In the name of God Amen. I Archibald Webster of the county of Taylor and state of Kentucky being weak in body but of disposing mind and memory knowing that it is appointed for man to die do constitute and ordain this my last will and testament. To wit, I give my Soul to God who gave it and my body to its mother earth and as to my property or substance with which it has pleased God to bless me, Ii desire that it be disposed of in the following manner.
Item 1st It is my will and desire that as soon as may be after my decease that all my just debts be paid
Item 2nd I give unto my beloved wife Ann W Webster during her natural life the following property and after her death to be disposed of in the manner hereinafter provided for. to wit So much of the tract of land on which I now live containing 600-700 acres including the mansion house and furniture as she may choose also so much of my estate both personal and mixed as she may think proper. Also the following named slaves, to wit 1st Yellow Joe, 2nd Harrod, 3rd Betsy 4th Amelia 5th Lucinda, 6th Charles Henry, 7th Styora, 8th Caty, 9th Zarel, 10th Martha, 11th Abraham, 12th Jarrold, 13th Lucinda, sr
Item 3rd I give and bequeath unto my daughter Martha W Williams, the following property, to her and her heirs forever, to wit, the slaves Amelia at $450, Zarold at $500 both of which slaves she has had in possession for some time, at my death she is to have Richmond also at my wife's death she is to have $300 and retain the following property now in her possession to wit 1 bed and furniture at $25, 1 horse, saddle and bridle at $65, 1 cow and calf $10, 15 sheep at $15, table furniture $10 Trunk $200
Item 4th To my son Thomas A Webster and his heirs I give the following property forever, to wit, Jo junior, which he has had some time in possession and at my death he is to have big Jo, sr and is also to have three hundred dollarsat the death of my wife to be made out of the property left her for life and is to retain one bed and furniture at $25, one horse, saddle and bridle at $110, one cow and calf at $12, one table at $8
Item 5th To my son James B Webster and his heirs forever I give and bequeath the following property forever, to wit, a negro boy name Tinsley at $500 who he has had in his possession for some time and at my death he is to have Lucy an old woman and Epps her son and is to retain the following property now in his possession to wit, 1 bed and furniture at $25, 1 cart at $15, I horse, saddle and bridle at $110, 1 cow at $9, 2 sows and pigs and 9 sheep at $15, table furniture at $16 Also cash paid for land $625.
Item 6th To my son W C Webster as trustee for his wife and children I give and bequeath the following property forever, to wit a negro boy John at $500, a horse saddle and bridle at $110, bedstead and furniture at $25, table and furniture at $16, 15 sheep for $15, a cow and calf at $10 all of which is now in his possession, except the cow and calf and is to have two hundred and fifty dollars in money at my death He is also in connection with Richard A Webster at my death to take possession of and hold in trust as above the remainder of the tract of land on which I now live, not taken by my wife as dower or directed by this will and at the death of my wife in the same connection is to take whole of the land taken by my wife as dower and divide the whole tract equally that is to say to W C Webster one M---- and Richard A Webster the other M---- and at the death of my wife aforesaid W C Webster is to have in trust one fourth part of all the property and slaves and their increase left to my wife for life in the 2nd clause of this will first taking out three hundred dollars given my son Thomas A Webster. Now my intention is to protect the wife and children of my son W C Webster and in order to accomplish that object I have left all of the above property to W C Webster as trustee for his wife and children and for no other use and in no event shall it be applied to the payment of his debts. It is stated above that W C Webster is to have one fourth of all the slaves and property left my wife for life, first taking out three hundred dollars left Thomas A Webster, there is left to my daughter Ann E Marshall a girl named Pauline, should she die of negro consumption the she is to have $380 to be taken out of the property left to my wife for life before division
Item 7th To my son Richard A Webster and his heirs I give and bequeath the following property forever To wit one negro boy name Phil at $500 also Archer in consideration of the confidence I entertain in his taking care of his mother and younger sister after I am gone hence also to have the horse saddle and bridle now in his possession rated at $80 and at my death he is to have one bed and furniture worth $25 one cow and calf worth $10 and table furniture to be worth $16 also 15 head of sheep
Item 8th To my daughter Ann E Marshall and her heirs I give the following property forever, To wit Paulina at $380 bur should said girl die of what is called negro consumption she to have $380 in lieu thereof to be taken out of the property left my wife for life after her death previous to a division as directed in another part of this will, also she is to have my boy George at my death at $280, She is also to retain one bed and furniture at $25, one bureau at $20 on table at $7, also horse, saddle and bridle at &70 all of which articles she has now in possession at my death he is to have a cow and calf at $10 also to have 15 sheep at $15 also to retain the table furniture she now has at $8
Item 9th To my daughter Mary Susan Webster and her heirs I give and bequeath the following property forever, To wit a negro girl named America at $300 and Clem at $500 and one bed and furniture worth $25, one bureau at $20 or $20 cash as she may chose, horse saddle and bridle to be worth $85 and $60 in cash
Item 10th It is my will and desire that the tract of land on which I live supposed to contain 600 to 700 acres be equally divided between W C Webster in trust for his wife and children and Richard A Webster to take at my death all the portion not taken by my wife as dower and at her death to take all of that part retained by her as dower but it is my will that each of my sons W C and R A Webster in four years from my death pay to my daughters, Ann E Marshall and Mary Susan Webster $600 dollars each, that is, the boys pay the girls $1200 to be equally divided.
Item 11th It is my will and desire that at the death of my wife that the whole of the 13 slaves and their increase together with all my estate both personal and mixed retained by my wife under the provision in the 2nd section of this will be equally divided between my four youngest children to wit William C Webster, as trustee for his wife and children and I hereby constitute and appoint him as such trustee with full powers to carry out the objects of the bequests herein made for the benefit of his wife and children and for no other purpose whatsoever, Richard A Webster, Ann E Marshall and Mary Susan Webster, first taking out the special devises before made in this will
Item 12th I herby direct that the money arising from my crop of tobacco now in market also the crop of tobacco that may be made the present year be appropriated to the payment of my debts, Funeral and administration expenses. and should there be a residue to be applied to the payment of such special devises as are to be paid in money and not provided for but should there not be enough to pay the debts after exhausting the surplus of perishable property of estate then my wish is my 4 youngest children all contribute an equal amount of such deficiency.
Item 13th I hereby direct that my Executors shall sell the tract of land that I purchased of F Dye containing 430 acres more or less for the best price that can be obtained and apply the proceeds as follows to wit in the first place a note of hand executed by me to William N Marshall for seventy eight dollars to be paid then the residue if any to go to the payment of a debt to Joseph W William money borrowed of him by my son W C Webster, it further my will and desire that my son Richard A Webster take charge for the boy Bill now in my possession and keep him until he is 20 years old at which time said boy is free.
Item 14th Finally it is my will and devise that my two sons William A Webster and Richard A Webster and my son in law John A Marshall my be the sole executors of this my last will and testament where of I have hereunto set my hand and affixed my seal this 23 day May 1849

At a County Court commenced and held in Taylor County at the court house in the town of Campbellsville on the 11 day of June 1849, the last will and testament of Archibald Webster, deceased was produced into court and the said will was proved by the oath of William Barnett one of the subscribing witness thereto have been signed sealed and delivered by the said Archibald Webster as his last will and testament and at the time of signing he believed him to be in his proper mind and memory and the same was ordered to be recorded. Whereupon the same together with this certificate hath been duly recorded in my office. Given under my hand this 13th day of June 1849
