This is the last will and testament of me Abraham Goodwin the elder of Goldsitch Moss in the township of Quarnford in the parish of Alstonefield in the county of Stafford Yeoman

First I direct that all my just debts my funeral and testamentary charges and expenses and the legacies by me hereinafter given and bequeathed shall be paid and retained by my executors hereinafter named out of my personal estate as soon as conveniently maybe after my decease

I give and bequeath unto Mr George Goodwin of the Wash in the Township of Quarnford aforesaid and Mr George Bullock of Barleyford in the Tiwnship if Wincle in the County of Chester whom I hereby appoint Executors of this my Will the sum of two pounds and as a small token of respect over and above all reasonable charges for their time trouble and expenses in carrying into execution thus my Will and as to all that my real estate with the rights privileges and appurtenances thereunto belonging situate in Rushton James in the Parishes of Leek and Storton or one or both of them in the County of Stafford I give and devise the same unto the said George Goodwin and George Bullock their heirs and assigns nevertheless upon the several Trusts hereinafter mentioned that is to say Upon Trust to pay or otherwise permit and suffer my dear wife Ann Goodwin and her assigns to receive the rents issues and profits thereof for and during the term of her natural life provided she continues my widow she keeping the buildings upon the same premises in good and tenantable repair but in case my said wife shall marry again then I give and bequeath to her the sum of ten pounds only to be paid her out of the rents and profits of my said real estate and from and after the decease or second marriage of my said wife then

Upon Further Trust to receive the rents issues and profits of my said real estate and pay and equally divide the same unto between and amongst all and every my children Abraham Thomas Richard Joseph and Ann and their respective assigns for and during their respective natural lives and from and after the decease of any one or more of them my said children then Upon Trust to pay the share it respective shares as well accruing as original of him her or their my said children so dying as aforesaid of un and to the rents issues and profits of my said real Estate unto and equally amongst the survivors or survivor of, them my said children until such time as my said real estate shall become saleable by virtue if the provisos next hereinafter contained and I do hereby declare that the share as well as original as accruing of my said daughter of in and to the rents

issues and profits of my said real estate shall be for her own sole and separate use and disposal and wherewith no husband she may happen to intermarry shall intermeddle nor shall the same be subject or liable to his debts control or engagements but her receipt alone shall be a good discharge to my said trustees for the same

Provided always and I do hereby expressly declare my Will to be and do hereby direct that they my said trustees or the survivor of them or the trustee or trustees to be appointed as hereinafter mentioned or otherwise for the time being acting in the execution of the trusts of this my Will shall and do as soon as conveniently May be after the decease of the survivor of the, my said children make sale and absolutely dispose of my said real estate either altogether or in lots and either by public auction or by private contract as they or he shall think proper for the most money that can be reasonably had or gotten for the same and on receipt of the purchase money do and shall convey and assure the same to the purchaser or purchasers shall require and I declare that the receipt or receipts of my said trustees or trustee for the time being shall be a good and effectual discharge for such purchase money or purchase monies and for any other monies payable to them or him under this my Will without such purchaser or purchasers or other persons paying such money being answerable or accountable either for the application or misapplication thereof and I do hereby declare that my said trustees or trustee for the time being acting in the execution of the trusts of this my Will shall stand possessed of and interested in the monies to arise from the date of my said real estate and the rents issues and profits thereof that shall accrue or become due from the decease of the survivor of them my said children In Trust for and to pay and equally divide the same unto betweeen and amongst all and every my grandchildren that shall be living at the decease of the survivor of them my said children their executors or administrators in equal shares and proportions for their respective absolute use and benefit and to and for no other trust intent or purpose whatsoever and I give and bequeath to my said dear wife the use and enjoyment of all and singular my household goods and furniture and all other my personal estate and effects whatsoever and wheresoever and of what nature or kind so ever for and during the term of her natural life they my said trustees and executors first taking an account and making an inventory and valuation thereof to be signed by my said wife and kept by them and after the decease of my said wife then I give and bequeath the

same personal estate unto and equally to be divided between and amongst all and every my said children share and share alike for the absolute use and benefit provided also and my will and mind further is and I do hereby direct if the said George Goodwin and George Bullock or either of them or any future trustee or trustees to be appointed as hereinafter is mentioned should happen to die or be desired of being discharged from or refuse or decline or become incapable to act in the trusts hereby in him and them respectively reposed before the same trusts shall be fully performed and satisfied then and in every such case and when and as often as the same show happen its shell and me and look below for for the said George Goodwin and George Bullock all the survivor of them all the executors or administrators of such survivor with the consent and approbation of my said wife if living testified by some writing under her hand but if she shall be dead than of their or his own proper authority by any writing or writings to be by them or him sealed and delivered in the presence of and attested by one or more credible witness or witnesses from time to time to nominate constitute and appoint any other person or persons to be a trustee or trustees in the l,ace or stead of the Tustess or Tustees so dying or desiring to be discharged from or declining or becoming incapable to act as aforesaid and when and so often as any new trustee or trustees shall be nominated and appointed as aforesaid all the said trust estates monies securities and funds shall be thereupon with all convenient speed conveyed assigned and transferred in such manner and so that the same shall and May be legally and effectually vested in the surviving or continuing trustee or trustees and such new trustee or trustees jointly or if there shall be no continuing trustee of the same trust estates monies and premises then in such new trustee or trustees only to for and upon such and the same trusts subs interests and purposes as are hereinbefore declared of and concerning the same trust estates monies and premises or such of them as shall be then subsisting or capable of taking effect and that every such new trustee or trustees shall and may in all things assist and act in the management carrying on and execution of the trusts to which he or they shall be so appointed in conjunction with the other then surviving or continuing trusts or trustees of the same trust estates monies and premises if there shall be any such continuing but if there shall be no such surviving or continuing trustee or trustees then by himself or themselves and shall have all the same powers and authorities as fully and effectively to all intents constructions and purposes whatsoever as if he or they had been originally in and by this my Will nominated a trustee or trustees for the

purposes for which such new trustee or trustees respectively shall be appointed any thing hereinafter contained to the contrary in any wise notwithstanding

Provided also and my Will and mind further is and I hereby expressly declare that my said trustees hereinbefore appointed and the trustee or trustees so to be appointed by virtue of the proviso last hereinafter contained and each and every of them and the heirs executors and administrators of each and every of them respectively shall be charged and chargeable only for such monies as the same trustees respectively shall actually receive by virtue of the trusts hereby in him and them reposed notwithstanding his or their giving or signing or joining in giving or signing any receipt or receipts for the sake of conformity and that none of them shall be answerable or accountable for the other or others of them ^nor for the acts receipts neglects or defaults of the other or others of them ^ out each of them for himself and for his own acts receipts neglect or defaults only and also that it shall be lawful for them my said trustees and all and every trustee and trustees for the time being of this my last will their heirs executors and administrators at all times in the first place by and out of any monies which shall come to their respective hands to deduct and reimburse himself and themselves respectively and pay and allow to his and their co trustee and co trustees all such costs charges and expenses as he they or any of them shall incur sustain or be put onto including a reasonable sum for their loss of time in and about the execution of the trusts of this my will or in relation thereto any thing hereinbefore contained to the contrary in any wise not with standing and I do hereby revoke and make void all former and other Will and wills and testamentary dispositions whatsoever by me at any time heretofore made and Claire this is only to be my last will and testament

In witness where of either said Abraham Goodwin the test data after this my last will and testament contained in four sheets of paper set my hand and fixed my seal to the last sheet heroes the 10th day of December 1833
