In the Name of God Amen I Thomas Toplis of Belper in the parish of Duffield and County of Derby Victualler being weak in body but of sound and disposing mind memory and understanding praised be Almighty God for the same do make and ordain this my last Will and Testament in manner and form following that is to say First I give and bequeath to my dear friend John Whitaker son of Andrew Whitaker one hundred pounds In Trust for the use of Sarah Hitchcock daughter of Sarah Hitchcock of Belper aforesaid spinster now an infant to be paid to her or her heirs at the decease of my said trustee: But with this special recommendation to his my said Trustee That if at any time after she the said Sarah Hitchcock shall have attained her full age of twenty one years it shall to him appear that the said legacy will conduce to her better settling and advancement in the world it is my earnest wish that he shall then pay it to her. But in case the said Sarah Hitchcock shall happen to die before she shall have attained the age of twenty one years or before she shall have received the said legacy and leave no heirs of her body lawfully begotten, then from and after her decease I give the said sum of one hundred pounds to my said Trustee John Whitaker and his heirs And All my Messuages Houses Lands Tenements and Hereditaments and real estate situate lying and being within the Liberty of Hazlewood in the parish of Duffield aforesaid or elsewhere in the county of Derby I Give and Devise to my beloved wife Sarah Toplis for and during the term of her natural life and from and after her decease I Give and Devise the same to the aforesaid John Whitaker his heirs or assigns forever. Also I Give and Bequeath all and singular the residue and remainder of my Personal estate of what nature or kind soever or wheresoever after my just debts and funeral expenses are duly discharged to my said Wife Sarah Toplis for and during the term of her natural life and from and after her decease I Give and Bequeath the same to the aforesaid John Whitaker and his heirs And Lastly I do hereby nominate, constitute and appoint the aforesaid John Whitaker and my friend Abraham Harrison of Belper Baker joint Executors of this my last Will and Testament In Witness whereof I have hereunto set my hand and seal this Eighth day of January in the year of our Lord one thousand seven hundred and ninety nine
