State of Alabama v. John Chism, deft} … on the 2d Monday after the 4th Monday in Sept in the year 1826 William Kennon foreman, (names of other jurors listed) … returned unto Court & exhibited a bill of prosecution(sp?) against the defendant in form following, to wit:
The Grand Jurors for the State of Alabama … on the 1st day of July 1826 there was and yet is a common and public highway in the county afsd called the Road from Turkey Creek to intersect Crabb’s Road at Cardwells Hatter Shop – 3 precincts for all the citizens of our country to go pass and repass ride …. with their horses, coaches, carts and carriages in and along the same way at their free will and pleasure and that a certain part of the same common and public highway to wit Precinct No 1 extending from the top of the Hill north of Turkey Creek to North River in said county over which John Chism was the overseer was at the time aforesaid and for more than 15 days together between that time and the 20th day of August last out of repair miry deep less than 20 feet wide with stumps more than 6 inches above the surface of the ground for want of due and needful and necessary reparation and amendment of the same by the overseer aforesaid contrary to the form and effect of the statute in such cases made and provided and against the peace and dignity of the State of Alabama. (Signed by grand jurors).
Whereupon on the 15th day of January in the year afsd the sd State of Alabama by Constantine Perkins Esqr attorney General … sued out a writ of capias ad respondendum agt the defendant directed to the Sheriff of said county in the following words and figures, to wit:
… commanded to take the body of John Chism ... safely keep so that you have his body before the judge of our next circuit court … on the 2d Monday after the 4th Monday in February instant …. for neglect of duty as overseer … Feb 15, 1827. Signed: John M Jenkins, Clerk.

give and bequeath unto his daughter Caty Nolen Freeman during her natural life his two negro girls Milly and Bet and after her death for them the said negro girls and their future increase to be equally divided among the bodily heirs lawfully begotten of the said Caty Nolen Freeman.
Now know ye that I Lewis Chism of the County of Tuscaloosa and State of Alabama the husband by lawful marriage of Betty Chism who is one of the lawful bodily heirs of the said Caty Nolen Freeman am by virtue of said marriage with my wife Betty entitled fully and in my own right after the death of the said Caty Nolen Freeman to an equal share with her other lawful bodily heirs in the two negro girls Milly and Bet afsd and their increase under the said last will and testament of Henry Maddox afsd and their increase under the said Last will and testament of Henry Maddox afsd.
And that I the said Lewis Chism have this day for and in consideration of the sum of 100 dollars to me in hand paid by Nimrod Freeman of the County of Tuscaloosa and State of Alabama the receipt whereof is hereby acknowledged released assigned confirmed … unto the said Nimrod Freemand … my right title … to the said Negro girls Milly and Bet and all their increase …

… And whereas she paid to me in June 1862 Confederate money the said sum of 100 dollars. Now therefore, for and in consideration of the premises and the said sum of 100 dollars to me in hand paid as above stated, I have bargained, sold and conveyed and do by these presents bargain sell and convey unto the said Rilla Chism and her heirs the above described lands together with all the tenements appurtenances and heredaments thereunto belonging and all the right, title, interest claim or demand whatever of the said Robert Cook of in and to said land.
