The following record was found within the probate files: Transcription: Depositions of witnesses sworn & examined this 9th day of October AD 1854 at the house of Alford Gandy under and by virtue commission ... out of the probate court of the state of Ala for Tallapoosa County in a certain cause there in pending between Hicks + Kinnebrew complainant and the Divicees of LB Kinnebrew Respon(d)ant Allen L Bailey + Philemon Owen, being duly sworn (and?) Examined on the part of complainaint doth depose and say as follows(.)

To 1st Intero they sayeth Ans, we are

To 2nd Integ Ans: we are acquainted with the settlement of lands LB Kinnebrew owed at his death.

To the 3rd Ans: we know the most of them for instance Dick. Rachel. Violet. Jim. Fanny + three children to Wit Nelly, Francis, Lucinda. + Sillar. Henry. Frank. Harriett. Charity. Hall. Phelix. Alax. Polly + four children (Wit) Martha, Sarah. Joe + John. We gave it as our opinion the land cannot be divided into seven shares equitably divided without a sale to the division regardless to the negros division we have the following opinion= we are of an opinion that the negros cannot be divided equitably to the satisfaction of the Devicees without sale.
