This is the last Will and Testament
of me Beadon Paul Newton of Creech Saint Michael in the County

of Somerset Yeoman
I give and devise unto Thomas Danger of S.......
stile Clinton Trinity in the County of Somerset Gentleman and John
Dunning Dunning of Creech Saint Michael aforesaid Gentleman all my
lands tenements hereditaments and real estate wherever of freehold or
customary freehold copyhold or any other tenure of which I shall be
sised or possessed at the time of my decease and all my monyes securi-
ties for money farming stock goods chattels personal estate and
effects whatsoever which I have power to dispose of by this my will
unto and to the use of the said Thomas Danger and John Dunning
Dunning their heirs executors administrators and assigns upon the
Trusts following (that is to say) Upon Trust as soon as conveninet
after my decease to sell the same by public auction or private con
tract with liberty form time to time if occurs expedient to buy in
any part thereof at any auction and to rescind or vary the Terms of
and Contract for sale with bower also to enter into special conditions
and stipulations relative to Title or otherwise and to convey such
parts of the said residuary estate as from time to time shall be sold
in such manner as the respective purchasers thereof ..............
And I declare that such purchasers respectively shall be exonera
ted from all responsibility in respect of the application or the monies
paid by them respectively to the trustees of Trustee for the time being
of this my will. And I declare that my said Trustees shall stand
possessed of the moneys arising from such sale or sales after ...
oucting the expenses attending the same .... the Trusts therein af
ter expressed And I hereby declare that such part of my real
estate as may from time to time remain unsold and the rents and
profits thereof shall for all purposes be considered as personal
estate. And I declare that it shall be lawful for the Trustees or
Trustee for the time being of this my will to ...... or let at ....
.... my messuages orchard and hereditaments or any part or
any residuary real estate that may from time to time remain.........
And upon further trust to sell dispose of collect get in and convert
into money so much and such parts of my said personal estate
and effects as shall not consist of money And I hereby empower
my said Trustees or Trustee in execution of the said Trusts to com
pound for or allow such time or accept such security real or per
sonal for any moneys owing to me at the time of my decease as
by them or him shall be deemed expedient whether ..... so
compounded for shall be secured or not And I declare and at
test? that the Trustees or Trustee for the time being of this my
will shall stand possessed of the moneys arising from my said
residuary real estate and also from my personal estate and effects
Upon Trust thereon to pay my debts funeral and testamentary
expenses and all expenses incident to the Trusts thereby......
And upon Trust to pay the following Legacies that is to say To>br/>
my daughter Mary Webber Ralls the wife of Charles Ralls the
sum of three hundred pounds for her absolute benefit free from the
control or debts of her presnt or any future husband
To my daughter Charlotte Culverwell the wife of Jasper Culverwell
the sum of two hundred pounds for her absolute benefit free<brr/>
from the control or debts of her present husbamd or any future husband
To my daughter Harriet Jane Newton the wife of George Newton
the sum of two hundred and fifty pounds for her absolute benefit
free from the control or debts of her present or any future hus
band
To my daughter Ann Boyer the wife of Robert Boyer the
sum of to hundred and fifty pounds for her absolute benefit free
from the control or debts of her present or any future husband

my daughter Emma House the wife of Thomas House the sum of two
hundred and fifty pounds for her absolute benefit free from the control or
debts of her present or any future husband
To my daughetr Julia Newton
the sum of three hundred pounds free from the control of may future husband
for her own absolute use and benefit also to my said daughter Julia
Newton my best bed bedding and bedstead and furniture now in my
..... room also my likeness painted in oil
And upon further trust
to pay the following legacies that is ton say,
To my son Thomas
Webber Newton the sum of one hundred and fifty pounds
To my son
George Newton the sum of two hundred pounds
Tomy son Edmund
Newton the sum of two hundred pounds
To my son John Newton
the sum of two hundred and fifty pounds
To my son Beadon Newton
the sum of two hundred and fifty pounds
To my son James Newton
one shilling And upon further trust that should there be any surplus
amounting to fifty pounds then the same to be paid to my said son
James Newton and if the surplus amount to more than fifty pounds
the surplus of the said fifty************ to be equally divided among
each of my said children as shall be then living upon the conditions
and in manner aforesaid
Also I give and devise unto and to the
use of the said Thomas Danger and John Dunning Dunning and
their heirs all tenements and hereditaments vested in me as a
Trustee or Mortgagee subject to the Trusts and equities affecting them
same respectively
And I appoint the said Thomas Danger and
John Dunning Dunning (Executor) in Trust of this my will and
revoke all former wills and testamentary depositions by me
heretofore made and publish this alone as my last Will and Tes
tament Provided lastly and I declare that my said executors and
trustees of this my will shall not be answerable for each other or
for involuntary i.... and that the slal be allowed and may
claim all their costs and expenses to be incurred in the one execution
of the Trusts hereby in them reposed and that every person paying
money to such executors and trustees shall be exonerated from
all responsibility in respect of the application thereof
And I hereby
declare that the Trusteeship of the said executors ....... shall cease
after the one performance and execution of theTrust reposed in
them
In witness whereof I the above named Beadon Paul
Newton the Testator have to this my last Will and Testament
contained in three sheets of paper to this and the two previous
sheets of paper set my hand this eleventh day of September in
the year of our lord one thousand eight hundred and fifty one
Beadon Paul Newton - Signed Published and declared by
the said Beadon Paul Newton the Testator as and for his last
Will and Testament in the presence ofus both present at the same
time who in his presence and in the presence of each other have
hereto subscribed our names as witnesses [illegible]
Proved at London 25th October 1852 before the Judge by
the oaths of Thomas Danger and John Dunning Dunning the
Executors to whom administration was granted having been first sworn
by Commission duly to Administer
