Will 1836, Elbert County, GA

Will - WB A 1835-1860 p.10-11, dated May 4, 1836[1]

Children named in will:

  • James A. Banks (dec'd at time of will)
  • William C. Banks (dec'd at time of will)
  • Nathaniel Banks (lives in Abbeville)
  • Gily Y. Harper, daughter
  • Martha A. Crawford, daughter
  • Hannah K. Oliver, daughter (dec'd at time of will)
  • Francis A. Banks
  • Sarah E. Banks

This Will gives to James' son Francis A. Banks the tracts of land on which James lived at the time, and directs Francis to "keep the whole of my property together made with the proceeds of my past debts but should Executor find in first years that he will not be able to accomplish that, then in that case I wish the whole of personal property with the exception of my negroes to be sold on a usual credit, and my land rented and my negroes hired out until said sale of personal property the rent of land and hire of negroes shall raise a sufficiency of money to pay off my debts."

No information was found about where James' enslaved people were hired out, but it's presumed that after James' death they were enslaved by his son Francis A. Banks (abt.1814-abt.1894) and "hired out" by him.

The Will gives the following enslaved to daughterSarah E. Banks (abt.1822-abt.1862) :
