Tilitha wrote her will in 1859. It was entered for probate in 1862.[1]
- To son, Joel W: Dick (boy) about age 17 or 18 (sometimes called Richard)
- To daughter, Elizabeth Hicks: George (man), Emily (woman) [son Huden Phillips to be trustee guardian]
- To son, Huden Phillips: Ben (man) about age 20
- To son, John H Phillips: Jerry (boy) about age 16 or 17
- To grandchildren, Frances Tilitha Hopkins & James K Polk Hopkins (children of daughter Frances Amanda): Adaline & Ellen (two small girls)
- To be sold: Bill, Ben, Racheal & her youngest child Gus
- To be divided equally between her four children: Allen, Nancy, Esther, Rudge, Allen, Margaret, Alice, Osborn, Dolly, Henry, & West
- Esther, Henry, West, Alice, and Dolly are probably the unnamed woman and children on the probate inventory
