Will proved 24 November 1658
In the name of God Amen the fourth daie of February in the yeare of our Lord God one thousand six hundred fiftie and six: I Thomas Caly of the parish of Heathfield in the Countie of Sussex yeoman; being sicke in bodie but of good and perfect memorie (thank be given unto Almighty God) doe make and declare this my last will and testament in manner and forme following (thatvis to say) In primis I give and bequeath my soule into the hands of Almighty God, and my bodie to the earth, to be buryed in Christian buriall, in the churchyard of the parish of Heathfield in the countie aforesaif And as for those worldly goods the Lord hath bestowed upon me, I give and bequeath in manner and forme following (viz.) In primis I give and bequeath to the poore of the parish of Heathfield the sume of twenty shillings of good and lawfull money of England, to be paid by my Executor hereinafter named unto the overseers of the poore of the said parish, and by them to be distributed amonge the poore of the said parish within one month next after my decease: Item I give and bequeath unto the poore of the parish of Heathfield the sume of twenty shillings of good and lawfull money of England to be paid by my Executor hereinafter named unto the Churchwardens or overseers of the poore of the said parish att my funerall by them to be distributed among the poore of the said parish: Item I give and bequeath unto my eldest son Thomas Caly all those my two messuages or tenements called or [?] by the name or names of Broadhurst, or by whatsoever other name or names they or any of them be called or [?] with all the land or landes thereunto belonging being all the houses and landes that I have situate, lying and being in the parish of Heathfield within the aforesaid countie of Sussex with their and every of their appurtenances: Item I give and bequeath unto my said son Thomas all my lands that I have situate, lying and being in the parish of Hallden in the countie of Kent with a Barne standing and being upon the same with all and every the appurtenances thereunto belonging: Item I will and bequeath unto my sonnes James, John, Edward, Richard, George and Steven, all those my two houses, with all my lands thereunto belonging, situate, lyinge and being in the parish of Brenchley in the countie of Kent, with all and every the appurtenances to the same belonging And also all that my messuage or tenement with all the land and appurtenances thereunto belonging situate, lying and being in the parish of Pembery in the countie of Kent, to be equally between those my five sonnes: Item I give and bequeath unto my said sixe sonnes James, John, Edward, Richard, George and Steven, All my moveable goods whatsoever And my will and true meaning is, that my Executor hereinafter named shall (after my debts and legacies are paid, and my funerall expenses discharged) sell all my moveable goods, and shall within the space of three yeares next after my decease, lay out and bestowe all the money of the said moveables (which shall come to his hands) upon certain landes which he shall think most fitt and convenient; And those landes so purchased shall be equally divided betweene my said sixe sonnes, James, John, Edward, Richard, George and Steven, And if it shall happen that any of my said sixe sonnes shall dye, and depart this naturall life, before he or they shall accomplish the age or ages of one and twentie yeares, Then my will and meaning is, that his or their parte in all the said landes, or landes and moveables, shall be equally divided between the survivors and my Executor also each to have his equall parte thereof: Item my will and meaning is, that Thomas Caly my eldest sonne, whome I make and ordaine sole Executor of this my last will and testament, shall be a guide unto my other sonnes until they accomplish their severall ages of one and twentie yeares; And that he shall have the disposing of them in the meane time, as shall be convenient, either to putt them to apprentice, or to bringe them up to learninge, or otherwise, as is meete and convenient for them; And that he shall have the disposing of each of their partes and portions, till they accomplish their several ages of one and twentie yeares, Then to be accomptable to them for the same, each of them paying and allowing him my said Executor whatsoever expenses and charges he shall be necessarily att, for or concerning them, or either of them (untill they accomplish the severall ages aforesaid), either in bringing up, schooling, putting to apprentice, or however otherwise it be. And if my wife shall desire to keepe or bring up my youngest sonne, she may doe it, And my Executor above named shall during the Childes minority pay her for the same, for the time she keepeth him. In witness whereof I have hereunto (abrogating and making null and void all former wills) sett my hand and seale the daie and yeare first above written.
