In the Name of god Amen the second day of September In the year of our Lord God One Thousand Six Hundred Eighty and Nine I Benedicta Burnard of Gittishayn in the Parish of Colyton and County of Devon widdow being sick and weake in body but of sound and perfect memory praise be given to God for the same knowing the certainty of this mortall life and being desirous to dispose of those worldly goods which it hath pleased God to give me do I hereby revoke all former Wills by me made and I do declare this to be my last Will and Testament
First I commend my Soul to God who gave it me in hopes of salvation by the only merits of my Saviour Jesus Christ my Redeemer. And my body I committ to the earth whereof it was made to be ????? decently Interred as my Executrix hereinafter named shall think fit and convenient and do dispose of my said Worldly Estate as followeth
First I give and bequeath unto my daughter-in-law Rebecca Burnard widow twenty shillings of lawful Englishmoney
Item I give and devise unto my Grandson John Burnard son of the said Rebecca and to his heirs for ever all that Tenement in Coliton aforesaid called Shamphayne and Coomes ground and the lands called Hardyes Hill with their and every of their apputenances all being in the said Parish of Coliton
Also I give and devise unto my said Grandson John Burnard and to his heirs for ever all that house in Fish Street London near London Bridge with its appurtenances
Item I give and bequeath unto my Granddaughter Benedicta Burnard Eldest daughter of the said Rebecca fifty pounds like lawful money
Item I give and bequeath unto my Grandchildren Mary Burnard and Rebecca Burnard other daughters of the said Rebecca to each of them ten pounds of like lawful money
Item I give and bequeath unto my daughter Anne Bowdage my four cows now in my possession
Item I give and devise unto my said daughter Anne Bowdage that she shall have the profits use and occupation of my Living and Estate in Gitteshayne in which I live and of the houses at Red Crosse in Coliton aforesaid during her natural life she doing not voluntary to use or spoil therein
Item I give and bequeath unto my Grandson Tristram Bowdage of Exeter forty shillings like lawful money
Item I give and devise unto my Grandson Thomas Bowdage and to his heirs for ever all my lands houses and tenem. with their appurtenances at Bradninch in the said County of Devon
Item I give and devise unto my said Grandson Clement Bowdage his heirs and Executors all my right title and Interest and claim into and in one house garden and appurtenances in Colyton aforesaid near the Church ???? in the West late the house of Peter ???? deceased
Item I give to my Granddaughter Ann Bowdage daughter of the said Anne Bowdage three hundred pounds of like lawful money
Item I give and bequeath unto my Granddaughters Ellen Searle Mary Andrews and Benedicta Bowdage other dauhgters of my said daughter Anne Bowdage to each of them one hundred pounds of like lawful money
Item I give and devise unto my daughter Frances Marwood and to her Heirs and Assigns for ever all those my Messuages dwelling houses orchards gardens and appurtenances in the Borough and Parish of Honiton in the said County heretofore purchased of one ______ Webber
Item I give and devise unto my said daughter Frances Marwood her Heirs Executors and Assigns all that Tenement and Messuage and Lands with the appurtenances called Watchcombe and Crokerhayne in Coliton aforesaid and all my Interest right claim and title to the same
Item I give and devise unto my Grandson James Marwood his Heirs Executors and Assigns all my Estate right and title in and to one dwelling house and Messuage with the appurtenances heretofore in the possession of Hugh Buckland and now or late in the possession of one William Baker lying in Coliton aforesaid
Item I give and devise unto my Grandson Benedictus Marwood and his Executors and Assigns all my Estate right title and term of years of and in all that my Messuage and Tenement with the appurtenances called Hamberhayne in Coliton aforesaid lately purchased of the Lord Petre
Item I give and bequeath unto my Granddaughter Bridget Marwood daughter of my said daughter Frances Marwood one hundred pounds of like lawful English money
Item I give and bequeath unto my said daughter Frances Marwood in trust and for the use and benefit of my daughter Mary Strode one hundred pounds of like lawful money
Item I give and bequeath unto my kinsman Daniel Marwood of Coliton three pieces of gold called guineas.
Item I give unto Sir Peter Prideaux Baronet and to Edmond Walrond Esq. to each of them two pieces of gold called guineas to buy them rings And I desire them to be Over- seers and to be assistant to my Executrix hereinafter named in the performance of my will
Item I give unto Sarah Whitt wife of Francis Whitt of Coliton aforesaid twenty shillings
Item I give unto her sister Johane Heathfield twenty shillings
Item I give unto Thomas Moxhayes the use and occupation of the house in Coliton aforesaid wherein he now lives during his life he doing no voluntary waste and spoil on the same
Item I give unto twenty such poor people of the Parish of Coliton aforesaid not having relief of the said parish as my Executrix hereinafter named shall think fit fifty shillings yearly for four years next after my decease to be distributed by my Executrix
Item I give unto each of my great Grandchildren my Grandchildrens children five pounds apiece of lawful money
Item I give unto Joan Domette wife of Cadhayne two brass pans which I formerly bought of her
Item I give unto Willmot Moxhayes’ two children to each of them twenty shillings
Item I give and bequeath unto my Granddaughter Anne Bowdage all my right title and Interest in and to one house in Coliton of one Elizabeth Houseman ? otherwise Bowdage
All the rest of my goods lands rents and Tenements not before given my debts legacies and funeral expenses being paid and discharged I give devise and bequeath unto my said daughter Frances Marwood and to her Heirs Executors and Assigns for ever
And I do hereby make constitute ordain and appoint my said daughter Frances Marwood my whole and sole Executrix of this my last Will and Testament and do desire and appoint my said Executrix to pay my Legacies before given by this my Will within one year next after my decease
