James died in December 1773 at his Mount Prospect plantation in Essex County. His will was written on 20 August 1773, probated 17 January 1774, and gave four enslaved people to his oldest two children.[3] The remaining enslaved people were given to his wife Mary (Smith) Webb to hold until his remaining children came of age, at which point they were to be divided in shares.
His estate inventory was recorded on 17 April 1775. The inventory named and gave valuations for 24 enslaved people, including the four named in his will.[4]
