In his will Solomon stated the following: "It is my express will and direction as soon after my death as it can ....be done my executors cause all my negroes and their increase then living to be removed and settled in some free state or states and that all the rest of my estate which may have at the time of my death not herein otherwise disposed of real and personal be sold by them, and the proceeds thereof, including my money then on hand and also the proceeds of all my debts and notes then on hand and of all my rights and credits of every kind be wholly applied to the removing, purchasing of lands for my negroes aforesaid and settling them.
But if it should happen that said negroes cannot[5] be removed to a free state or states either because the laws of such state or states prohibiting such removal and settlement or from any other good and sufficient reason then it is my will and direction that my said negroes be transported to the Colony of Liberia or to some other colony of free negroes on the coast of Africa and that proceeds of my property......applied to the expense of their removal to Africa and to their location and settlement there."[6]
The will is dated 1856.
Probate
Documents from the executors within the probate file state that there was a delay in the filing of Solomon's will due to the "public mind against the validity of the emancipation" and that there was a "strong and violet opposition to the establishment of said will".[7] The estate was not fully distributed until sometime in the 1870's. By which time the question of slaves was a mote point.
During the court case that followed the slaves were hired out but the money was not paid into the estate. [8] There were also numerous other allegations of mismanagement of the estate. The dispute in the will was between: Pickney Hall in behalf of himself and all other legatees, former slaves of Solomon Hall vs Joseph W Hall and Burton Craig.[9]
