The State of Texas} County of Smith} June 10, 1891

Be it known that James F Kendrick of the County and State aforesaid being of sound mind and realizing the uncertainty of life, and the certainty of death, and appreciating the importance of having my worldly affairs arranged. As I desire them do make and declare this to be my last will and testament, hereby revoking and all others that may have heretofore been made by me.

First, I desire, and it is my will, that all my just debts be paid should I have anything at the time of my death.

Second, I herely Will and bequeath unto my beloved wife M.U. Kendrick all of my property of every kind, and character, real personal and mixed, and absolute letter to the same shall be vested in her when this will, has been probated as required by law. And she shall use and enjoy, and dispose of the same as she may choose, And ant deed on other instrument of conveyance that she make to any part of the real estate that I may accrue, on we may both [?] at the date of my death, all of which is hereley willed and bequeathed to my beloved wife M.U. Kendrick as foresaid shall be as valid as any deed that we can on might make jointly before my death.

Third, I hereby nominate, constitute and appoint my said wife M.U. Kendrick executor of this my last will and testament, and it is my will and desire that she shall not be required to give bond in any seen on amount whatever as such Excutrix, And further it is my will and desire, that no proceedings be ad in the Probate Court relative to me Estate except to file an inventory and appointment of the property and probate and record this my will as required by law. In testimony whereof I hereunto subscribe my name in the presence of Jeff B Burns, Joel Bell & Jime Lee, the subscribing Witness n this 10th day of June 1891. Signed and seal, J.F. Kendrick

To How B.B. Beaird, County Judge of Smith County Texas.

M.U. Kendrick shows that J.F. Kendrick died on the 16th day of July A.D. 1891 in Smith County Texas, leaving real and personal property of the estimated value of $2500.00 dollars and a will duly executed as petitioner believe that the said J.F. Kendrick at the time of his death resided in Smith County, State of Texas that your petitioner M.U. Kendrick was named as executor in said will and is capable of executing all trust as required by said will and accord with law.

Wherefore she prays that notice of this application be given by citation duly posted and that said will be probated and that letters issue as required thereall.

Gives notice all persons interested in estate to appear before Honorable Count Court, of Smith County, at Court House in, in the City of Tylor on the Third Monday in November, A.D.1891, when and where they may legally contest the same.

Given under my hand and seal of said Court, at my office, in the City of Tyler, this 24 day of October, A.D. 1891.
