Smither
This is the last Will and Testament of me
Sarah Smither of Chipping Norton in the County of Oxford Widow
I Give and devise all that my Freehold Messuage or tenement situate
and being in Chipping Norton aforesaid and now in my own occupation with
the outhouses buildings garden fixtures appurtenances thereunto belonging unto my
Nephew William Huckvale Son of my Brother Jonathan Huckvale his heirs and assigns
for ever I Give and bequeath to my sister Hannah Francis the sum of Two
hundred pounds sterling the same to be paid to her by my Executors hereinafter named
at such time or times and in such way manner and form as they my said Executors or
the survivors or survivor of them shall in their or his discretion see fit for her own
exclusive use and benefit whose receipt alone notwithstanding her coverture shall be
a good and sufficient discharge to the person or persons paying the same I
Give and bequeath (subject to the proviso hereinafter contained) to my
Sister Mary Goatley the sum of Two hundred pounds sterling I Give and
bequeath to my Sister Rebecca Huckvale the wife of William Huckvale of
Over Norton in the said County of Oxford Yeoman the like sum of Two hundred
pounds sterling I Give and bequeath to my Niece Mary Gibson the like
sum of Two hundred pounds sterling I Give and bequeath to my Brother
James Huckvale the sum of Three hundred and fifty pounds sterling I Give
and bequeath after and subject to the payment of my just debts funeral
and Testamentary expenses All my household Goods and furniture plate linen
china and Implements of Household and all the rest residue and remainder of my
monies and securities for money personal Estate and effects whatsoever and
wheresoever and of what nature or kind soever I may be possessed of or entitled to
at the time of my decease to the several Legatees hereinafter named and in
the proportions following (the share of the said Mary Goatley to be subject
to the proviso hereinafter contained) that is to say One eighth part thereof
to the said James Huckvale One other eighth part thereof to my Brother
the said Jonathan Huckvale One other eighth part thereof to my said
Sister Hannah Francis One other eighth part thereof to my said Sister
Mary Goatley One other eighth part thereof to my said Sister Rebecca
Huckvale One other eighth part thereof to the said Mary Gibson One
other eighth part thereof to my said Nephew William Huckvale and the
remaining one eighth part thereof to my two Nephews Thomas Huckvale
and Robert Huckvale Sons of my late Brother Samuel Huckvale to be
equally divided between them and to take as Tenants in Common Provided
always and my Will is that my Executors hereinafter named or the survivors or
survivor of them or the executors or administrators of such survivor do and shall pay
the Legacies or shares given to or intended for my said Sister Mary Goatley and all
accumulations thereof at such time or times and in such way manner and form as they
my said Executors or the survivors or survivor of them his executors or administrators
shall in their or his discretion see fit for her own sole and separate use and benefit
And I direct that the same or any part thereof shall not be subject to the
control debts or engagements of her present husband and that the receipt and
receipts aboue of my said Sister notwithstanding her coverture shall be a good and
sufficient discharge and good and sufficient discharges for the same and in case the
said legacies or shares or any part or parts thereof shall remain unpaid at the
time of the decease of my said Sister Then I Give and bequeath the said
Legacies or shares or so much and such part or parts thereof so unpaid as aforesaid
to such person or persons as my said Sister shall by her last Will and Testament
Give or bequeath the same or in default of such Gift or bequest then I Give and
bequeath the said Legacies or shares or so much and such part or parts thereof so
unpaid as aforesaid to the children of my said Sister living at her decease equally to
be divided between them if more than one And I appoint my Brother the said
James Huckvale the said William Huckvale of Over Norton and my said Nephew
William Huckvale Executors of this my Will hereby revoking all former Wills
by me at any time heretofore made And I do hereby declare that they my
said Executors shall not be answerable thr one for the other of them or for the
signing receipts for the sake of conformity or for any involuntary loss And that it
shall be lawful for them to reimburse themselves all costs charges and expenses which
they may expend or put unto in the execution of the trusts aforesaid or in relation
thereunto In Witness whereof I the said Sarah Smither have to this my last Will and
Testament contained in two sheets of paper to each sheet thereof set my hand the thirtieth
day of October One thousand eight hundred and forty three

her last Will and Testament in the presence of us who in her presence at her
request and in the presence of each other have hereunto subscribed our names
