Application to The State of TexasCounty Court February __ AD 1850 (pencilled notation "1854") Probate Will County of Harrison
To the Chief Justice of said County. :The petition of John B. Webster and Jefferson M. Saunders respectfully shows that John J. Webster late of said county departed this life about the 19th of January A.D. 1854 having a will. That said Testator in his said will appointed your petitioner his executors. Said will is filed in the office of the Clerk of said Court of date January 25th, 1854. :They therefore pray that for the purpose of probating said Will it be made a part of this petition that said Will be duly probated as by law directed at said term of said Court to be held on the last Monday in February ______. :That petitioners be appointed executors of said Will and that they be permitted To qualify without bond as allowed by said will for such other orders as may be needful under the requirements of the law. Affidavit of The State of Texas
- This is to certify that on the 13th day of March AD 1854 J.M. Saunders, County of Harrison personally came before Mr. J.A. Patillo, chief justice in and for J.B. Webster said County. John B. Webster one of the executors of the estate of John J. Webster deceased who took and subscribed the following oath as such executors, to wit.
I John B. Webster do solemnly swear that the writing presented for probate I believe to be the last will and testament of John B. Webster deceased and that I will well and truly discharge and perform all the duties of execution of the estate of the said John B. Webster deceased to the best of my skill and ability. So help me God! Sworn to and subscribed before me this 13th day of J. B. Webster March A.D. 1854. T.A. Patillo, Chief Justice The State of Texas I T.A. Patillo, Chief Justice in and for the County aforesaid County of Harrison do hereby certify that Jefferson M. Saunders one of the executors of the last will and testament of John E. Webster deceased on this 16th day of March AD 1854 personally appeared before me and took and subscribed the following oath as such Executor to wit: I Jefferson M. Saunders do solemnly swear that the writing which has been presented for probate I believe to be the last will and testament of John E. Webster deceased and that I will well and truly discharge and perform all the duties of Executor of the estate of the said John E. Webster deceased to the best of my ability. So help me God! Census Records
In 1830 J. J. Webster has 45 enslaved persons enumerated under his name.[3]
In 1840 John Webster is again seen in Tuscaloosa Co, AL with 12 enslaved listed on the census. Its possible the others were in Texas at this time, building the plantation house.[4]
