1861 -- Will of Epenetus Heath dated 24 Dec 1861 and probated on 11 Feb 1862 in Fulton County Court, Georgia.

Epenetus requested that:

  • "all my land & negroes shall remain as at present undisturbed until my beloved daughter marries after which my desire is that all my property of every kind except the negroes be sold & the proceeds equally divided between my beloved Wife & my two children Sarah and William"
  • the "negroes be divided [among his family members] without selling them.

Bequeathed to his wife, Elizabeth: the choice of one or two Negroes (unnamed). At Elizabeth's death, the enslaved people were to be equally divided between his two children.

Bequeathed to his daughter, Sarah: a Negro man, Jeff Heath (bef.1861-), and his family. At Sarah's death, the enslaved people were to be given to her children.

Bequeathed to his son, William -- Epenetus directed the Executors of his estate to "select one of the shrewdest or smartest & most suitable Boys of the Balance of my negroes to train as a Blacksmith for my beloved son William."

All of the enslaved people owned by Epenetus (names and number unknown) were to be valued and divided as equally as possible among his wife and two children.
