I Richard Eland of Market Harborough in the County of Leicester Wesleyan
Minister do hereby declare this to be my last Will and Testament hereby
revoking all other Wills by me at anytime heretofore made I appoint my
two Sons Richard Eland of Gloucester in the County of Gloucester Wesleyan
Minister and William Eland of Market Harborough aforesaid Bookseller
and printer to be my Executors I direct that my Wife Lucy shall have such
part of my Household Goods Furniture plate linen and china as she may
select for her use during her life and immediately upon her decease the
same form part of my general residuary personal Estate I Give devise
and bequeath all my Real and personal Estate whatsoever and
wheresoever the same may be and of what nature or kind soever and all
my right title and interest therein at the time of my decease whether in
possession reversion remainder or expectancy unto the said Richard
Eland and William Eland their heirs executors administrators and
assigns according to the nature and quality thereof respectively
nevertheless Upon the Trusts and to and for the ends intents and purposes
hereinafter declared, That is to say Upon Trust to collect and get in all such
part of my personal Estate as shall consist of money or Securities for money
and to collect and get in all debts sum and sums of money due and
owing to me and forthwith or at such time or times as they or he shall
think fit and from time to time to sell by public Auction or private contract
in such Lots as they shall see fit all my said Real and personal Estate
which shall not consist of money or Securities for money and to buy in and
resell the same or any part thereof from time to time without liability
for any loss that may be occasioned thereby and subject to such special
conditions or otherwise as they may see fit for the best price or prices that
can be gotten for the same and to perfect and complete any Contract or
contracts for sale entered into by me or to abandon the same as they
shall see fit And to stand possessed of the monies to arise from such Sale
or Sales and conversion and collection of my assets Upon Trust in the
first place to pay all my just debts Mortages and interest and funeral
and testamentary expenses and the costs and charges of and incident
to such sale or sales and the performance of the trusts of this my Will and
in the next place to invest a sufficient sum on Government or real or
personal security to the satisfaction of my said trustees on their or his

name or names and from time to time to vary and transfer such security
as they shall see fit and to pay an annuity or yearly sum of Twenty
pounds to my wife Lucy for and during the term of her natural life to
be paid to her by Two equal half yearly payments the first of such
payments to begin and be made within Three calendar months after
my decease and to divide the surplus and residue of the aggregate
proceeds of my said real and personal Estate equally between and
amongst my five children namely Richard Eland William Eland
Elizabeth Eland Eliza Sheppard the wife of William Sheppard of Great
Bowden in the County of Leicester Butcher and Sarah Eland as tenant
in common and not as joint tenants such shares to be vested interests in
them at the time of my decease and also upon the decease of my said
Wife to call in all the monies which shall have been invested for the purpose
of raising the said annuity of Twenty pounds and to pay and
divide the principal thereof in like manner together with the proceeds
of the sale of the Furniture and effects given to my said wife for life
between my said five children in equal proportions share and share
alike as Tenants in common and not as joint Tenants or to the
Executors Administrators or assigns or representatives of such of
them as may be dead such reversionary share to be equally a vested
interest in each of them my said children at the time of my
decease And I direct that it shall be lawful for my son William
Eland to take the House and premises purchased by me of the Reverend
[J?] Cox and George Lamb situate in Market Harborough aforesaid
in part of which he now resides at the sum of Four hundred and seventy
pounds to be paid to him by my other Executor Richard Eland and to
form part together with the other proceeds of my general Estate and in
case he shall elect to take the same at that sum then I give and devise
the same to him his heirs and asssigns accordingly and if he refuses or
neglects to take the same at that sum within three calendar months
after my decease then the same shall be sold in the same manner
as is directed with respect to my other real and personal Estate And
declare that in case of the nonpayment of the said Annuity of Twenty
pounds to my said Wife or any part thereof within thirty days after
any of the half yearly days for the payment thereof it shall be lawful
for my said Wife to proceed by Action or plaint in the County Court

or otherwise against my said Executors to recover the payment thereof or
of such part thereof as shall remain unpaid And I hereby direct that it
shall be lawful for my said Trustees and Executors to allow to each other
and to pay all costs charges and expenses which they shall sustain or
be put unto in carrying into execution the trusts of this my Will and
that they shall not be answerable for any loss to be occasioned by any
Broker Banker or other person with whom any part of the assets of
my Real and personal Estate me be or be deposited nor the one of them for
the other or others of them but each for his own wilful neglect and
default only And that the receipt in writing of my said Trustees or the
Survivor of them their executors or Administrators shall be a good
and sufficient discharge to any person or persons paying any money
to them for so much money as shall be therein expressed to be received
and the person or persons paying the same shall not be bound to
see to the application thereof And in case my said Trustees or either of them
shall die or decline or become incapable to act in the Trusts of this my
Will before the same shall be fully satisfied it shall be lawful for the
surviving or continuing Trustee his heirs executors or administrators
to appoint some other person or persons either jointly with such
surviving or continuing Trustee or alone to act in the trusts of this my
Will and such Trustee so to be appointed shall have all the same powers
rights remedies and indemnities as if he or they had been originally
named and appointed in this my Will and my Estate real and personal
or the proceeds thereof or such part thereof as shall remain undisposed
of shall forthwith vest in such new Trustee either jointly with such
continuing Trustee or alone as the case may be Upon the Trusts of this
my Will so far as the same shall remain to be completed And further
that it shall be lawful for my Trustee or Trustees for the time being until
they shall see fit to make sale of my said real Estate to let any part
thereof which shall not be sold for the best and most improved annual
rent that they can obtain for the same from year to year without fine
and such rents and profits shall be applied after the satisfaction of the
annuity of Twenty pounds to my said Wife and the payment of such
repairs as may be requisite in the same way between my said five
children as the produce of the sale of such property is directed to be paid

In witness whereof I the said Testator Richard Eland have to this my
Will contained in three sheets of paper set my hand this fifteenth day of
November in the year of our Lord one thousand eight hundred and
fifty five ______ Richard Eland _______ Signed published and
declared by the said Richard Eland as and for his last Will and
Testament in the presence of us both present together at the same
time who in his presence and in the presence of each other have at his
request hereunto subscribed our names as Witnesses
