Transcription

THIS INDENTURE made and entered into by and between Will Greenwell and his wife Rachael Greenwell of Waverly Union County, Ky., of the first part and Howard Greenwell and his brother George Greenwell of the second part
WITNESSETH:
That the parties of the second part have this day undertaken and agreed to pay to Drury & Drury of Morganfield, Ky. a fee of $50.00 for defending Sam Greenwell upon the charge of assault with intent to kill now for and in consideration thereof and other good and valuable consideration the parties of the first part have bargained and sold and do hereby sell and convey unto the parties of the second part and their heirs and assigns forever, a certain house and lot in Waverly Union County, Kentucky being the same property acquired under deed dated Feby. 29th 1888 and now of record in deed book 38 at page 588 in the office of the clerk of the Union County Court. This property the parties of the second part are TO HAVE AND TO HOLD unto themselves and their heirs and assigns forever with covenant of general warranty of title except as against a mortgge given to John M. Crowe upon the 23rd day of Feby. 1907 to indemnify him as surety upon the bail bond of said Sam Greenwell for $200.00. In witness whereof the parties of the first part have hereunto set their hands this the 25th day of February 1907.
