Last Will and Testament of Johann Gottfriedt Miller (abt.1730-abt.1753)

In the Name of God, Amen I Godfrey Miller of the City of New York, Yeoman, being at present sick and Weak of Body but of sound mind Memory and understanding, Make this my Last Will and Testament in Manner Following, that is to say, Imprimis: I Resign my Soul to God my Creator and my Body to the Earth there to be buried in Such decent manner as to my Executors herein after named Shall think proper. Item: I will that all my just debts and Funeral Charges be paid in some convenient time after my decease. Item: I Give and bequeath unto my dearly beloved wife Mary Miller my Son John Miller and my Child which is at present unborn all my Estate both Real and personal to be divided equally Share and Share alike when and at the time of each of my Children Coming at age but if in case any one of my Children die, the Surviving Child to have his or her part, if both die then their parts to Return to my said Wife and Will and desire is that my said Wife carefully bring up my said Children in the fear of God and when at a proper Season to put them to Learn a Trade whereby they may be Capable of getting a Livelihood, and Lastly, I do Nominate Constitute and appoint my True and Well beloved Friends Phillip Henry Rapp, Mathias Knecht to be my Executors of this my Last Will and Testament Revoking all Former Wills by me made. In Witness hereof I have hereunto set my hand and Seal, the twenty seventh day of August 1752.

Signed Seal publish pronounced and declar’d by the said Testator as and for his Last Will and Testament in the presence of us the Subscribers Joseph Hawsner Robert Case Charles Richardson.

Be it Remembered that on the thirteenth day of January 1753, Joseph Hausur one of the Subscribing Witnesses to the Within Written Instrument appeared before me Goldsbrow Banyar thereunto duly Authorized and made Oath on the Holy Evangelists that he saw Godfrey Miller sign or Make his Mark to the within Instrument purporting to be his, the said Godfreys Will and also Seal and publish and declare the same to be and Contain his Last Will and Testament. That at the Time thereof he was of Sound disposing mind and Memory to the best of his, the said deponents Knowledge and belief and that he the deponent and Robert Case and Charles Richardson the two other Witnesses thereto Subscribed their names as Witnesses to the said Will in the Testator’s presence.

To all to Whom these presents shall come or may Concern, Greeting. Know Ye that at the City of New York on the day of the date hereof, before Goldsbrow Banyar being thereunto delegated and appointed, the Last Will and Testament of Godfrey Miller, deceased (a copy whereof is hereunto annexed) was proved, and now approved, and allowed of by me: The said deceased having Whilst he Lived, and at the time of his death, Goods Chattels and Creditts within this province, by means Whereof the proving and Registering the said Will and the Granting Administration of all and Singular the said Goods Chattels and Creditts and also the Auditing allowing and Final discharging the accompl thereof doth belong unto me and that Administration of all and Singular the Goods Chattels and Creditts of the said deceased and any way concerning his Will was Granted unto Phillip Henry Rapp and Mathias Knecht the Executors in the said Will named, being First Sworn well and Faithfully to Administer the same and to make and Exhibit a True and perfect Inventory of all and Singular the said Goods Chattels and Creditts and also to Render a just and true account thereof when thereunto Lawfully requested. In Testimony whereof I have Caused the prerogative Seal of the province of New York to be hereunto affixed this thirteenth day of January one thousand Seven hundred and Fifty three.
