Will

Memorandum that I Major Rawbone of Allesley in the County of Warwick Cooper being aged but blessed be God of sound mind
and memory doe make this my last Will and Testament in manner following ffirst I give and devise unto my son in Law John Pomfrey and my daughter
Elizabeth his wife All that my messuage or tenement wherein I live and all buildings Orchards Gardens backsides and appurten[an]ces thereunto belonging And
all those two little meadows called Stanleys And all that little Close or Pingle called Topps of trees scituate lyeing and being in the Parish of Allesley aforsaid
To have and to hold to the sayd John Pomfery and Elizabeth his wife for and dureing the Severall terms of theire naturall lives and the life of the longer liver
of them without Impeachment of Wast other then involuntary and wilfull pulling downe houses and buildings And from and after the death of the survivor of them
the sayd John Pomfery and Elizabeth his wife My mind and will is that the said messuage or tenement Closes and Lands shall descend come remaine and bee unto my
three Grandsons Thomas Pomfery John Pomfery and Samuell Pomfery theire heires and assignes forever But my mind and Will is that the said messuage and
Lands notwithstanding the before menconed devises shall be chargeable with the payment of the yearly Rent or sume of fforty shillings of Lawfull money of England
to my deare wife Mary and her assignes for and dureing the terme of her naturall life to be paid at two dayes of payment in the yeare that is to say the five and twentieth
day of March and the nine and twentieth day of September by two even porcons The first payment thereof to begin at such of the sayd dayes as shall next happen after my
decease And in case the said yearly rent of fforty shillings to be be hinde or unpaid in part or in all at either of the sayd dayes of payment on which the same ought to be paid as
aforesaid It shall and may be Lawfull to and for the said Mary my wife and her assignes into and upon the sayd mesuage or tenement Closes Land and p[re]misses before
menconed and every or any part thereof from tyme to tyme to enter and distraine for the said yearly Rent of forty shillings and for the Arrears thereof (if any such
shall be) And the distresse and distresses there from time to time to bee taken and had to leade drive take and carry away impound detaine and Keepe untill she and her assignes shall
of the sayd yearly rent of forty shillings and Arrears thereof (if any shall bee) be fully satisfyed And my Mind and Will also is my said wife shall have the use and benefitt of the
Chamber with the Chimney in my sayd mesuage And the use and benefitt of One halfe of the Garden called the new Garden for so long of her naturall life as she shall
continue A widow and my Will is that my Executor hereinafter named shall finde and provide my wife her dyett for the space of one yeare next after my decease or else pay or
allow unto my wife foure pounds in lieu thereof which my wife shall thinke best I also give unto my wife the Bed and Bedstedd in the Chamber over the Kitchen with the
Boulster thereto belonging and the Curtaines and vallence belonging to the bed in the Chamber with the Chimney in and the Greene Hilling upon the same Bedd and one
Blankett one high Chaire one Lowchaire one Trunck One little Chest and One box all in the said Chamber with the Chimney in also I give to my said wife the Bible with brass
Clasps One greate spining Wheele two little spinning wheeles two pewter dishes and the greate brass Kettle I also give unto my said wife on[e] paire of fflaxen sheets one paire of
hem[pe]n sheets One table cloath One dozen of Napkins [an]d three Pillow beers which my wife hath made si[nce sh]e was marryed I also [giv]e unto my said wife One Cow and my
min[d and] Will is my sayd wi[fe] shall have dureing he[r life all] the fruit that [shall] grow upon One Apple t[ree ... and] that [...]ver the Pitt and is comonly called
[... I g]ive unto [my da]ughter Sarah Garne[r ... the sume of ... pounds of La]wfull english money [to be paid ... next] after my decease. Also I
g[ive and beque]ath unto my d[aug]hter Rebeccah the sume [... pou]nds of Law[full m]oney of England to be pa[id ...]eares nex[t after] my decease also I give and bequeath
the s[ume] of fforty pounds of La[w]full english money to be [give]n to the hands of the [ov]erseers of this my Will he[reaf]ter named within tw[o yea]res next after my decease or into
whose hands my said Overseers shall direct and appoint the payment of the same to be putt forth to Interest for my said daughter Sarah G[ar]ner to have and receive the benefitt
and Advantage thereof dureing her naturall life And imediately after her decease my mind and Will is the said fforty pounds be payd unto my Grandaughter Sarah Garner
but my Will is my sayd Overseers shall not be chargable with the sayd fforty pounds or any part thereof unless they shall actually receive the same nor by any loss that may
happen by placeing forth the same to Interest other wise then by theire or either of their respective wilful defaults And my Will is that the one of my Overseers shall not be chargeable with the Act
or default of the other of them also I give unto my Grandson Nathaniell Chiswell the sume of twenty poundsof Lawfull english money if that he lives to attains the Age two yeares after my decease
And if it shall please God my said Grandson Nathaniel Chiswell shall dye before that tyme then I doe give and bequeath the sayd sume of Twenty pounds unto my Grandson Jeremiah
Chiswell the sayd sume of twenty pounds to be paid him two yeares after my decease ~ ~ ~ also I give unto my Cozen Mary Austin the sume of ten shillings and I doe
give and devise unto my said son John Pomfery All that my Close called the Hursh into three parts divided And also All that my Close called Hooke close or Hooke wast with theire
and every of theire appurten[an]ces lyeing and being in Allesley aforesaid To have and to hold the same to the said John Pomfery his heires and assignes forever upon speciall Trust
and Confidence nevertheless And to the End and intent that my said son John Pomfery his heires and assignes shall and may sell or dispose of the same for the raiseing of moneys
for the performance of this my Will and the payment of the before menconed Legacyes and every of them or of such or soe much of them and every of them as my personall Estate will
not Amount to satisfy and pay And my Will is that in case my said two Closes called Hurses and Hooke Wast will not be sufficient with my personall Estate to pay the s[ai]d severall Legacies
and every of them that then my said mesuage with the appurten[an]ces & meadows called Stanley's and close called Topps of trees shall be chargeable with the payment of soe much of them as my said
personall Estate and other Lands shall fall short to pay and of such charges as any of my respective Legatees may be putt unto in recovering of theire respective Legacyes or any
of them in case any suit or trouble may happen touching the same (which I hope will not bee) by my Will is the same shall still remaine chargeable to my wife as aforesaid All the rest
and residue of my household Goods not herein before by mee given and bequeathed I give unto my said daughters Sarah Elizabeth and Rebeccah to be equally divided amongst them
share and share alike And I doe make my sonn in Law John Pomfery sole executor of this my last Will and testament And I doe devise give and bequeath unto him all my Goods
Chattells and Testamentary estate whatsoever not herein before by me given and bequeathed the better to Enable him to performe this my Will And I doe hereby declare
that what I have by this my Will given and devised unto my said Sonn John Pomfery and Elizabeth his wife is in lieu and full satisfaccon of all claymes and
demands which they or either of them may have or clayme out of my Estate for or by reason of any bond Writeing or Agreement Entred into by me to or with
the sayd John Pomfery upon his marriage with my said daughter Elizabeth And I doe desire my loveing ffreinds Mr Thomas Lander the elder and my Cozen Thomas
Paddy the elder to be Overseers of this my Will And I doe give to each of them ten shillings A peice for the paines and case they shall take therein And I doe desire my
Executor and Children to be advised by them touching this my Will And if any difference should happen betweene any of my said Children or Legatees (which I hope will not
be) that the same be reconciled and determined by my sayd Overseers In Witness whereof I the above named Major Rawbone have to this my last Will and testament putt my hand and
seale this thirteenth day of November in the fifth yeare of the reigne of our soveraigne Lord and Lady William and Mary now King and Queene over England &c Annos D[omi]ni 1693
