This is the last Will and Testament of me John Pepper late of
Woodthorpe in the County of Leicester but now of Loughborough in the same
County Farmer I give and bequeath all my household goods and furniture
plate linen and china and all other household effects in my Dwelling-
house in Loughborough aforesaid in which I now reside And also my Light
Sprung Cart and the Harness belonging to and used with the said Sprung Cart
now in the possession of my Son James Pepper at Woodthorpe aforesaid unto
my Dear Wife Sarah for her life if she shall long continue my Widow and
after her decease or marrying again ( which shall first happen ) I bequeath
the said household goods and furniture plate linen and china and other
household effects in my said Dwellinghouse at Loughborough aforesaid (except
my large family Bible) unto my Son James Pepper and my Son in law
Samuel Wale of the Parish of Wimeswold im the said County of Leicester Farmer
their executors administrators or assigns Upon trust that they or the survivor of them
or the executors administrators or assigns of such survivor shall sell and
convert the same into money And do and shall stand possessed of the monies
to arise from such sale and conversion into money as aforesaid Upon the
trusts hereinafter declared concerning the same And my said Light Sprung
Cart and the Harness belonging thereto And also my said large Family
Bible I bequeath to my said Son James Pepper absolutely I give and
bequeath the profits and produce which shall during the life of my said
Wife arise from the Messuage Farm and Lands situate in Woodthorpe aforesaid
now in my occupation and rented by me And also all my live and dead
Farming Stock Implements of Husbandry and all other my personal Estate
and Effects whatsoever and wheresoever unto my said Wife during her life if
she shall so long continue my Widow and after her decease or marrying again
(which shall first happen) I give and bequeath the Tenancy of the said
Messuage Farm and Lands (provided my Landlord William Herrick Esquire
shall consent thereto) And also my said farming Stock Implements of
husbandry household goods and furniture and all other my personal Estate
and Effects in about or upon the said Messuage Farm and Lands at
Woodthorpe aforesaid And all other my personal Estate and Effects whatsoever
and wheresoever not hereinbefore specifically bequeathed unto my youngest Son
the said James Pepper absolutely subject nevertheless to and charged and
chargeable with the payment thereof by him of my just debts and funeral
and testamentary expenses and the expenses of proving this my Will and of

the following Legacies ( that is to say ) To my eldest Son Thomas Pepper the
sum of One hundred and twenty Pounds and to each of my four Daughters
Mary Renals, Sarah Renals, Elizabeth Wale and Eliza Pepper the sum of
Twenty Pounds Which said Legacies I direct shall be vested interests in the said
Legacies respectively immediately upon my decease And shall be paid to them
within six calendar months next after the decease or marriage of my said
Wife (which shall first happen) with interest for the same after the rate of Four
Pounds and tenshillings per centum per annum from that period until
payment thereof I give and devise all me Messuages Lands Tenements
and hereditaments situate at Woodhouse Eaves in the said County of Leicester
And all other my real Estate whatsoever and wheresoever of which I now am
or at any time hereafter may be seised or possessed of or which I now have
or hereafter may have power to dispose of by this my Will with the appurtenances
thereto respectively belonging Unto and to the use of my said Son James Pepper
and my said Son in law Samuel Wale their heirs and assigns Upon trust
that they or the survivor of them or the heirs executors administrators or
assigns of such survivor shall receive the rents and profits thereof and thereout
in the first place pay the interest of any money due and owing by me at my
decease on Mortgage Bond or Note and thereout in the next place keep the
said Messuages and Real Estate in good and tenantable repair and condition
and also ( if thought necessary by them ) insured from loss or damage by fire
and shall pay the remainder of the said Rents and Profits unto my said
Wife during her life provided she shall so long continue my Widow and after
her decease or marrying again ( which shall first happen ) then Upon trust
that they my said Trustees or the survivor of them or the heirs executors
administrators or assigns of such survivor shall make sale and absolutely
dispose of my said Messuages Lands Tenements hereditaments and real Estate
eith the appurtenances either together or in parcels and either by Public
Auction or Private Contract and generally in such manner and form as to
them or him shall seem fit for the best price or prices that can be
reasonably obtained for the same And I declare that my said Son James and my
said Son in Law Samuel Wale and the survivor of them and the heirs
executors administrators or assigns of such survivor shall out of the monies
to arise from the sale of my said Real Estate and from the sale and conversion
into money of such part of my said personal Estate as is hereinbefore directed
to be sold and converted into money as aforesaid in the first place pay

all the expenses attending such sale or sales or otherwise incurred in the
execution of the aforesaid trusts or in isolation thereto and then do and shall
pay the remainder of such Trust money unto my said Daughters Mary
Renals Sarah Reneals Elizabeth Wale and Eliza Pepper equally to be divided
between them share and share alike as Tenants in Common and not as joint
Tenants and to be vested interests in my said Daughters respectively
immediately after my decease and to whom I bequeath the same accordingly
in addition to the Legacies hereinbefore bequeathed to them Provided always
that my said Daughters Mary Renals Sarah Renals and Elizabeth Wale shall
not receive any part of the said trust monies lastly hereinbefore bequeathed
until they shall have respectively paid to my said Trustees or Trustee or
allowed themselves to be charged or debited by my said Trustees or Trustee
with the following sums of money which I have already advanced to my
said Daughters, that is to say, the said Sarah Renals the sum of Twenty
Pounds the said Elizabeth Wale the sum of One hundred Pounds and the said
Mary Renals the sum of Thirty five Pounds And I direct that the said
several sums of Twenty Pounds, One hundred Pounds and thirty five Pounds
shall be held by my said Trustees or Trustee upon the same trusts as are
hereinbefore declared concerning the monies to arise from the sale of my real
and personal Estates hereinbefore directed to be sold and shall be divided
amongst my said four Daughters accordingley share and share alike as
Tenants in Common I empower my said Trustees or the survivor of them
or the heirs executors administrators or assigns of such survivor to sell
my said Real Estate or any part thereof during the life or Widowhood of
my said Wife with her consent in writing in the same manner as I have
directed the sale thereof after her decease or marrying again but the annual
Income to arise from the Purchase Monies for the same shall be paid and
applied in the same manner as the Rents of such Real Estate would have
been paid and applied pursuant to the trusts of this my WIll if no such
sale had taken place I direct that the receipt or receipts of my said Son
James Pepper and the said Samuel Wale or the survivor of them or the
heirs executors administrators or assigns of such survivor as well to any
purchaser or purchasers of my said Real and Personal Estates as on all other
requisite occasions under the trusts of this my Will shall be good and
effectual discharges for so much money as shall therein be expressed to be
received and that the persons paying them or him any monies and taking

such receipt or receipts shall not afterwards be required to see to the
application of the monies therein expressed to be received nor be answerable
or accountable for the misapplication or nonapplication of the same I also
direct that my said Trustees and the survivor of them and the heirs
executors administrators or assigns of such survivor shall not be
answerable for each other nor for the acts deeds or defaults of each other
even though joining in any act for the sake of conformity nor for any
loss or misfortune which may befal the said hereditaments trust monies
and premises unless the same shall happen through their wilful neglect
or default And also that they may with and out of the said trust monies
and premises reimburse themselves and each other all costs and expenses
incurred in or about the execution of the aforesaid trusts or any of them
And I devise all of the Estates which now are or at the time of my decease
may be vested in me upon any trust or by way of Mortgage unto my said
Son James Pepper and the said Samuel Wale their heirs and assigns
subject to the trusts and equities affecting the same respectively And I
appoint my Son James Pepper and the said Samuel Wale joint Executors
of this my Will and I authorize and empower them to settle compound
and adjust and debts claims or transactions relating to my personal
Estate and Effects In Witness whereof I have hereunto set my hand
this eighth day of May in the year of our Lord One thousand
eight hundred and fifty two
