggs County, Georgia.
It is threfore ordered by the Court that the 12th day of October 1874 be set as a day for hearing testimony in proof of said instrument as such will that said Grandison Smitherman & Jesse T Tucker be subpoened to be and appear on said 12th day of October 1874 in & before this Court to Testify & give evidence of & concerning all and any facts touching the question of the validity of said instrument as such will. That said Margaret Latham and Harriett E Belvin be notified of this proceeding & of the day set for hearing the same by citation personally served in time of least ten days before said day set for said hearing & that Mary S Johnson, Sarah J Johnson, John G Johnson, Cicero Z Johnson, Francis M Johnson, Susan A Johnson all have notie of the same by forwarding notice to them to their post office Twiggs Post Office, Twiggsville, Georgia at tleast then sdays before said day of hearing. An it is further ordered that James W Owens be & he is hereby appointed guardian ad litum to represent & protect the interest of John G Johnson, Cicero Z Johnson, Francisc M Johnson & Susan M Johnson who are minor heirs & who are interested in the proceeding & he being in open Court accepts said appointment.
