Introduction

John Martin (abt.1698-1783) was a slave holder in Caroline County, Virginia. He passed his slaves to his children, who were also slaveholders, and many of whom migrated to North Carolina, continuing the plantation life there.

Will of John Martin

From S. Waters: "Here is the 1783 Will of John Martin (abt.1698-1783) of Caroline County that I personally saw and transcribed:"[1]

  • In the name of God Amen, I John Martin of the County of Caroline being of sound since and memory do make and ordain this my last will and testament. I lend unto my beloved wife all my Estate both real and personal and at her decease to be divided as followeth:
  • Item I lend unto my daughter Mary Gaunt during her life three negros Doll, Cyrus and Andrew with all their future increase and after decease to be equally divided among all her children.
  • Item: I lend unto my daughter Bridget Spindle during her life three negros Sam, Janny and Ben the son of Janny with all their future increase and at her decease to be equally divided among all her children.
  • Item: I lend unto my daughter Christian Eubank during her life three negros Casar, Dinah and Winney Dinah's child with all their future increase and at her decease to be equally among all her children.
  • Item: I give unto Ambrose Blackburn and his assignees in trust for the use and separate maintenance on my daughter Ann Bowler during her life three negroes Prince, Gilbert and Judy with all their future increase and one forth of my household and kitchen furniture and after her decease to be equally divided among all her children.
  • Item: I give unto my three daughters Mary Gaunt, Bridget Spindle and Christian Eubank the remainder of my household and kitchen furniture to be equally divided among them.
  • Item: I give unto son John four negroes Ben, Sarah, Lucy and Charles with all their future increase.
  • Item: I give unto son Isaac four negroes James, Anthony, Aggy and Judy with their future increase.
  • Item: I give unto son William four negroes George, Seth, Phillis and Tom with all their future increase.
  • Item: I give unto my son Henry's children four negroes Davy, Grace, Phebe and Peter with their future increase to be equally divided among them only reserving to the widow of my son Henry the use of the one third part of the said negroes during her widowhood.
  • Item: I give unto my son Ambrose's children four negroes Frank, Milley, Pheby and Janey the daughter of Milley with their future increase to be equally divided among them only reserving to the widow of my son Ambrose the use of the one third part of the said negroes during her widowhood.
  • Item: I give all the remainder on my estate both real and personal unto my sons John, Isaac and William and my sons Henry and Ambrose's children to them and their heirs forever to be equally divided into five lots and my son Henry's children to have one lot equally divided amongst them and my son Ambrose's children to have one lot equally divided among them reserving to the widows on my sons Henry and Ambrose the use of one third of what is here given their children during their widowhood and lastly I appoint my sons John and Isaac and grand son John Spindle Jr Executors.
  • I have there unto set my hand and seal this 5 day of August 1783. John X Martin (his mark) Signed Sealed and Declared to be his last Will in presence of us. James Upshaw and L. Upshaw
  • Caroline October Court 1783 This Will was proved by the oath of James Upshaw and ordered to be certified on motion of John Spindle one of the Execs therein named who made oath thereto according to law. Certificate is granted him for obtaining a probate thereof. Bond acknowledged and ordered to be recorded.
  • Caroline November Court 1783. On motion of Isaac Martin a probate of said Will was granted him he having taken the oath prescribed by Law bond with Security acknowledged and ordered to be Recorded. signed Wm Nelson
